AN ORDINANCE AUTHORIZING THE CITY MANAGER
~ TO SIGN A COOPERATIVE AGREEMENT BETWEEN THE
OHIO DEPARTMENT OF TRANSPORTATION AND THE CITY OF
DUBLIN, OHIO FOR BRIDGE DECK WIDENING AT
_-,;_,oM RINGS ROAD OVER 1-270
WHEREAS, the Ohio Department of Transportation is currently in the process
of designing plans to replace the bridge deck at Rings Road over 1-270 in
Dublin, Ohio; and
WHEREAS, the Ohio Department of Transportation will design this project to be
fully compatible with the City of Dublin's planned improvement of the proposed
. Rings/Woerner- Temple Road; and
WHEREAS, the City of Dublin desires construction of a dedicated third lane to
serve adjacent properties efficiently and safely; and
WHEREAS, it is in the best interest of both parties to design and construct
projects in a cooperative manner and fulfill the requirement of the agreement
with Ashland Chemical Company;

NOW THEREFORE, BE IT ORDAINED, by the Council of the City of Dublin, State
of Ohio, '7 of the elected members concurring:

Section 1. The City Manager be and hereby is authorized to execute on behalf
of the City of Dublin the Cooperative Agreement, attached as Exhibit A,
between the Ohio Department of Transportation and the City of Dublin.
Section 2. That the City Manager or his designee be, and hereby is,
authorized to cooperate, review and approve construction plans for the bridge
deck widening at Rings Road over 1-270.
Section 3. That the this Ordinance shall take effect and be in force from and
after the earliest period allow by law.

SUBJECT: Cooperative Agreement Between the Ohio Department of Transportation and the
....... City of Dublin.
Attached, please fmd a copy of the proposed ordinance authorizing the City Manager to execute
a proposed Cooperative Agreement with the Ohio Department of Transportation regarding the
bridge deck widening at Rings Road over 1-270.
Dublin's participation in this project was initiated by the City and insures that the design of the
1-270 Rings Road overpass is fully consistent with the proposed RingsIWoemer- Temple Road as
included in the Southwest Area Plan of the City of Dublin. Additionally, this agreement insures
compatibility with the replacement and widening of the bridge culvert on Rings Road near Paul
Blazer Parkway by the Franklin County Engineer's office. Both of these improvements will also
help fulfill the requirement of the Economic Development Agreement with the Ashland Chemical
Company.
The estimated City's share of construction costs is $500,000, and is expected to be bid in 1997.
1 recommend approval of the Agreement by the City Council.
After replacement and widening of two bridges on Rings Road, 500-600 feet of pavement
- between the two bridges will remain two lanes wide, which would create a traffic bottle-neck.
It will be most desirable to widen this gap to three-lane widths. The cost of this work could be
$50,000 to $100,000. The Franklin County Engineer's office has agreed to perform this
...... construction at Dublin's expense in conjunction with their work. 1 strongly recommend approval
of this work.

Exhibit A
COOPERATIVE AGREEMENT
BETWEEN
THE OHIO DEPARTMENT OF TRANSPORTATION
AND
THE CITY OF DUBLIN
WHEREAS, the City of Dublin has identified the need for and proposes the
Jf!"-..,."1l construction of a portion of the public highway which is described as follows:
To widen Rings Road bridge over 1-270 to accommodate two through
~"".o!ii lanes, a turn lane, bikeway and sidewalk on both sides of bridge.
Said portion of highway within the municipal corporation limits being
hereinafter referred to as the improvement, and
WHEREAS, the City further desires cooperation from the Director of
Transportation in the planning, design and construction of said improvement.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Ohio:
Section 1. (Cooperation)
That the City of Dublin hereby requests the cooperation of the Director
of Transportation in the cost of the above-described improvement as follows:
(a) The Ohio Department of Transportation will provide design plans,
replace the bridge deck, and provide the construction inspection
for the improvement.

(b) The City agrees to assume and contribute one hundred percent
(100%) of any additional right-of-way.

(c) The City agrees to assume and contribute one hundred percent
(100% of construction costs for the additional widening, currently
estimated at $500,000. The City further agrees to assume and
contribute one hundred percent (100%) of the total cost of those
items requested by the City which are not necessary for the
improvement, as determined by the State and Federal Highway
Administration.
(d) The Director of Transportation will cooperate and coordinate it's
construction with the Franklin County Engineer for the
construction coordination of the Rings Road bridge culvert
replacement located just east of the improvement.
Section 2. (Consent)
That it is declared to be in the public interest that the consent of said
City be and such consent is hereby given to the Director of Transportation to
JIIIII'!i.'''' construct the above-described improvement, in accordance with plans,
specifications and estimates as approved by the Director.
- Section 3. (Traffic Control Signals and Devices)
That traffic control devises installed within the limits of the project will
conform with Section 4511 of the Ohio Revised Code.
Section 4. (Maintenance and Parking)
That upon completion of said improvement, said City will thereafter keep
said highway open to traffic at all times, and

(a) Maintain the improvement in accordance with the provisions of
statute relating thereto and make ample financial and other
provisions for such maintenance, and
(b) Maintain the right-of-way and keep it free of obstructions in a
manner satisfactory to the State of Ohio and hold said right-of-
way inviolate for public highway purposes and permit no signs,
posters, billboards, roadside stands or other private installations
within the right-of-way limits, and

(c) Place and maintain all traffic control devices conforming to the
Ohio Manual of Uniform Traffic Control Devices on the
... improvement in compliance with the provisions of Section
4511.11 and related sections of the Ohio Revised Code.
(d) Regulate parking in the following manner.
Prohibit parking in accordance with section 4511.66 of the
Ohio Revised Code, unless otherwise controlled by local
ordinance or resolution.
Section 5. (Right-of-Way, Utility Rearrangement and Damage and Liability
Responsibilities)
(a) That all existing street and public way right-of-way within the City
which is necessary for the aforesaid improvement, shall be made
available therefor.
(b) That the City will acquire any additional right-of-way required for
the construction of the aforesaid improvement.

(c) That arrangements have been or will be made with and
agreements obtained from all public utility companies whose lines
- or structures will be affected the said improvement and said
companies have agreed to make any and all necessary plant
removals or rearrangements in such a manner as to be clear of any
construction called for by the plans of said improvement and said
companies have agreed to make such necessary rearrangements
immediately after notification by said City or the Department of
Transportation.
(d) That is hereby agreed that the City shall, at its own expense,
make all rearrangements of water mains, service lines, fire
hydrants, valve boxes, sanitary sewers or other municipally owned
utilities and/or any appurtenances thereto, which do not comply
with the provisions of Directive H-P-508, inside or outside the
corporate limits as may be necessary to conform to the said
improvement and said rearrangements shall be done at such time
as requested by the Department of Transportation Engineer.
(e) That the construction, reconstruction, and/or rearrangement of
both publicly and privately owned utilities, referred to in
~ subsections (c) and (d) above, shall be done in such a manner as
to not interfere unduly with the operation of the contractor
- constructing the improvement and all backfilling of trenches made
necessary by such utility rearrangements shall be performed in
accordance with the provisions of the Ohio Department of
Transportation Construction and Material Specifications and shall
be subject to approval by the State.
(f) That the installation of all utility facilities on the right-of-way shall
conform with the requirements of the Federal Highway
Administration Policy 23-CFR-645A and the Department of
Transportation's rules on Utility Accommodation.

(g) That the City hereby agrees to accept responsibility for any and all
damages or claims for which it is legally liable arising from the
negligence of its officers, employees agents in the performance of
the City's obligations made or agreed to in sections (a), (b), (c),
(d), (e) and (f) hereinabove. Likewise, the State agrees to accept
responsibility for any and all damages or claims for which it is
legally liable arising from the negligence of its officers, employees
or agents in the performance of the State's obligations made or
agreed to in sections (a), (b), (c), (d), (e) and (f) hereinabove.
