AN ORDINANCE AMENDING CERTAIN SECTIONS OF
ORDINANCE NO. 9&96 ("COMPENSATION PLAN") AND
AUTHORIZING CERTAIN WAGE ADJUSTMENTS FOR CERTAIN

JOB CLASSIFICATIONS RETROACTIVELY.
WHEREAS, the Maintenance Crew Leader and Automotive Mechanic II job classifications
have now been declazed as exempt from the proposed bazgaining unit seeking representation
by the United Steel Workers Union; and,
WHEREAS, Council has therefore determined, upon the recommendation of the City
Manager, that Section 2 ("WAGE & SALARY STRUCTURE/ADMIlVISTRATION"),
Subsection 2.A of Ordinance No. 98-96 should be amended to include the pay grades for the
Maintenance Crew Leader and Automotive Mechanic II job classification, as identified within
the Classification & Compensation Study completed by Public Administration Service in
September 1996; and,
WHEREAS, Council has determined that the pay grades for the Maintenance Crew Leader
and Automotive Mechanic II classifications, as identified within the Classification &
Compensation Study, should be adopted retroactive to December 8, 1996; and,
WHEREAS, Council has determined that the 5% "technical adjustment" authorized for all job
classifications contained within Ordinance No. 98-96 (as a result of the Classification &
Compensation Study) effective December 8, 1996, should now also be authorized for the
Maintenance Crew Leader and Automotive Mechanic II classifications retroactive to December
8, 1996; and,
WHEREAS, Council has determined, that increases in certain benefits authorized within
Ordinance 98-96 (i.e. Vacation Accrual, Longevity Pay, Life Insurance, Tuition
Reimbursement) for all job classifications contained within Ordinance 98-96 should ~ be
effective retroactively for the Maintenance Crew Leader and Automotive Mechanic II job
classifications, but only upon the date this legislation legally takes effect; and,
WHEREAS, Council has determined that these amendments and retroactive wage adjustments
aze in the best interest of the City of Dublin from aLabor/Employee Relations standpoint; and,
WHEREAS, Council has determined that one "housekeeping" amendment should be made
within Section 2 ("WAGE & SALARY STRUCTURE/ADMINISTRATION"), Subsection
2.A of Ordinance No. 98-96, which involves the deletion of the existing "Facility Supervisor"
job classification title and pay grade under the "Service, Maintenance, Streets, Utilities,
Grounds & Facilities categorical heading;
NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, ~ of the elected members concurring:
Section 1• That effective retroactive to December 8, 1996, Section 2 ("WAGE & SALARY
STRUCTURE/ADMINISTRATION"), Subsection 2.A. is hereby amended to include the
following job classification titles and corresponding pay grades under the following categorical
headings contained therein:
Service, Maintenance, Streets, Utilities, Grounds & Facilities

Section 2. That effective retroactive to December 8, 1996, employees within the
Maintenance Crew Leader and Automotive Mechanic II job classifications, whose base
rates of pay fall below the minimum of the pay ranges for their respective job classifications,
shall have their base rates of pay adjusted to the minimum of their respective pay ranges
plus receive a 5% "technical adjustment". Furthermore, effective retroactive to December
8, 1996, employees within the Maintenance Crew Leader and Automotive Mechanic II job
classifications, whose base rates of pay fall within the minimum to maximum parameters of
their respective pay ranges, shall receive a 5% "technical adjustment" in their base rates of
pay.
Section 3• That effective upon the date this legislation legally takes effect, employees
within the Maintenance Crew Leader and Automotive Mechanic II classifications shall be
eligible to begin receiving the increased benefits authorized within Ordinance No. 98-96 (i.e.
Vacation Accrual, Longevity Pay, Life Insurance, Tuition Reimbursement).
Section 4. That Section 2 ("WAGE & SALARY STRUCTiJRE/ADMIlVISTRATION"),
Subsection 2.A. is hereby amended by deleting the "Facility Supervisor" classification title
and corresponding pay grade under the "Service, Maintenance, Streets, Utilities, Grounds &
Facilities categorical heading contained therein.
Section 5. That this Ordinance shall take effect and be in force on the earliest date
permitted by law.

Attached for your consideration is Ordinance No. 43-97 amending certain sections of Ordinance No.
98-96 ("Compensation Plan") and authorizing certain wage adjustments for certain job classifications.
Council will recall that prior to the completion of the Classification & Compensation Study and the
subsequent adoption of Ordinance No. 98-96 ("Compensation Plan") in the Fall of 1996, the United
Steel Workers Union (USW) filed a "Request for Recognition" with the State Employment Relations
Boazd (SERB) seeking representation of employees within the Service Department. The composition
of the proposed bargaining unit was not cleazly defined by the USW but appeazed to include
employees within the Maintenance Worker, Maintenance Crew Leader, Sign Worker, Automotive
Mechanic, and Auto Service Worker job classifications. Given the fact that the recognition request
had been filed with SERB prior to the completion of the Study and adoption of the new
Compensation Plan, the City's labor counsel (Mr. Weisman) advised the City not to implement any
changes to the compensation structure for job classifications which appeazed to be part of the
proposed bazgaining unit, as such could be interpreted by SERB as an unfair labor practice. Thus,
those job classifications were specifically excluded from Ordinance No. 98-96, pending a final ruling
regarding composition of the proposed unit.
The City filed objections to the composition of the proposed bargaining unit with SERB and a hearing
was eventually scheduled for March 5, 1997 to address the issue of unit composition. Mr. Weisman
and Mr. Harding attended this hearing together with representatives from the USW, and as a result
of this hearing, the Maintenance Crew Leader and Automotive Mechanic II classifications have been
declared exempt from the proposed bargaining unit.
As a result, Stafi'is therefore recommending that certain amendments be made to certain Sections of
Ordinance No. 98-96 and that certain actions be taken regarding the adjustments of wage rates for
employees within the Maintenance Crew Leader and Automotive Mechanic II classifications. These
recommendations include the following:
- To amend, retroactive to December 8, 1996, Section 2 ("WAGE & SALARY
STRUCTUREJADMINISTRATION"), Subsection 2.A. by adopting new pay grades for

the Maintenance Crew Leader and Automotive Mechanic II classifications, as identified
within the Classification & Compensation Study completed by Public Administration
Service in September 1996. (The Study had recommended that these two job
classifications be assigned to pay grade 5, which has a pay range of $26,465 - $39,698.)
- To authorize, retroactive to December 8, 1996, the same 5% "technical adjustment" for
employees within the Maintenance Crew Leader and Automotive Mechanic II
classifications as was received by other non union employees effective December 8, 1996.
""~" - To authorize, effective upon the date the attached legislation legally takes effect,
employees within the Maintenance Crew Leader and Automotive Mechanic II
classifications to begin receiving the benefit increases adopted by Ordinance No. 98-96.
These include increases in Vacation Accrual, Longevity Pay, Life Insurance, and Tuition
Reimbursement. (To authorize such benefits retroactive to December 8, 1996 would
either be impractical or impossible.)
It should be emphasized that Staff is recommending retroactivity in both the adoption of pay grades
and the "technical adjustment" for these classifications for the reason that Staff believes it
demonstrates good faith on the part of the City and is truly in the best interest of the City from a
Labor/Employee Relations standpoint. (Had the Union issue not intervened when it did, the City
would have implemented the ranges and the wage adjustment for these classifications December 8,
1996, as it did for other non-union personnel.)
The attached legislation contains one other proposed amendment, which is of a "housekeeping"
nature. Staff is proposing that the "Facility Supervisor" classification title and pay grade be deleted
from Section 2, subsection 2.A. of Ordinance 98-96. No personnel are presently assigned to this
classification and Staff does not believe there will be a need for this classification in the future. Staff
therefore recommends the deletion of this classification title and pay grade from Ordinance No. 98-
96.
