AN ORDINANCE AUTHORIZING THE CllY MANAGER
TO ENTER INTO AN AGREEMENT WITH WASHINGTON TOWNSHIP
FOR SNOW REMOVAL SERVICES,
AND DECLARING AN EMERGENCY

- WHEREAS, The Washington Township Board of Trustees has requested that the city of Dublin provide
snow removal service to certain Township streets, and
WHEREAS, a mutual agreement/contract has been reached between the City and the Township; and
WHEREAS, said services are deemed necessary to effect the safest travel conditions possible.
NOW THEREFORE BE IT ORDAINED, BY THE COUNCIL OF THE CITY OF DUBLIN, STATE OF
OHIO. 7 OF THE ELECTED MEMBERS CONCURRING THAT:
Section 1. That, the City Manager is hereby authorized to enter into an agreement with the Washington
Township Board of Trustees for snow removal services,
Section 2. That this Ordinance is hereby declared to be an emergency measure for the immediate
preservation of the public safety and welfare in accordance with Sections 4.06 and 4.07 (A) (6) of the
Dublin Charter.

SUBJECT : Snow Removal Services for Washington Township
- Staff recommends the Ordinance (attached),
approval of 120-95
authorizing the City Manager to enter into an agreement with
....... Washington Township Board of Trustees in order that the City can
provide snow removal service for the Township's streets/roads.
The washington Township Board of Trustees approached the City for
these services as a result of losing personnel and experiencing
equipment difficulties.
Dana McDaniel and Danny Johnson assessed the situation given
current equipment and personnel resources and negotiated a level of
service to the Township that would not negatively impact the City's
existing service level. A system of priorities will stretch
existing equipment and personnel resources to accommodate the
Township's desired service level during moderate snow events.
The reason we are able to meet the additional demand is because all
but one of the Township's streets/roads are residential side
streets which will technically receive last priority. However, an
advantage to both the City and the Township is that some of the
Township's streets/roads are integral to our established districts
and/or trucks are already operating in the immediate area.
Key points of the contract include:
- a. The term of the contract will be through May 1, 1996, at
which time it will be re-evaluated.
b. The Township compensates the City $50 per hour and
- reimburses the City for actual salt usage.
c. Prioritizes streets for service and establishes at what
point Township streets/roads will be serviced.
Exhibit A to the attached contract explains the service to be
provided. Also attached is a Memorandum to the Township Trustees. ,

SUBJECT: Snow Removal Service
Please find attached a proposed contract for snow removal service.
Basically, the City agrees to provide snow removal service (salting
and plowing of roads/streets) to those roads/streets listed in
.. Exhibit A. We took an odometer reading of these streets and found
them to be 11.6 lane miles.

We feel that the best ,way to charge for th1S serV1ce 1S on cost per
hour rate and cost per ton rate for salt usage. The $50 per hour
rate in this contract is based upon the recent fee study conducted
for the City of Dublin and is our typical charge for services
conducted by the Division of Maintenance. The cost per ton for
salt charge is a straight pass through of the City'S cost for salt.
Salt charges will be based upon our estimation of usage. This is
similar to how we currently charge the Township for salt use.
It is my understanding that the Township intends to use its truck
to remove snow at your facilities and parks and that this truck
will not be available for our use on the Township's roads. Our
only concern is that the City possesses a fleet which is designed
for its needs and does not have significant "slack" to adjust for
additional requirements, especially if we experience breakdowns.
I don't anticipate significant delays in meeting your service
expectations even if we experience a significant number of
breakdowns. As you know, we deliver a high level of service and
would anticipate providing no less to your residents. An advantage
we have is that most of the streets/roads to be serviced in the
Township are integral to our established districts and trucks are
.. already operating in the immediate area.
Please be advised that this contract, if you approve it in concept
tonight, can be addressed by Dublin City Council as early as
-- December 18. Therefore, I need to hear from you on Wednesday so I
can prepare the needed legislation for Thursday's council packet.
Council will be able to pass this as an emergency measure in that
it is ,clearly a public safety concern.
I apologize for not being able to attend your meeting tonight.
However, I can be reached at home should you have any questions
(228-6502). Do not hesitate to call.
In the interim, we will continue to provide assistance to you
should any more snow events occur prior to the execution of this
agreement.

WASHINGTON TOWNSHIP & CITY OF DUBLIN
CONTRACT FOR SNOW REMOVAL SERVICES
THIS CONTRACT, entered into as of this day of , 1995,
by and between Washington Township (hereinafter referred to as the
"Township" ) and the City of Dublin (hereinafter referred to as the
"City")~
..... ARTICLE I - SCOPE OF SERVICES

I The City agrees to provide services as specified in Exhibit A.

ARTICLE II - TERM OF CONTRACT
This contract shall become effective immediately and shall be in
effect until May 1, 1996.
ARTICLE III - TOWNSHIP RESPONSIBILITIES
The Township shall accomplish the following:
1. Give prompt notice to the City whenever the Township observes,
or otherwise becomes aware of any fault or deficit in the service
or any non-conformance with this contract.
2. The Township shall designate a point of contact to represent
the Township on a day-to-day basis and notify the City as to who
shall serve as this point of contact. The point of contact:
a. Shall have the ability to authorize the city to begin and
terminate services.
b. Shall coordinate services with the City.

~ 3. Shall monitor the contract to ensure full compliance with this
contractual agreement.

ARTICLE IV - CITY RESPONSIBILITIES
The city shall accomplish the following in addition to Exhibit A:
1. ' Execute the services as defined in Article I and within the
designated time frame.
2. Give prompt notice to the Township whenever the City observes,
or otherwise becomes aware of any fault or deficit in the service
or any non-conformance with this contract.
3. The city will provide the Township after each service,
notification of all services performed and an assessment of the
need for additional services.

4. The City will provide all labor, tools, vehicles and materials
required to perform the services as identified in this contract and
Exhibit A.
ARTICLE V - COMPENSATION AND PAYMENT

a. The City shall be compensated for services as follows:
...... 1. $50 per hour for labor, equipment and fuel costs.
2. $37.78 per ton of salt used. (due to not having scales,
salt usage will be approximated)
b. The city shall invoice the Township monthly for services
rendered during the period of the contract. Said invoice shall
itemize hours spent and salt used.
ARTICLE VI - TERMINATION
The Township may, by written notice to the City, terminate this
contract prior to May 1, 1996, if the city fails to perform any of
its material obligations hereunder, and does not cure such failures
immediately upon notification from the Township specifying in
detail such failures. Provided such termination occurs prior to
completion of the Scope of Services herein, the Township agrees to
pay the City for work actually performed in accordance with the
terms of this Contract through the cancellation date.
ARTICLE VII - This Contract shall be governed by the laws of the
State of Ohio.
- ARTICLE VIII - INSURANCE
The city shall secure and maintain at its own expense insurance for
.... protection from claims under Worker's Compensation acts for damages
because of bodily injury including personal injury, sickness or
disease or death of any and all city employees or of any person
hired by the City other than such employees.
The City shall secure and maintain, , at its own expense, General
Liability insurance in an amount not less than One Million Dollars
($1,000,000) per occurrence.
The City shall secure and maintain, at its own expense, Automobile
Insurance, inclUding coverage for non-owned and hired autos, with
a combined single limit of not less than Five Hundred Thousand
Dollars ($500,000) per occurrence.

The City shall secure and maintain, at its own expense, Property
Insurance for protection from claims or damages because of damage
to or destruction of property including loss of use resul ting
therefrom in an amount not less than Five Hundred Thousand
~ ($500,000). In addition, the city shall hold the Township harmless
- for any damage to its tools/equipment unless it can prove
negligence on the part of the Township, its employee(s)/agent(s).

The above referenced insurance shall be maintained in full force
and effect during the life of this Agreement. Certificates showing
that the City is carrying the above referenced insurance in at
least the above specified amounts shall, upon request, be furnished
to and approved by the City prior to the start of work on the
project and before the Township is obligated to make any payment to
the City for the work performed under the provisions of this
contract. The Township shall be immediately notified if any of the
foregoing insurance is cancelled, not renewed, reduced, or
otherwise materially altered during the term of this contract.
ARTICLE IX. NON-WAIVER
Nothing in this contract including, without limitation, the
insurance provisions herein before provided, shall in any way serve
to supersede, waive, limit and/or otherwise affect any rights,
privileges and/or immunities afforded to either party under
applicable law, including, but not limited to, those contained in
Chapter 2744 of the Revised Code of the State of Ohio.
IN WITNESS THEREOF, the parties hereto have executed this Agreement

EXHIBIT A
SCOPE OF SERVICES
1- Snow removal shall mean the salting and plowing of snow/ice
covered streets/roads for the purpose of providing the safest
travel conditions feasible. In the case of icy streets, the City
may use sand or a sand/salt mixture to improve traction.
- 2. The City shall provide snow removal services for Washington
- Township. Priorities of snow removal are as follows:
- a. Key intersections and hills
b. Primary Roads
c. Secondary Roads
d. Residential side streets
3. Township roads/streets will be prioritized in the same manner
as above but will be second priority to city roads/streets. For
example, all Dublin key intersections and hills will be done first
then the Township's key intersections and hills. Next will be the
City's primary roads/streets then the Townships primary
roads/streets. Next will be Dublin's secondary roads/streets then
the Township's secondary roads/streets. Next the city's
residential side streets then the Township's residential side
streets.
4. The Township streets/roads to be serviced include but are not
limited to:
a. Shier Lane - Residential Side Street
b. Holiday Lane - Residential Side Street
c. Fischel Drive North and South - Residential Side Street
d. Woerner Temple - Secondary
- e. Alleys in Amlin - Residential Side Street
f. Vintage Lane - Residential Side Street
g. Baldwin Road - Residential Side Street
- h. Indian Run - Residential Side Street
i. Bellaire - Residential Side street
