Roll Calla Davis, present Eberly, present Eger, present Karrer, present Shriver, present Thomas, present The minutes of the January meeting were read and approved., The annual report for 1957 was read. The following bills were submitted for payments Herb Jones - 16 hrs., cutting trees behind Fire House H. A. Bailey - hauling trash, street cleaning, etc., 21 hrs. Jack Frambes - 24 hrs. police service plus $1.20 for certified mail receipts Horace W. Jones - bonds for mayor, clerk, treasurer, marshall, and Shriver Guy Elbin, Franklin County Engineer - one load of cinders Columbus & Southern Ohio Electric Co. - current (Gen'l Fund) W. Ralph Jones - January Mayor's Court Mahlon Maxton Chevrolet - repairs on cruiser Franklin County Regional Planning Commission - dues Fred Dunn, County Auditor - Civil Defense 1957 & 1958 Baldwin & Sours - Radar Speed Meter Richard C. Netting - Frequency check on cruiser Thomas Motor Sales - Repairs on cruiser Shell Oil Company - Gas and oil for cruiser & tractor Standard Oil Company - Truck and cruiser expense Columbus & Southern Ohio Electric Co. - current (Street Fund) Public Employees Retirement System - amount deducted from police pay for 'month of January Jack Frambes - 10 hrs. police service Howard Lyons - 81 hrs. police service H. Shriver moved the matter of the appointment of a Village Solicitor be settled first 'in' order to solve . legal mat'ters involved. 'Mayor Jones then read a letter received from Russell Welch and a memorandum relatlv. to compensation to be paid to the Village Solicitor for general services 'and extra services rendered. Dis- cussion then followed and after each councilman versed his'opinion, Bernard Karrer moved the acceptance of Welch's proposition and the ~doption of the folloWing-Ordinance:' 6 "ORDINANCE NO. 02-58 a VILLAGE OF DUBLIN, OHIO Ordinance ratifying employment of Village Solicitor for the year 1958 and determining the compensation of the Village Solicitor of the Village of Dublin, Ohio. Be it ordained by the Council of the Village of Dublin, Ohio; all six of the members elected herein concurring. 9 SECTION 1. That Russel S. Welch, Attorney at Law, is hereby employed as Village Solicitor for the year 1958, and that said solicitor shall be paid the sum of $150.00 per year for ordinary services as solicitor including informal opinions and for attending approximately eight council meetings per year. That said solicitor be paid for the preparation of ordinances, resolutions, memorandums, contracts and legal opinions the sum of $10.00 per hour. That said solicitor be paid the sum of $10.00 pe~ hour for attendance at Mayor's Court. Said solicitor shall be paid for all trial work, the sum of $125.00 per day. For legal services incident to the prosecution or defense of legal proceedings, the sum of $lQ.OO per.hour. For legal services incident to all publ~c ~mprovements, including the preparatiQn of legal opinions on aspects of said improvemen't.,programs, the preparation of all memorandum, contracts, correspondence and the like, and for services in connection with the issuance of bonds and notes in payment thereof, the sum of $100.00 plus two (2) per cent of the total costs of said improvements. That said solicitor shall bill the Village quarterly and shall be paid quarterly for all services rendered as solicitor. . SECTION 2. That this ordinance be and the same is hereby declared to be an emergency measure necessary for the public safety and general welfare of the Village of Du~~in, Ohio, for the reason that the foregoing will enable the Village ~o have the services of a SOliC..i.tor and that this ordi~nce shall take effect I..... :nd be in force irrunediately uPf its passage." {' The motion was second by George Eger, actual vote thereon was as follows. KUImXID Davis, yes Eberly, yes Eger, yes Karrer, yes Shriver, yes Thomas, yes Shriver then called Welch notifying him of the acceptance and asked him to attend meeting. i I I . It was established that the men were suspended due to personality clashes rather.than the Mayor's own personal feelings toward the men or their negligence of their duties. Mayor stated men would continue to ,be suspended until time stated, i..e., February 9th, at which time both men were to ~eport for duty. It was pointed out, however, that if the men were suspended after that time, it would have to be for a different reason. The matter of the bill for Mayor's son, William Jones, Jr., who served as police officer forona week was discussed. Mr. Welch stated this could readily be taken care of by Ordinance creating third man and Council approving it. Eberly moved Council do not create a third job but to let duty fall upon Marshall as set forth in Ordiaance ~econded by Karrer. Roll Call: Davis, yes Eberly, yes Eger, yes Karrer, yes Shriver, yes Thomas, yes Davis asked if both men would continue in their present capacities after suspension was lifted. Both men stated they would. The clerk requested approval of Council to pay bills just once a month, including salaries, in order for Council to approve all bills before being paid. Shriver moved the bills be paid once a month, seconded by Thomas. .. ~~u ,Gall: . The matter of paying the two policemen a week's vacation, which they were not entitled to, was again discussed. Solicitor Welch ,stated this could be readily taken care of after the probationary period.. Karrer then.moved the bills be paid as read, seconded by Davis. Roll Call: Davis, yes Eberly, yes Eger, yes Karrer, yes Shriver, yes Thomas, yes Karrer moved since the bill for services rendered by Mayor's son was withheld and not acted upon, Welch was asked to go further into the matter of the legality of payment of said bill, seconded by Shriver. Eberly moved the confirmation of the following ordinance: "ORDINANCE NO. 02-58 VILLAGE OF DUBLIN, OHIO. Ordinance ratifying the purchase of radar equipment. Be it ordained by the Council of the Village o~ Dublin, Ohio; all six of the members elected herein concurring: SECTION 1. That the purchase of police radar equipaent for the police cruiser ". f 8- . as of the date of January 6, 1958, is hereby ratified and confirmed as to said purchase of said radar equipment at a consideration price of $897.60. SECTION 2. - That this ordinance be and the same Is hereby declared to be an emergency measure necessary for the public safety and general welfare of the Village of Dublin, Ohio for the reason that the foregoing will enable the Village to hav.e police service and that this ordinance shall take effect and be inforce ; immediately upon its passage."
