NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring: Section 1. That the following described real estate (see attached map marked Exhibit "A") situated in the City of Dublin, State of Ohio, is hereby rezoned to Planned Commerce District and shall be subject to regulations and procedures contained in Ordinance No. 21- 70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto. Section 2. That application, Exhibit "B", including the list of contiguous and affected property owners, and the recommendations of the Planning and Zoning Commission, Exhibit "C", are all incorporated into and made an official part of this Ordinance and made an official part of this Ordinance and said real estate shall be developed and used in accordance therewith. COMPOSITE PLAN DEVELOPMENT TEXT 29.355 ACRE TRACT ON THE SOUTH SIDE OF RINGS ROAD BETWEEN I-270 AND PAUL BLAZER PARKWAY A) SCHEMATIC PLAN, ETC. The site is an irregulaz rectangle totaling 29.355 acres. The I-270 frontage is about 600 feet; Paul Blazer Parkway frontage is about 700 feet and the depth along Rings Road is about 1500 feet. The site is essentially flat with a gentle slope to the east with an existing landscape business and single family house on the eastern portion of the site. The site is of a shape that will permit efficient development with an infinite number of variations. With the exception of the portion located within the elevated roadway for the Rings Road right-of--way there are no known physical factors that interfere with full use of the site. The primary attributes of the site are its I-270 freeway frontage and a location neaz to the Tuttle Crossing interchange. It can be anticipated that the ultimate user of this site will seek to exploit this exposure, probably with freeway-oriented office or corporate office uses such as aze located to the north, the south, and to the west, across I-270. These uses may include, but aze not limited to, general office uses, corporate headquarters office, hotels/motels and major institutional uses. The site also has significant frontage on Paul Blazer Pazkway which would permit non-freeway orientated buildings. B) PROVISION OF WATER AND SANITARY SEWER, ETC. 1. Water service will be accessed from the 20 inch water line that is located in the Rings Road right-of--way, on the south side of the street. ""~ 2. Sanitary sewer service will be accessed from the 21 inch trunk line located along the north side of Rings Road, to the north of the site. 3. Surface drainage is to be determined. The Cramer Ditch, a major drainage outlet, is located along the north side of Rings Road, to the north of the site. C) TRAFFIC CIRCULATION, ETC. The site has frontage on ,and access to, Rings Road and Paul Blazer Pazkway. Due to the elevation of the Rings Road bridge over I-270, cuts will be restricted on the western portion of the site. If more than one user is involved it is anticipated that a single phase for each user will occur. E) RELATIONSHIP TO EXISTING AND FUTURE DEVELOPMENT IN SURROUNDING AREA, ETC. To the greatest degree possible, this text seeks to make this site subject to the same goals, restrictions, and quality assurances as the Tuttle Crossing development to the south and across I- 270 to the west. The goal is to encourage development of this site as a visually integral part of the Tuttle Crossing development and be complimentary to the Ashland corporate park to the north. F) EVIDENCE OF CONTROL, ETC. All affected properties are now in the control of one developer. G) DEED RESTRICTIONS Deed restrictions, if any, will be filed at the time of conveyance of the property to end user(s). H) DEVELOPMENT STANDARDS TEXT If these standards conflict in any way with the City of Dublin Codified Ordinances then the Planned Commercial District shall prevail. Standards in the City of Dublin Zoning Code "°"` applicable to matters not covered in this document shall apply to each of the subazeas in the Planned Commercial District. The proposed development will compliment the adjacent uses within the Tuttle Crossing Development. The Subazea Development Standazds aze as follows: ubazeas The development plan for the subject property creates two subareas. Subazea A consists of 29.027 acres which contains the proposed 310,000 square foot office building along with ground for future development. Subazea B consists of .328 acres located on the southern portion of the site and will be used for landscaping and pazking for the Atrium building as part of the revision to the driveway layout between the Atrium and BMW buildings. e ral 2 1. It is the intent of the developer to create a unified, high quality office pazk development. 2. Mid-rise, signature type offices with parking structures will be promoted along freeway frontage. 3. Building elevations, plans and materials will be submitted for approval as part of the Development Plan in order to ensure that the quality standazds required by this text have been met. 4. The same palette of landscaping materials will be utilized in a similar design mazmer as in "' the Tuttle Crossing development to ensure a coordinated landscaping treatment. Proposed developments will be focused azound major water features. Wells will be used in some cases to control levels. 5. All site planning will be done in a manner consistent with prudent planning principles and practices. Permitted Uses The following uses are permitted in Subarea A: 1. Landscaping Permitted Density 3 The overall site will be developed with a maximum building area computed on the basis of acreage, exclusive ofright-of--way with a maximum overall density of 17,000 squaze feet per acre. Yard and Setback Requirements 1. Setback along I-270 shall be 50 feet for all pazking azeas and 75 feet for buildings. 2. Side yards shall be 25 feet from pavement and buildings except for the proposed north/south driveway which shall have a 15 foot setback for pavement and for the pazking azeas in Subazea B which shall have a 10 foot setback for pavement. 3. Rear yards shall be 25 feet for pavement and buildings except for the proposed north/south driveway which shall have a 15 foot setback for pavement and for the pazking areas in Subarea B which shall have a 10 foot setback for pavement. 4. All other publicly dedicated streets shall have a 25 foot pavement setback and a 50 foot building setback. 5. Setback along Paul Blazer Parkway shall be 25 feet for all pazking azeas and 50 feet for buildings. 6. Total ground covered by all buildings, excluding pazking gazages, shall not exceed 25 percent of the total azea. Maximum lot coverage shall not exceed 70 percent of the total lot area. 7. Setback from the proposed north/south driveway shall be 15 feet for all pazking azeas and 50 feet for buildings. Height Requirements The maximum height for structure shall be measured per the Dublin Zoning Code and have a maximum height limitation of 100 feet. The maximum height may be extended if the structure is set back from both I-270 and Rings Road rights-of--way and an additional two feet beyond the required setback for every one foot of height above the 100 foot maximum. A minimum height of two stories shall be required for all primary structures. Parking and Loading Sizes, ratio, and type of pazking and loading and other facilities shall be regulated by Dublin Code, Chapter 153. 2. Circulation All accesses shall be as approved by the City Engineer. At least one full service cut shall be permitted on both Paul Blazer Parkway and Rings Road, in an appropriate location. 2. Final location and design of all accesses to be subject to approval of the City Engineer. 3. A turn lane will be provided on Rings Road if it is needed, as determined by the City Engineer. Waste and Refuse All waste and refuse shall be containerized and fully screened from view by a solid wall or fence. Storage and Equipment 1. No materials, supplies, equipment, or products shall be stored or permitted to remain on any portion of the parcel outside of permitted structures. 2. Mechanical equipment or other utility hardware on roof, ground, or buildings shall be screened from public view with materials harmonious with the building. Landscaping All landscaping shall be according to Dublin Landscape Code. 2. A continuous landscape treatment shall be provided along the I-270 frontage containing a ~~ six foot earth mound or evergreen hedge/planting. Trees shall be placed in a manner that provides a 50 percent visual opacity throughout the year. This shall be achieved by providing a mixture of deciduous and evergreen trees. The deciduous trees shall be planted a minimum of 30 feet on center with a minimum installation size of 2.5 inches caliper measured at a height of 12 inches above ground level. Evergreen trees shall be installed a maximum of 15 feet on center with a minimum height of six to eight feet. Landscape material shall be located to provide maximum buffering to vehicular areas while allowing visual access to buildings facades. 3. As many existing trees as possible will be preserved. Existing trees to be preserved shall be protected during construction with snow fencing placed at the drip line and maintained during construction. 5 P 4. Within the 25 foot setback along Rings Road and Paul Blazer Pazkway a three foot average height continuous earth mound shall be installed and planted with one tree per 40 feet of frontage or fraction thereof. Provided however that this requirement will be abated due to the rise in Rings Road as it crosses I-270. The degree and point of abatement will be subject to resolution by the applicant and the Staff. 5. If a pazking lot abuts a dedicated road or the north /south driveway then the one tree per 40 feet of frontage shall meet both the vehiculaz use azea perimeter requirement as well as the street tree requirement. 6. Any portion of a lot upon which a building or pazking area is not constructed, or any portion retained to be developed in a future phase, shall be landscaped with a lawn at a minimum. 7. A minimum greenbelt of 25 feet shall be maintained between adjoining property line and any parking azea or structure except for the additional pazking spaces in Subazea B and along the east and west sides of the proposed north/south driveway where the minimum green belt shall 10 feet. Required mounding can be placed in this azea. 8. Site unity will be maintained by specifying the same species of major landscape elements (shade, evergreen, and ornamental trees) as in the adjoining Tuttle Crossing development. New compatible species of shrubs and ground cover will be introduced to the plant palette as needed to provide interest, focal points and screening around new development. Sig_nage and Graphics 1. All signage and graphics shall confrom to the Sign Code. 2. All signage shall be subject to applicable signage setbacks of the Code. 3. No sigh shall be painted or posted directly on the surface of any building, wall or fence. 4. No signs shall be applied to windows for the purpose of outdoor or exterior advertising. 5. No roof signs shall be permitted. Nor should a sign extend higher than the building. 6. No flashing, traveling, animated or intermittently illuminated signs may be used. 7. No billboazds, or electrical or other advertising signs shall be allowed other than a sign carrying the name of the business occupying the site. 8. The size of the site, the freeway frontage, the obscuration of view from southbound I-270 and the fact that neither wall no ground signage on the freeway side of the site will be 6 ,. ~~.; . one ground sign, each per the Sign Code, will be permitted facing I-270.
