AN ORDINANCE AUTHORIZING THE PURCHASE
OF ROAD SALT WITHOUT FORMAL ADVERTISING
AND COMPETIVE BIDDING AND DECLARING AN

......"', WHEREAS, a critical need exists to purchase road salt to control the condition of Dublin's
roadways during and after winter storms;
WHEREAS, the cost of this salt will exceed $10,000 (but in no case exceed $50,000), which
would require the City to comply with formal adveritisng and competitive bidding procedures;
and,
WHEREAS, in the interest of preserving the public health, safety, and welfare, Council
desires that this salt be purchased in an expeditious manner; and,
WHEREAS, Section 8.02 (B) of the Dublin Charter enables Council, by ordinance or
resolution adopted by a vote of at least two-thirds of its members, to authorize, without
advertising and competitive bidding, contracts or expenditures for any purpose where the
statutory or common law of Ohio does not require compeitive bidding; and,
WHEREAS, Section 735.051 of the Ohio Revised Code enables the legislative authority of
a City to authorize, by a two-thirds vote of its members elected thereto, the City Manager,
or other duly authorized contracting authority, to enter into a purchasing contract without
/,. formal bidding and advertsing, when a real and present emergency arises in connection with
the operation of any department, division, commission, bureau, or board of the municipality;

NOW, THEREFORE, BE IT ORDAINEDby the Council of the City of Dublin, State of
Ohio ..... ~ of the elected members concurring;
Section 1. That, pursuant to Section 8.02 of the Dublin Charter and Section 735.051 of the
Ohio Revised Code, the purchase of road salt in an amount not to exceed $50,000 is hereby
authorized without formal advertising and competitive bidding.
Section 2. That this Ordinance be, and hereby is, declared to be an emergency measure
necessary for the preservation of the public health, safety, and welfare in that snow and ice
covered roadways represent a serious safety threat. Therefore, this Ordinance shall take
effect and be in force immediately upon passage.

Subject: Emergency Purchase of Road Salt
Date: January 11, 1996
The recent, uncharacteristic snow falls over the mid and eastern U.S. has caused a much higher than
normal demand for road salt. This has resulted in the inability of the City's vendor (Morton
International) to supply us with sufficient quantities of salt. The City's supply is nearly depleted and
should there be additional accumulations in the Central Ohio area tonight through early next week,
additional quantities will urgently be needed.
Staff has identified another vendor (AKZO - Nobel) who can supply us with salt at a price of
$48.91/ton. (Morton International's price under our existing contract is 37.38/ton.) The Service
Department has an estimated need for 1,000 tons, which translates into a $48,910 expenditure. Such
an expenditure is well above the amount requiring formal competitive bidding and advertising.
Therefore, I will be bringing Council emergency legislation at tonight's special meeting of Council
waiving fonnal bidding and advertising requirements and authorizing the purchase of the additional
