WHEREAS, it has been determined that Chapter 150 of the Dublin Codified
Ordinances be amended, said section which adopted the 1992 CABO One and Two
Family Dwelling Code,
WHEREAS, the Dublin City Council, by reference on March 1, 1993 adopted the
1992 CABO One and Two Family Dwelling Code.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, K of the elected members concurring:
Section 1. That Chapter 150: Building Regulations, U50,(XH,
150,OO2(A)(B)(E)(F)(G)(H)(I), 150,003, 150,004, 150,005, 150,OO6(B), 150,022,
150,090, 150,091, 150.092, 150.093 be deleted,
Section 2. That ~150.001 of the Dublin Codified Ordinances be replaced with:

There is hereby adopted by reference the 1995 CABO One and
........ Two-Family Dwelling Code, including Appendix A (Manufactured
Housing), Appendix D (Swimming Pools) and Appendix F (Radon
Control Methods), of the Nationally Recognized Model Code,
which shall be known as the One, Two and Three-Family Dwelling
Code for the city, save and except such portions as are hereinafter
deleted, modified or amended by this chapter, One copy of such
Code has been and is now filed in the office of the Clerk of
Council. Such Code is hereby adopted and incorporated as if fully
set out at length herein, and from the date on which this chapter
shall take effect, the provisions thereof shall be controlling within
the limits of the city.
Section 3. That ~ 150,OO2(A) of the Dublin Codified Ordinances be replaced with:

(A) The CABO One and Two-Family Dwelling Code, 1995 Edition,
Chapter 1, Section 101,1 shall be amended as follows:

replace reference to Paragraph 205 with reference to Paragraph 305.1 Ceiling

replace reference to Paragraph 209,2 with reference to Paragraph 309,2 Separation
Required,

modify the CABO One, Two and Three Family Dwelling Code to include
M paragraph 112.1.1.
112.1.1 Expiration of plan review. Plans reviewed by the City
shall expire 90 days after the approval of plans.
Section 8. That U50,OO2(F) be added to read as follows: "The CABO One, Two
and Three Family Dwelling Code", Chapters 29, 30, 31, 32, 33, 34, 35, 36, 37
and 38 be deleted in their entirety and replaced with the Ohio Plumbing Code as
referenced in the Ohio Administrative Code Chapters 4101:2-56 to 4101:2-69,
That Chapter 39 be deleted in its entirety and be replaced with Dublin Ordinance
13-96 (The National Electric Code),
Section 9. That U50.002(G) of the Dublin Codified Ordinances be added to
modify the CABO One, Two and Three Family Dwelling Code to include
Paragraph 302.3,
.." 302.3 CertifICation. The elevation and location of all new buildings
shall be certified by a registered land surveyor or a person under

Section 10. That ~150,OO2 (H) of the Dublin Codified Ordinance be added to

CARBON MONOXIDE DETECTION
325.1 Requirement. Carbon Monoxide detectors shall be installed
in all new one, two and three family dwellings that are heated by
one or more central fossil fuel powered heating units as hereinafter
provided, Said carbon monoxide detectors shall be capable of
detecting the presence of 100 PPM of carbon monoxide in ambient
air and providing a suitable audible alarm; further they shall be
installed in the manner provided in the manufacturers specifications
and shall comply with applicable federal and state regulations, and
shall bear the label of a nationally recognized standard testing
laboratory, and shall meet the standard of UL 2034.
325.2 Installation. The carbon monoxide detectors shall be

the location outside each separate sleeping area in the immediate

325.3 Power Source. Carbon monoxide detectors or alternative
systems directly connected (permanently wired) shall be permanent

operated when installed in existing structures,

Subject: Ordinance 22-96
Date: February 29, 1996
Over the next few months, Council will be receiving several pieces of proposed legislation
concerning the enforcement of building standards in the City of Dublin. There are two reasons for
this; first, the normal three-year cycle for the approval of new Ordinances and second, because the
insurance industry, over the last few years has suffered major losses due to windstorms and fire,
investigation by their controlling group indicates that enforcement and adoption of building codes
had a direct relationship to the losses suffered by their carriers.
Starting with the year 1995, a series of pilot programs were started in various states, This
program will become nationalized and Ohio will be the recipient of their actions in 1998. The
Insurance Standards Organization (ISO), will be adopting a "scorecard" or "gradecard" for
building departments. On the basis of this "gradecard", insurance rates for homeowners and
businesses will be adjusted, either upward or downward. In other words, a good rating schedule
will reduce the cost of hazard insurance for homeowners and businesses, The 1995 CABO, which
..,- you will be debating in public hearings on Monday, March 4, is the first of these pieces of
legislation.

It is our goal to adopt these standards with a minimum number of local modifications. There are
currently a series of meetings being held by OBOA (Ohio Building Officials Association), and
after another series of public hearings that will be held statewide, OBOA will recommend to all
jurisdictions adoption of OBOA sponsored amendments, in order to promote, as much as
possible, statewide uniformity in the One, Two and Three Family building codes. OBOA is a
recommending agency and without statutory force.
The ordinance before you this evening has been modified in conjunction with meetings held with
the BIA (Building Industry Association) and have been discussed on Wednesday morning,
February 28, at the Building Division Annual Residential Contractor's Breakfast. The amended
ordinance, which has been presented to you today, includes the input of these meetings,
There are a couple of "hot-button" issues that you should be aware of The "rise and run" of
residential stairs has been hotly debated in the builder community. The City of Dublin, in the
crafting of it's ordinance has modified the 1995 CABO to the extent that the "rise and run"

requirements for stairs is tied to the commercial building code (the OBBC), residential R2 and R3
Construction types. These are multiple, single-family (townhouses) or apartment type units,
which clearly have similar characteristics to the One, Two and Three Family Dwelling Code, The
- purpose of this tie-in, is that, as the 1995 BOCA is debated for adoption in the state of Ohio,
probably as the 1997 OBBC, the issue of stair tread rise and run will again come to the forefront
- and, if adopted, under BOCA language, the OBBC and the CABO codes will be consistent with
the lowered rise and widened tread.
Another subject that will be presented to the building community, through this ordinance, is the
requirement for passive radon mitigation systems. We have had meetings through OCCINIBS
(the Ohio Consultative CouncillNational Institute of Building Sciences) in the City of Dublin,
concerning the real hazards and requirements of radon mitigation in our community. We are
considered a Class 1 category area, which has a high likelihood of radon incidence, and the cost of
passive mitigation will pre-empt the cost of a major mitigation system being required at the time
of single-family resale, These systems average between and $1500.00 and $2500.00 as part of the
selling negotiations in many houses today. The system, when properly installed, provides the
underground piping so that if elevated readings of radon are discovered in the testing of a house, a
simple mitigating fan addition can bring the radon level to an acceptable standard as defined by
EP A. You will find a book in your packet on radon mitigation that was issued by Underwriters
Laboratories.
The third major area of change in the 1995 CABO is the adoption of a requirement for Carbon
Monoxide detection, The City of Dublin, during the heating season, experiences a number of calIs
each month from voluntary Carbon Monoxide detectors, Carbon Monoxide is a silent killer, with
- it's symptoms often misdiagnosed, until serious injury or death results.
...... You will also note a number of locally adopted ordinances that have been in our codes are no
longer necessary. Many of the issues in this category have been adopted as part of the 1995
CABO standard. This includes such items as foundation waterproofing and bathroom safety
glazing.
As a part of the rating system for ISO, the insurance industry will be reviewing our adopted
codes. Upon the passage of the CABO code, Building Standards will be submitting a Property
Maintenance Code to Council for debated action, this should be following in about 30 days,
