Form No. 30043 Ordinance NO.n ___2^~_-:':~_~___n Passed_______ ___ unn__________________ _n _________19n----- AN ORDINANCE TO UPDATE THE ARTERIAL TRAFFIC PLAN FOR THE CITY OF DUBLIN, AND r- DECLARING AN EMERGENCY ~ WHEREAS, the city of Dublin as part of the community planning process has established a comprehensive plan for rights-of- way, location and realignment of existing and future streets, highways, and roadways within the city of Dublin; and, WHEREAS, the ordinance establishing the Arterial Traffic Plan recognized and required the plan to be updated and amended when warranted; and WHEREAS, the city must develop a plan for a street system to preserve the health, safety and welfare of the general public as well as to create a desirable environment and promote economic growth; and WHEREAS, a uniform functional street system classification is needed by the private sector as a guide to likely future action with respect to the development of public streets; and WHEREAS, the City Administration, the Planning and zoning commission, the Board of zoning Appeals, and the council require a traffic plan on which to base decisions on zoning changes, variances, and conditional uses as well as publicly initiated capital improvement projects; and r- WHEREAS, the existing traffic plan was adopted on December 18, i L- 1995, which incorporated the 1988 Community Plan, the 1993 Southwest Area Plan, and other traffic studies adopted by the City; and WHEREAS, the City has recently undertaken analysis of the need for a roadway connection between Dublin Center Drive and Krier Drive, has sponsored a public information meeting on January 23, 1996 to review the study, and has determined that such a connection is appropriate and should be incorporated into the city Thoroughfare Plan; and WHEREAS, it is recognized that although the Thoroughfare Plan establishes general alignments and projected rights-of-way need for the city's roadway system, it does not in all cases reflect the results of detailed alignment studies which determine the feasibility of either obtaining all of the needed rights-of-way or constructing the planned roadway improvements, and may therefore, on a case by case basis, be subject to minor variations from the plan (such as combining public rights-of-way with abutting easements in order to accommodate all of the needed public roadway improvements) at the time of roadway implementation in order to fulfill the intent of the Plan; and fI""""o WHEREAS, the Thoroughfare Plan is currently being reviewed in ..... depth as part of a major update to the community Plan. NOW, THEREFORE, BE IT ORDAIN~ by the Council of the City of Dublin, State of Ohio, of the elected members concurr1ng. section 1- That the connection of Krier Drive and Dublin Center Drive, as recommended in the 1995 Barton-Aschman Associates study, be added to the "1995 Thoroughfare Plan" map. ---.- -"- ~,_~.. That the map entitled "1995 Thoroughfare Plan" Dublin, Ohio dated March 28, 1996, be and hereby is adopted by ,.. this Council as the minimum recommended standards for rights- } of-way, and replaces the exhibit in Ordinance 21-95. i t: , l...... Section 3. That the Thoroughfare Plan depicts the general location for needed roadway improvements, the precise location of which will be established by detailed engineering feasibility studies, land use patterns and alternate proposals which may emerge. Section 4. That the City Administration, the Planning and Zoning Commission, the Board of Zoning Appeals or the Council shall cause a review of the traffic plan at the conclusion of the current process to update the Community Plan and whenever there is the belief thereafter that the living, employment or traffic patterns have changed sufficiently to warrant such, but in no case less frequently than four (4) years, and shall submit proposed changes in the form of an amendment to this Ordinance. Section 5. That this Ordinance is declared to be emergency legislation necessary to ensure the health, safety and welfare of the residents of Dublin, and for the further reason that a pending rezoning application requires the City to amend the Thoroughfare Plan to provide for the connection of Krier Drive and Dublin Center Drive.
