NOW, THEREFORE, BE IT ORDAINED by the council of the City of
Dublin, state of Ohio, 7 of the elected members
concurring:
section 1. That the following described real estate (see
attached map marked Exhibit "A") situated in the city of
Dublin, State of Ohio, is hereby rezoned to PUD, Planned Unit
Development District and shall be subject to regulations and
procedures contained in Ordinance No. 21-70 (Chapter Eleven of
the Codified Ordinances) the city of Dublin Zoning Code and
amendments thereto.
Section 2. That application, Exhibit "B", including the list
of contiguous and affected property owners, and the
recommendations of the Planning and zoning Commission, Exhibit
"C", are all incorporated into and made an official part of
this Ordinance and made an official part of this Ordinance and
said real estate shall be developed and used in accordance

force from and after the earliest period allowed by law.

..."-,..~ Muirfield Village Phase 45
- The basic tenet of the concept plan for Phase 45 echoes the primary goals
outlined in the original Master Plan for Muirfield Village. Ecology-conscious planning will
create a quiet park-like environment to enhance the lifestyle of its residents and preserve
the aesthetic beauty of the tranquil terrain.
Muirfield Village, phase 45, consists of one parcel of land bordered by Muirfield
Village phase 30 and Avery Road. The parcel has an area of 23.525 acres. The
proposed extension of Grey Friar Way to the west shall serve as the access to proposed
Muirfield Village Phase 45.
In December of 1988, the parcel was made subject to the provisions of the
original General Warranty Deed of Muirfield Village, a copy of which is attached hereto.
The property became subject to the assessment of the Muirfield Association, Inc. and to
all of the restrictions of record that apply to Muirfield Village. Design standards and
architectural review are now in place for any improvement placed on the property as is
shown on the General Warranty Deed for Muirfield Village and the Proposed covenants
and restrictions that will be added to the criteria for construction.
-" The total number of single family lots to be developed is 38. The gross acreage
to be developed within Phase 45 is 23.525 acres. Right-of ways, including Avery Road
and the proposed streets is 4.005 acres. The proposed density of single family lots is
1IIit..... equivalent to 1.6153 units to the acre. Total open/green space net of existing and
proposed right-of-way is approximately 4.337 acres which is equal to 18.4357 percent of
the gross acreage. In May of 1990, the City of Dublin's Parks and Recreation Committee
met to determine the City's parkland dedication requirement as it related to Muirfield
Village, Phase 44 and Phase 45. The consensus opinion of the Parks and Recreation
Committee that the land east of Avery Road and north of Brand road would become
private parkland and a motion was passed to allow the parkland to be made part of the
Muirfield Association's reserve areas and maintained by the Association. (A copy of the
minutes from that meeting is attached hereto.
Average lot size within Muirfield Village Phase 45 is 15,000 square feet with a
minimum frontage along the building setback line of 100 feet. All building setbacks and
sideyard setbacks would be in conformance with other similar phases of Muirfi . ~ . -;--

Kent Underwood wanted to make sure that the Committee understands that
Muirfield Association is not the developer.
Janet stated that public vs. private has come up more and more in the
past year. Young mothers in Muirfield want to kno~ why there are no parks
in this area, mainly, no playgrounds, tot lots, etc. Janet stated that she
explains to them that Muirfield is a PUD (Planned Unit Development), and that
they do have open space in Huirfield.
Becky Saylor, Huirfield Association, felt that she should give a little
more background, Muirfield Association does not want the Committee to feel
that they just want Muirfield to keep growing.
Becky stated that there are several phases of Muirfield that were not
in the original PUD, these two parcels, 44 & 45 are among that group. In
1989 the developers of Muirfield were looking forward to the time when the
residents would take control of the Muirfield Association. Before the
residents took over the Association, developers tried to include as much land
as possible in Muirfield.
",",,''- Avery Road Park was part of the original PUD, as well as. some of the
,roperty on the southeast corner of Avery & Brand Roads.
Some residents of Muirfield do not want anymore land accepted into the
-development. The exception being the Griener Property, some prior
commitments were made on that land when the Deer Run School property w.as sold
to the City of Dublin, the Griener property was accepted as a trade-off in
1989 for the underpass.
Janet stated she was concerned as to where Muirfield was g~ing to end,
she looks at the ~ntire community, with the bond issue passing yesterday, we
can address the need for additional athletic fields and more playground space
and equipment, these are the needs that reach our office.
Becky Saylor stated that in regards to the need for playground
equipment, there is an incorrect statement in the Minutes, $50,000.00 has not

Denise King stated that she had been told by a mother in Muirfield that
the Common Grounds Committee had recommended that up to $ 50,00.0..00 be
allocated for the development of a playground in Muirfield.
It was stated that these minutes will reflect that Muirfield Association

parcel, totally surrounded by Huirfield within the boundaries of Brand and
Avery Road, be kept private as part of Huirfield Association and that the
Huirfield Association strive to encourage the development of facilities that

IV. Bill Andrews - Consultant on the Dublin Community Center
Kent Underwood asked if Bill Andrews was here to discuss a decision or
to discuss the analysis of the proposals received, the basis on which they
were analyzed, the rating system and the first cuts.
Kent Underwood then asked if he should leave the meeting at this time -
the firm he works for has submitted a proposal.
It was agreed that Kent leave the ~eeting. Kurt Hurto, Vice-Cnair then
took control of the meeting.
Bill Andrews then handed out several forms (see attached). that, he

In reviewing proposals question he asked himself. was - "who has . had
!xperience in programming Community Centers? Grading . geared in that

review the 11 submitted proposals for programming service for the proposed

The Planning and Zoning Commission took the following action at its special meeting:
1. Concept PlanIRezoning Application Z9S-015 - Muirfield Village, Phase 45
Location: 23.525 acres located on the east side of Avery Road, approximately 400 feet
south
of Memorial Drive.
Existing Zoning: R -1, Restricted Suburban Residential District.
Request: PUD, Planned Unit Development District (Muirfield Village).
Proposed Use: A single-family neighborhood of 38 lots and private open space.
Applicant: D & A Associates and Muirloch Realty, Inc. dba RFJMAX Muirloch, clo
Stephen C. Lenker, 6189 Memorial Drive, Dublin, Ohio 43017.

MOTION: To approve this concept plan/rezoning application because it meets the criteria
outlined in the concept plan and preliminary development plan requirements, the
subdivision is a logical expansion of the Muirfield open space and bike path
....',. system, and the project density, development standards and lot sizes are consistent
with adjacent phases of Muirfield Village with the following twelve conditions:
1iIIIIFI-"d 1) That the applicant replat Muirfield Village Phase 30 to allow access through Reserve
MMMM from Memorial Drive;
2) That "no vehicular access" from the three lots backing up to Memorial Drive be shown
on the final plat;
3) That the applicant meet with the engineering staff to discuss design of cul-de-sac islands
before proceeding with final designs;
4) That the retention basins shown in Reserve A be wet ponds designed according to the
requirements of the City Engineer and that access easement be provided;
5) That a tree preservation plan be submitted for this site, subject to staff approval;
