B. OF ORDINANCE NO. 17- 90 ("COMPENSATION PLAN") AND DECLARING AN r EMERGENCY. I WHEREAS, Council has determined, upon the recommendation of the city L . Manager, that it is desirable to amend the above captioned section of .. Ordinance No. 17-90 ("Compensation Plan"); and, WHEREAS, Council believes that the amendment recommended by the City Manager is appropriate; . NOW, THEREFORE, Bf IT ORDAINED by the Council of the City of Dublin, state of Ohio, ~ of the elected members concurring: Section 1. That Section 7 ( "Vacation Leave"). subsection 7. B. of Ordinance No. 17-90 be, and hereby is amended by deleting the present verbiage contained therein and replacing it with the following: "An employee of the City who has prior service with the State of Ohio, or any political subdivision thereof, shall be entitled to receive credit for his/her prior service with these employers for the purpose of computing the amount of his/her vacation leave with the City. In addition, an employee who has prior service with a state other than Ohio, or any political subdivision thereof, may receive credit for such service with those employers, for the same purpose if, in the discretion of the City Manager and/or Personnel Director, the nature of said service is relevant to his/her service with the City of Dublin. Section 2. That this Ordinance be, and hereby is, declared to be an emergency measure for the reason that adoption of the above mentioned ,.. amendment is essential to the immediate hiring of a new City Engineer, . the appointment of which is critical to preserving the public safety , and welfare; wherefore, this Ordinance shall take effect and be in ~ force immediately upon passage. SUBJECT: Ord~nance No. 89-92 ~ DATE: June 11, 1992 INITIATED BY: David L. Harding, Director of Personnel & Purchasing ~ .~ During the recent compensation negotiations with the preferred candidate for the position of City Engineer, said candidate indicated that one of his requirements consisted of the ability to earn an annual vacation accrual of 24 days, which is consistent with his current allotment provided by his present municipal employer. Given the fact that said candidate has over 22 years of public service with the state of Illinois and two of its municipalities, over 17 years of which is at the municipal level, and the fact that said public service would be relevant to the nature of his service with the City of Dublin, staff believes that allowing this candidate to initially earn 24 days of vacation would be fair and reasonable. However, the existing provisions of the City "Compensation Plan" (Ordinance No, 17-90) only permit the City to recognize prior public service acquired through employment with the state of Ohio or its political subdivisions. No provision presently exists for recognizing prior public service acquired in other states or their political subdivisions. Therefore, the maximum vacation this candidate could earn during his initial year of service with the City would be five (5) days. Staff believes that this situation illustrates the need to revisit the present policy of the City regarding this matter, Attached for your consideration, therefore, please find Ordinance No. 89-92 amending Section 7 ("VACATION LEAVE"), subsection 7. B. of Ordinance No. 17-90 ("Compensation Plan"). Section 7., subsection 7, B. presently permits Staff to credit an employee with prior public service for the purpose of vacation leave computation. However, as noted earlier, subsection 7. B., as presently written, only permits Staff to provide credit for service acquired through employment with the State of Ohio or any political subdivision thereof. Ordinance No. 89-92, as attached, seeks to ;a.. amend Section 7, subsection 7. B. of Ordinance No, 17-90 to permit staff to , credit an employee with prior public service acquired within states other than ~ Ohio, or any political subdivisions thereof, if, in the discretion of the City ~ Manager and/or Personnel Director, the nature of said service is relevant to the employee's service with the City of Dublin. This amendment would enable staff to recognize the value of public service acquired outside the geographic boundaries of the state of Ohio when warranted and, therefore, Staff recommends that said amendment be adopted. Staff respectfully requests that Council consider Ordinance No, 89-92 as emergency legislation. Staff requests such for the reason that immediate approval of the above mentioned amendment is essential to the immediate hiring of a new City Engineer, the immediate appointment of which is in the best interest of preserving the public safety and welfare.
