AN ORDINANCE AMENDING SECI'ION 51.61 AND 51.62 OF TIlE CODIFIED
ORDINANCES ESTABLISmNG USER FEES AND CAPACITY CHARGES FOR
TIlE AREA OF THE CITY SERVICED BY DELAWARE COUNTY AND

...... WHEREAS, the City of Dublin (the City) and Delaware Country (the County) entered into an
Agreement For SanitaIy Sewer Service (the Agreement) on August 22, 1994, and
WHEREAS, the Agreement provides that the sewage and wastewater treatment for an area of
approximately two hundred ten (210) acres of residential use in the City (see attached Exhibit
A) will be provided by the County instead of the City of Columbus, and
WHEREAS, the Agreement provides that capacity charges for service connections to the
sanitaIy sewer system in this area shall be paid directly to the County at the County's current
capacity charge rate, and
WHEREAS, the Agreement provides that the City shall pay to the County usage fees based
upon actual usage in the service area as recorded by a master meter at the County's current
residential rate plus a fifty percent (50%) County surcharge, and
WHEREAS, the Agreement provides that the County will bill the actual users for usage fees
on behalf of the City based upon actual usage in the service area as recorded by a master meter
at the County's current residential rate plus a fifty percent (50%) County surcharge, plus any
additional user surcharges established by the City, and remit the fees collected to the City, and
WHEREAS, the City of Dublin is responsible for the cost of operation and maintenance of the
lflii"'- system as well as related capital improvements, and
""',"~ WHEREAS, an analysis of projected revenue and expenses, including capital improvements,
has been completed by the CPA :firm of Coopers & Lybrand, and
WHEREAS, it is necessmy to amend the user fees and capacity charges to include the area that
will be serviced by the County.
NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio,
7 of the elected members concurring:
Section 1, That Section 51,61 of the Codified Ordinances be amended to read as follows:
(A) The following rates are charges for sewer service and use for the area of the City
serviced by the City of Columbus and are based on metered consumption of water for
sewer usage:

...... (B) These rates are in addition to the sewer rates charged by the City of Columbus.
(C) The following rate is the charge for sewer service and use for the area of the City
serviced by Delaware County:
(1) Delaware County's current residential rate, which at January 1, 1996 is a flat
fee of $25.00 per month, plus a fifty percent (50%) Delaware County
surcharge.
(2) A flat fee of $9.00 per month as a City of Dublin surcharge
(D) Moneys received ftom the use of the sewer system shall be deposited in a separate fund
(Sewer:fimd) and used for the payment of the costs to operate and maintain the system
and to make capital improvements to the system.

Section 2. That Section 51.62 of the Codified Ordinances be amended to read as follows:
(A) No person shall make a service connection to the City's sanitary sewer system or any
part thereof, unless he has been issued a permit to do so by the City for the area
- serviced by the City of Columbus or issued a permit to do so by Delaware County for
the area serviced by Delaware Country.
....... (B) The fees to be charged for permits to connect to the sanitary sewer system serviced by
the City of Columbus shall be based upon the domestic supply water tap size as
follows:

*These rates are effective after May 1, 1995
(C) In the event a tap is subsequently enlarged, the difference between the charges for the
two tap sizes shall be paid,
(D) These fees are in addition to any charges made by any other governmental agency, The
City of Columbus charges a capacity fee which is collected by the City of Dublin.
Two-thirds of that fee is retained by the City of Dublin under the terms of the sewer
agreement. At January 1, 1992, the Dublin share of the Columbus charge is $500.
(E) Moneys received from the capacity charge fees collected by the City shall be deposited
in a separate fund (Sewer Fund) and used for the payment of the costs to operate and
maintain the system and to make capital improvements to the system,
(F) The fees to be charged for permits to connect to the sanitary sewer system serviced by

G) The capacity charge fees collected by Delaware County will be retained by Delaware
County,
...... Section 3, That this Ordinance is hereby declared to be an emergency measure necessary for the
immediate preservation of the public peace, health, safety and welfare of this City and for the
... further reason that it is immediately necessary to establish the sanitary sewer user fees and
capacity charges for the area as the final plats for both Wedgewood Hills and Campden Lakes
have been approved, therefore, this Ordinance shall be in full force and effect immediately after
its passage,
