AN ORDINANCE TO ACCEPT AN ANNEXATION OF
21+/- ACRES IN JEROME TOWNSHIP,

____"'"..oil WHEREAS, said annexation has been approved by the Union County
Commissioners, and Council is of the opinion that said
territory should be annexed.
NOW, THEREFORE BE IT O']AINED by the Council of the City of
DUblin, state of Ohio, of the elected members concurring:
section 1. That the petition for the annexation of 21+/-
acres (see attached legal description) to the City of Dublin,
Ohio is hereby accepted.
section 2. That this Ordinance shall take effect and be in
force from and after the earliest period allowed by law.

Situate in the State of Ohio, County of Union, Jerome Township and being in
Virginia Military Survey Numbers 3009 and 5162 being the 20,526 acres owned by
Walter L. Starkey and the 0.224 acres owned by James P. and Lillian S. Edwards
....... and being more particularly described as follows:
Beginning at the point of intersection of the common line to Union and
- Fr anklin Counties (also the existing City of Dublin Corporation line, as
established by Ordinance Number 13-73, of record in M.R, 159, Page 38) with the
common line of the Columbus Builders Supply, Inc. 70.522 acre tract (7.00 acres
in Union Co.) and the Walter L. Starkey 145.25 acre tract (20.526 acres in Union

Thence NORTHWESTERLY, a distance of 940 feet, more or less, along the common
line to said 70.522 and 145.25 acre tracts and the common line to V.M.S. 5162 and
V.M.S. 3009 to a point at the northeasterly corner of the said 70.522 acre tract;

SUBJECT: Annexation Request: Resolution #08-95 (21 acre Starkey tract - Union County)

INITIATED BY: Terry D, Foegler, Asst. City Mgr.lDir, of Dev.
Council is being requested to approve its standard statement of services for the proposed
annexation of this 21 acre tract, located in Union County, currently owned by W, L.
Starkey. The public hearing for this petition will be held by the Union County
Commissioners on Monday, May 8, 1995 at 10:30 a,m. If approved by the Union County
Commissioners, the annexation request will be back before City Council, who may either
approve or disapprove the petition at that time,
The site in question encompasses approximately 21 acres and is located immediately west of
the City of Dublin/Franklin County Line, and is bounded by Brand Road (Mitchell & DeWitt
Road) on the north, The tract is under common ownership with a much larger 145 acre
parcel located within the City of Dublin, immediately east of the subject site, also owned by
Walter Starkey. In the process of reviewing the initial submission of this petition, staff
discovered an error which required that the process be re-initiated. Specifically, the petition
indicated Mr. Starkey as the owner of the entire tract being annexed, while a ,87 acre piece
of the annexation area is owned by James p, and Lillian S. Edwards, The revised petition
...... now includes the signatures of Mr, and Mrs. Edwards.
...... The proposed petition is consistent with the City's recently adopted Interim Annexation
Policy which provides for allowing such annexations when property under common
ownership is split by a county boundary. The policy does, however, note that each case
must be looked at individually in order to fully determine our ability to provide sewer and
water to the property, Please note the attached memorandum to Balbir Kindra from Chuck
Petty indicating that the subject property is fully serviceable with City sewer and water
facilities. Also, as can. be seen on the attached map, the western boundary of the subject
parcels does align with two other recent annexations accepted by the City. Obviously, the
issues of "jurisdictional fragmentation" among the various private utilities, as outlined in the
Interim Annexation Policy, confront this parcel as well.

Subject: Annexation Request - 21 acre tract - Walter Starkey
The subject tract is in Union County and abuts other l~ds owned by Mr.
Starkey that are within the City of Dublin. These properties are within the
tributary boundaries defined by Muirfield Drive and A very Road Sanitary
Sewer Study prepared by Bd&M recently. Sanitary sewer service will be
available to these properties once the proposed Shannon Glen sewers and the
sewers across the Erwin tract are constructed. These sewers are tributary to
the North Fork of Indian Run Trunk Sewer which has been identified as
having future capacity problems. These problems will not manifest themselves
until the majority of the tributary area is developed. Since development is
currently light in this tributary area, capacity problems can be dealt with in the
future by adjusting the tributary boundaries.
Water service will be extended west along the North side of Brand Road as
.",.."4 part of the Shannon Glen subdivision. This will be the point at which water
service to the subject tract of land can be accessed.
.....~ In general, the annexation of this parcel, for residential uses consistant with the
surrounding tracts, will not create any demands on the water and sewer utilities that
cannot be accommodated.

TO THE BOARD OF COUNTY COMMISSIONERS OF UNION COUNTY, OHIO:
,.,. The undersigned, petitioners in the premises, and being
a MAJORITY OF OWNERS OF REAL ESTATE in the territory

in the Township of Jerome which area is continuous and
adjacent to the City of Dublin, do hereby pray that said
territory be annexed to the City of Dublin, according to the
statutes of the State of Ohio.
A full and accurate description and a plat of said
territory so prayed to be annexed are attached hereto and
made part hereof.
In support of said Petition, your petitioners state that
there is within the territory so prayed to be annexed three
(3) OWNERS OF REAL ESTATE.
David E. Haid is hereby appointed Agent for the
undersigned Petitioners, as required by Section 709.02 of the
Revised code of Ohio. Said agent is hereby authorized to
make any amendment and/or deletion which in his absolute and

A motion was made by Glenn W, Irwin and seconded by Gene Cameron to adopt the
following:
WHEREAS, a petition for annexation was filed On March 3, 1995, praying for
annexation to the City of Dublin, Jerome Township; and
WHEREAS, said petition represents real estate situated in Jerome Tov.rnship, Union
County, Ohio being a total of21 acres, more or less, and being continuous and adjacent to the
City of Dublin. There are three (3) owners of real estate in the territory sought to be annexed to
the City of Dublin, Ohio,
THEREFORE, BE IT RESOLVED, that said petition for annexation be and is hereby
received pursuant to Section 709.02 of the Ohio Revised Code, shall be advertised by publication
as required by law and that public hearing on said petition shall be held in the office of the Board

:1 WHEREAS, a petition for the annexation of 21+/- acres from
:: Jerome Township was duly filed by David E. Haid on March 3,
!11995 on behalf of Walter L. Starkey, 6503 Cook Road, Powell,
I Ohio and James P. and Lillian S. Edwards, 7041 Mitchell Dewitt
:i Road, Plain city, Ohio; and
,
I
i WHEREAS, a public hearing has been sched~led before the Union
: County commissioners on Monday, May 8, 1995 at 10:30 a.m.; and
I
i
II WHEREAS, Section 709.031 of the Ohio Revised Code requires
I that, prior to said hearing, the Municipal Authority shall
il adopt a statement indicating what services, if any, the
I, Municipal Corporation will provide to the territory proposed
il for annexation; and
I
I WHEREAS, Dublin City Council adopted an interim annexation
~ I policy on June 20, 1994 to provide policy directive regarding
proposed annexations to the City of Dublin.
NOW, THEREFORE, BE IT RESOL'LED by Council of the City of
- DUblin, State of Ohio, JJ of the elected members
concurring:
Section 1. The city of Dublin will provide the following
municipal services for the 21+/-acres in Jerome Township,
Union County upon the annexation of said area to the City of
Dublin, Ohio:
Police. The City provides Police and Communications
service on a full twenty-four hour basis and also has
mutual aid agreements with other municipalities. The
annexation area lies approximately two miles northwest of
Dublin's Police Division Headquarters. Dublin operates
wi th a minimum of four cruisers on duty. A response time
of approximately five minutes for an emergency situation
should be expected for this area.
Fire. Fire and emergency medical services protection is
currently provided by well-staffed departments in Jerome,
Washington and Perry Townships. They, too, have mutual
aid agreements with other municipalities. This
- annexation would not change f ire department
jurisdictional boundaries, and therefore response times
for fire and emergency medical services will not be
-- affected. The Jerome Township Fire station is
approximately six miles from the annexation area and
normal response times should be approximately eight
minutes. However, due to an existing automatic response
agreement, the area is also served by the Washington
Township Fire station 93 which is located approximately
1.0 mile away, and normal response time would be
approximately three minutes.
Sanitation. Residential refuse collection services are
contracted by the City and are currently provided at no
additional charge.

Department which provides excellent service in the area
of street and road maintenance. This department also
provides curbside leaf pick-up at no additional charge.
section 2. The City has SEWER and WATER service area
contracts with the city of Columbus, and the subject property
is within said service areas, and conditioned on the ability
of the city of Columbus to provide WATER, and to provide
I sufficient SEWERAGE disposal capacity, the city will have the
ability to service the area.
section 3. This Resolution is declared to be an emergency
necessary to preserve the public health, safety and welfare
and for the further reason that action must be taken prior to
the public hearing scheduled by the Union County commissioners
on May 8, 1995, and therefore this resolution shall be
effective upon passage.

... RESOLUTION NO. 251-95 RE: PETITION FOR ANNEXATION OF 21 ACRES TO THE CITY
OF DUBLIN, JEROME TOWNSHIP, UNION COUNTY, OHIO
Mr. Irwin offered the following resolution:
WHEREAS, a petition for annexation was filed on March 3, 1995, naming David Raid, Agent
for the Petitioners, and praying for annexation to the City of Dublin, Union County, Ohio;
AND WHEREAS, said petition represents real estate situated in Jerome Township, Union
County, Ohio being a total of 21 acres, more or less, and being continuous and adjacent to the City of
Dublin. There are three (3) owners of real estate in the territory sought to be annexed to the City of
Dublin, Ohio.
AND WHEREAS, said petition for annexation contains all matter required by law to wit:
1. (a) a full description and accurate map
(b) a statement of total number of owners sought to be annexed
(c) the name of the person to act as agent for the petitioners
2. The matters alleged in the petition are true and notice has been published as required by law.

3, Persons whose names are subscribed to the petition are owners of real estate in the territory
described in the petition and the number of valid signatures on the petition constituted a majority of the
- owners.
4, The territory included in the annexation petition is not unreasonably large and is adjacent to
the City of Dublin,
5. The general good of the territory sought to be annexed will be served if the annexation
petition is granted and the annexation is allowed.
IT IS THEREFORE, ordered that the prayer of the petition be and is hereby granted and that the
final transcripts be delivered to the Clerk of the City of Dublin,

PUBLIC HEARING RE: ANNEXATION PETITION TO THE CITY OF DUBLIN, JEROME
TOWNSHIP - DAVID E. HAID, AGENT FOR THE PETITIONERS
A public hearing was held at 10:30 a.m. in the office of the Union County Commissioners for the
purpose of considering a Petition for Annexation of 21 acres in Jerome Township, Union County, Ohio
to the City of Dublin, filed by David Raid, Agent for the Petitioners, Walter L. Starkey and James and
Lillian Edwards on March 3, 1995,
In attendance at the hearing presided over by Gene Cameron, President of the Board of the Union
County Commissioners were:
David Raid, Agent for the Petitioners; Eric Priday, Jerome Township Trustee; Steve Stolte,
Union County Engineer; Commissioners Cameron, Irwin and Fraser; and Commissioners' Clerk,
Rebecca Roush.
The Petition, Proof of Publication, Resolution stating services provided by the City of Dublin,
Description of the proposed tracts to be annexed, and the Notice of the Filing of Annexation Petition to
the Clerk of Jerome Township are in order and filed with the Union County Commissioners.

The Board of Trustees of Jerome Township, represented by Eric Priday, wanted noted in the
minutes that the annexation system is inequitable and they (trustees) are opposed to annexations without
..... representation.
There being no further comments or objections, the hearing was adjourned at 10:45 a.m.
