AN ORDINANCE ACCEPTING THE LOWEST AND
BEST BID, ON A PRICE PER UNIT BASIS, FOR
PORTABLEI MOBll..E RADIOS & ACCESSORIES,
--- AUTHORIZING THE CITY MANAGER TO ENTER
INTO A CONTRACT FOR THE PROCUREMENT

WHEREAS, after advertising and receiving bids on a price per unit basis for
portable/mobile radios and accessories~ and,
WHEREAS, Council has determined that the bid submitted by Motorola Communications
& Electronics, Inc. For said equipment, as listed in the attached bid tabulation, is the
lowest and best bid~
NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, I of the elected members concurring:
Section 1. That the bid submitted by Motorola Communications & Electronics, Inc. for
portable/mobile radios and accessories, as listed in the attached bid tabulation, is hereby
accepted.
Section 2. That the City Manager is hereby authorized to enter into a contract with
Motorola Communications & Electronics, Inc. for the procurement of said equipment
--.. based upon the per-unit prices specified within the said bidder's bid proposal on file within
the Division of Personnel & Purchasing.

Section 3. That this Ordinance is declared to be an emergency measure necessary for the
preservation of the public health, safety and welfare in that portable radio communications
equipment is needed within the Division of Police as soon as possible to ensure the
continuation of effective operating levels and the provision of the most responsive public
safety services possible. Therefore, this Ordinance shall take effect and be in force
immediately upon its passage.

Attached for your consideration please find Ordinance No. 97-95 accepting the lowest and best
bid for "PortableIMobile Radios & Accessories". Also attached for your reference is the bid
tabulation form. This purchase involves the acquisition of portable ("hand held") units and mobile
("vehicle installed") units for use primarily within the Divisions of Police and Maintenance. Funds
for the purchase of this radio equipment were identified and allocated in the 1995 Budget. (A
total of approximately $36,000 was reflected in the 1995 Budget.)
As reflected on the attached bid tabulation fonn,bids were requested on a price per unit basis for
radios in three classes together with corresponding accessories. (These three classes include a
more complex, more sophisticated "hand held" unit for the Division of Police, a less sophisticated
"hand held" unit for the Division of Maintenance, and a "vehicle installed" unit also for the
Division of Maintenance.) The actual purchase will include a mixture of the three classes based
upon the relative needs of the Divisions of Police and Maintenance. Staifis attempting to pursue
lower cost alternatives in its purchase of radios by seeking to use less sophisticated "hand held"
- and "vehicle installed" models within the Division of Maintenance. These particular models are
L identified on the attached bid tabulation as B.1.a and b (alternates) and C.1. a (alternate) and
would be less costly yet would still provide compatibility with the City's existing and possible
future radio communications system.
As reflected on the attached bid tabulation, the City received one bid which was submitted by
Motorola Communications & Electronics, Inc. Such is not surprising in that each time the City
has pursued formal competitive bidding for radio communications equipment since its original
purchase in 1989, Motorola has been the only bidder. Staff believes this situation is indicative of
a "sole source" purchase in that, for reasons of compatibility, Motorola is the only company that
manufactures radio equipment that will meet the City's operational objectives and needs.
As mentioned previously, Motorola has provided the City with radio communications equipment
since 1989 when the City made the original purchase of equipment for the communications center
within the Division of Police. Since 1989, Motorola has been responsive to the City's needs and
Staff would recommend that Motorola's bid for the previously mentioned radio communications
equipment be accepted.

Staff would respectfully request Council to consider passage of the attached Ordinance as an
emergency. Staff apologizes for any inconvenience such a request may cause on the first reading,
however, an immediate need does exist within the Division of Police to obtain portable radios. In
order to ensure the continuation of effective operating levels and to provide the most responsive
...... public safety services possible, the additional radio communications equipment is needed as soon
