AN ORDINANCE TO APPROPRIATE A PERMANENT
SEWER EASEMENT AND A TEMPORARY
r CONSTRUCTION EASEMENT IN AS. 0 ACRE TRACT
OWNED BY ELIZABETH A. HERDMAN, ET AL.,
..... LOCATED ON THE WESTERLY SIDE OF RIVERSIDE
DRIVE AT TULLER ROAD, PARTIALLY IN THE
CITY OF DUBLIN AND PARTIALLY IN THE
TOWNSHIP OF PERRY, COUNTY OF FRANKLIN,
STATE OF OHIO, AND DECLARING AN EMERGENCY
WHEREAS, the City of Dublin is preparing to improve Tuller
Road; and,
WHEREAS, said improvement will require the City of Dublin
obtaining a permanent sewer easement and temporary
construction easement in and to the premises described in the
attached Exhibit "A", located partially within the City of
Dublin and partially within the Township of Perry, Franklin
County, Ohio.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of
Dublin, state of Ohio, 7 of the elected members
concurring that:
section 1. A permanent sewer easement and temporary
r- construction easement in and to the premises located partially
in the city of Dublin and partially within the Township of
....... Perry, Franklin County, Ohio, and more fully described in the
legal description attached hereto as Exhibit "A", is hereby
appropriated for the public purpose of improving Tuller Road,
pursuant to Ohio Revised Code Chapter 163 and the Constitution
of the State of Ohio.
section 2. Council hereby fixes the value of the interests
appropriated at Eight Hundred Nine Dollars ($809.00), which
sum shall be deposited with the Franklin County Common Pleas
Court for the use and benefit of the owners of the property
appropriated. Upon such deposit, the city of Dublin shall
take possession of and enter upon the property pursuant to
law.
section 3. Council finds that the appropriation is
necessary for the stated purpose, that the City has been
unable to agree with the owners of the property, and that the
City intends to obtain immediate possession of the property.
Section 4. The City Law Director is directed to file a
petition for appropriation in the Franklin county Common Pleas
Court, to have a jury impaneled to assess the compensation to
be paid for the real estate herein described above.

\..., appropriated within the TULLER ROAD IMPROVEMENT FUND for the
purpose of paying all costs incident to such acquisition.

r- section 6. This ordinance is hereby declared to be an
emergency necessary for the immediate preservation of the
\.- public health, safety and welfare. The reason for such
necessity is that the prompt improvement of Tuller Road is
necessary due to the condition of an increased traffic flow on
Tuller Road. Therefore, this ordinance shall go into
immediate effect.

To the Council of the City of Dublin, Ohio:

As fiscal officer of the City of Dublin, I certify in connection with
your proposed issue of $4,100,000 notes (the Notes) to be issued in anticipa-
-" tion of the issuance of bonds (the Bonds) for the purpose of paying costs of
providing additional facilities at the Coffman Park Municipal Complex for the
conduct of municipal government operations by constructing, furnishing and
equipping a new police facility, and acquiring real estate and interests in
real estate and making site improvements thereon (the improvement), that:
l. The estimated life or period of usefulness of the improvement is
at least five years,
2. The maximum maturity of the Bonds, calculated in accordance with
Section 133.20 of the Revised Code, is twenty years. That maximum maturity is
based on my calculation of the average number of years of life or period of
usefulness of the improvement as measured by the weighted average of the
amounts proposed to be expended for the several classes of the improvement as
follows: $890,000 for land acquisition, thirty years; $4,083,490 for
build ings and other structures, twenty-five years; and $2,026,510 for
equipment, furnishings and site improvements, ten years; the weighted average
is therefore twenty years. The Bonds are to be paid from voted taxes approved
by the electors of the City and the voters approved those taxes and the Bonds
for a period of twenty years, If notes in anticipation of the Bonds are
outstanding for a period in excess of five years from the date of the original
issue of notes, the period in excess of five years shall be deducted from that
maximum maturity of the Bonds,
3. The maximum maturity of the Notes is twenty years,
