BY THE CITY OF DUBLIN, omo TO THE BOARD OF TRUSTEES
OF THE COLUMBUS METROPOLITAN LmRARY; AUTHORIZING THE
...... EXECUTION AND DELIVERY OF A DEED; AND RESERVATION OF AN
ACCESS EASEMENT

WHEREAS, the City of Dublin, Ohio (the "City") and the Board of Trustees of the
Public Library of Columbus and Franklin County, now the Board of Trustees of the
Columbus Metropolitan Library (the "Library"), have heretofore entered into a lease,
dated as of January 1, 1980, pursuant to which the Library leased and contracted to
purchase a branch library facility from the City consisting of 1.244 acres improved with
a structure; and
WHEREAS, the Library later negotiated an agreement with the Dublin Local School
District pursuant to which 2.2111 acres adjacent to the west side of the existing Library
was made available to the Library so the Library could expand its building; and
WHEREAS, the additional 2.2111 acres were acquired by the City and added to the
lease, as authorized on Ordinance No. 106-87, passed on September 8, 1987, the 1.244
acres and the 2.2111 acres sometimes hereinafter called the "Premises"; and
WHEREAS, the final payment of the Five Hundred Thousand Dollars ($500,000.00)
Village of Dublin, Ohio Seven and One-Half Percent (71J, %) Library Building Mortgage
Revenue Bonds dated January 1, 1980, and due January 1, 1995, have been paid in full,
as certified by the Trustee, National City Bank, Columbus Trust Group, in writing to the
..... Director of Finance, Columbus Metropolitan Library, as shown to the City and its Law
Director; and
......
WHEREAS, Sections 10.3 and 10.5 of the January 1, 1980 Lease call for the transfer
of the Premises by the City to the Library upon payment in full of the bonds.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, '7 elected members concurring:
Section 1. The City shall convey the Premises upon which the branch library and the
parking lot sit, containing 1.244 acres and 2.2111 acres, at 75 North High Street, Dublin,
Ohio, more particularly described in the attached Exhibits "A-1" and "A-2" to the Board
of Trustees of the Columbus Metropolitan Library, by Deed which Deed is attached as
"Exhibit B", and as required by Sections 10.3 and 10.5 of the Lease.
Section 2. The Deed shall reserve, as shown, an easement to the City as follows:
"Reserving, however, to the Grantor an easement over the southern, paved portion of the
premises to the west line of the Premises, for the purpose of ingress and egress for
maintenance vehicles in order to maintain the cemetery to the north of the Premises, only
when such maintenance is being performed. The rights of ingress and egress shall also
include the right to park maintenance vehicles at the western line of the premises and for
- access to the paved path north to the cemetery. Grantor will park its maintenance
vehicles on the path and on the cemetery grounds, and will only park its maintenance
vehicles on Grantee's parking lot for extraordinary reasons. This agreement shall be

Section 3. The City Manager is hereby authorized and directed to execute and deliver
the Deed to the Library.

Section 4. It is found and determined that all formal actions of the City concerning and
relating to the adoption of this Ordinance were adopted in an open meeting of this
Council, and that all deliberations of this Council and any of its committees that resulted
......' in such formal action were in meetings open to the public, in compliance with all legal
requirements, including Section 121.22 of the Ohio Revised Code.

with limited warranty covenants, to the BOARD OF TRUSTEES OF THE
COLUMBUS METROPOLITAN LIBRARY, Grantee, whose tax-mailing address
