NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, !:l- of the elected members concurring:
Section 1. That the following described real estate (see attached map marked Exhibit IIAII)
situated in the City of Dublin, State of Ohio, is hereby rezoned to PUD, Planned Unit
Development District and shall be subject to regulations and procedures contained in
Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning
Code and amendments thereto.
Section 2. That application, Exhibit IIBII, including the list of contiguous and affected
property owners, and the recommendations of the Planning and Zoning Commission,
Exhibit II C II, are all incorporated into and made an official part of this Ordinance and made
an official part of this Ordinance and said real estate shall be developed and used in
accordance therewith.

Premises: Approximately 3.279 unimproved acres located
northerly of and contiguous to Metro Place North,
City of Dublin, Franklin County, Ohio, being the
"property" defined in the Contract which is more
particularly described in EXHIBIT "A" attached

Contract)

Certain terms used in this Authorization Letter are defined in the
reference portion set forth above.
Cooker has entered into the Contract to sell the Premises to ESA
conditioned upon Buyer's ability to obtain the appropriate zoning,
rezoning and/or variances to permit Buyer's intended use of the Premises
as a motel or hotel.
This Authorization Letter signifies Cooker's consent and
authorization, as owner of the Premises, for ESA, its officers,
employees, agent and/or attorneys to apply for, process and obtain the
required zoning, rezoning and/or variances to permit ESA's development
of the Premises for construction and operation of ESA's intended use of
the Premises set forth in the Contract.

Nothing contained in this authorization to act on behalf of Cooker
as owner of the Premises shall be deemed to construed to authorize ESA
to make commitments on behalf of or to obligate Cooker in any manner
concerning the grant or installation of an ingress or egress easement
(or roadway thereon) westerly of and contiguous to the Premises designed
.1'1' to provide access to and from Metro Place North to land between the
Premises and State Route 161 (U.S. Highway No. 33) . Negotiations
regarding said access shall be directly between the City of Dublin and

The Planning and Zoning Commission took the following action at this meeting:
4. Rezoning Application Z96-OO8 - Metro Center - RevRd Preliminary Development Plan
- Extended Stay America - 450 Metro Place North
Location: 3.279 acres located on the north side ofMetto Place North, approximately 800 feet
west of Frantz Road.
Existing Zoning: PUD, PIamied Unit Development District (Metro Place).
Request: Revision of the approved preliminary development plan (Metro Center PUD) to
establish a third hotel site.
Proposed Use: A 53,600 square foot, three-story hotel with 120 rooms.
AppRcant: ESA Development, clo William T. Henry, 1550 Northwest IDghway, Suite
401, Park Ridge, lllinois 60068-1463.
MOTION: To approve this rezoning because it provides for the long-planned access to the
McKitrick property to the north, is consistent with the recommendations of the Mt. Auburn study
....... and the Dublin Business Retention and Expansion report, and complements the Metro Center
office park with five conditions:

1) 'Iba.t the 6O-foot-wide right~f-way for the access road from Metro Place North to the
McKitrick property and parallel utility easements (20 feet wide) be deeded to the City
before approval of building permits;
2) That the owner agree to cooperate in a plan for a coordinated bike/pedestrian path
along Metro Place North;
3) That a future second access drive be provided to the new north-south access road;
4) That the existing fence row along the north property line be preserved, and that all
landscape and parking requirements be incorporated at final development plan review
acceptable to staff; and
