AN ORDINANCE PROVIDING FOR A CHANGE OF ZONING
OF 2.85 ACRES OF LAND LOCATED ON THE NORTH
SIDE OF PERIMETER LOOP ROAD, APPROXIMATELY 500
FEET EAST OF AVERY ROAD, FROM: PCD, PLANNED
COMMERCE DISTRICT, TO: PCD, PLANNED COMMERCE
DISTRICT.
NOW, THEREFORE, BE IT ORDAINEl by the Council of the City
of Dublin, state of Ohio, of the elected members
concurring:
section 1. That the following described real estate (see
attached map marked Exhibit "A") situated in the City of
Dublin, state of Ohio, is hereby rezoned to PCD, Planned
Commerce District, and shall be subject to regulations
and procedures contained in Ordinance No. 21-70 (Chapter
Eleven of the Codified Ordinances) the City of Dublin
Zoning Code and amendments thereto.
section 2. That application, Exhibit "B", including the
list of contiguous and affected property owners, and the
recommendations of the Planning and Zoning Commission,
Exhibit "C", are all incorporated into and made an
official part of this Ordinance and made an official part
of this Ordinance and said real estate shall be developed
and used in accordance therewith.
Section 3. That this Ordinance shall take effect and be
in force from and after the earliest period allowed by
law.

PERIMETER CENTER TEXT AMENDMENT
This text covers a 2.85~ portion of subarea D which is east
of Subarea I, as those subareas are delineated in the Perimeter
Center zoning. The purpose of this amendment is to expand
Subarea I by adding 2.85 acres from the east.
SUBAREA DEVELOPMENT STANDARDS:
The expanded Subarea I shall comply with the general subarea
development standards contained in the original Perimeter Center
zoning unless otherwise indicated in this text or in the
submitted site plans.
EXPANDED SUBAREA I:
Permitted Uses:
The following uses shall be permitted within expanded
Subarea I:
a. Those uses listed in section 1159.01 and 1175.01 of the
Zoning Code.
b. Corporate offices.
c. Hotel and motel.
d. Institutional uses.
e. Drive-in facilities developed in association with a
permitted use.
f. Ancillary commercial uses within a structure primarily
devoted to office uses.
g. Use listed in section 1163.01 (a) (551) . New car
dealer, developed to provide a retail-to-office
transition and in accordance with accompanying
standards.
DEVELOPMENT STANDARDS FOR AUTOMOBILE DEALERSHIPS:
Auto display, sales and service, shall be permitted and may
not include a body shop, or storage of damaged vehicles or other
activities which may detract from the visual quality intended
here.
No automobile body work shall be permitted on the site. No
damaged automobiles shall be stored outdoors on the site.
Automobiles stored outside of buildings and awaiting sale are
limited to number of approved parking spaces, and may be
displayed in single rows only; Le., automobiles may be displayed
nose to tailor side to side but not both. Display pad areas
outside or parking areas are not included in foregoing
requirements, providing same is finished with concrete, brick
pavers or other permanent material and is located behind building
setback line. No outside loudspeakers permitted. No balloons,
banners, flags, blimps or helium air devices or similar devices,
may be used on site for any purpose. All building materials must
be or equal quality all four sides.
Display information on vehicle not a part of the vehicle
itself is limited to stickers required by federal or state law
and, in addition, one additional sticker not larger than 3 by 6
inches, not an iridescent color, and listing the year and type of
car. There will be no slogans, prices or other information
painted or added to the windows, either on the interior or
exterior side, of automobiles held for display on site.
No loading docks are permitted on site. All curbcuts on
public streets shall require brick pavers or concrete finished in
a brick pattern at point of entry into site.
Treatment of hazardous materials on site:
1. Waste oil and waste anti-freeze must be stored above
ground in concrete vault within the primary structure.
2. All hydraulic lifts shall use only biodegradable
vegetable oil as hydraulic medium, or future EPA
approved material.
3. New (as yet unused) oil will be stored above ground
indoors within the building.
4. No automobile gasoline or diesel fuel storage tanks
will be permitted on site for the purpose of fueling
autos.
DEVELOPMENT STANDARDS WHICH APPLY TO ALL USES IN EXPANDED
SUBAREA I:
Mechanicals:
All mechanicals must be so located or screened so as to not
be visible by automobile from either state Route 33, the exit
ramps to Avery Road, Avery Road, or the interior roads of the
center.
Architecture:
All buildings shall be designed to reflect the architectural
elements of the retail center and reflect the image and scale of
any office building. Materials must be complementary and
compatible with the retail center as determined by the Dublin
Planning and Zoning commission. This standard does not require

exact duplication of the themes, materials or elements of the
retail center. The goal is to achieve total site compatibility
within the retail center.
Yard and Setback Requirements:
1. Setback along Perimeter Loop Drive shall have a 25'
pavement setback and 50' building setback.
2. All other publicly dedicated local streets shall have a
25' pavement setback and 50' building setback.
3. Side yards shall be 15' for pavement and buildings.
4. Rear yards shall be 25' for pavement and buildings.
5. Total ground covered by all buildings shall not exceed
25% of the total lot area. However, parking garages
and buildings shall cover no more than 75% of the total
lot area.
Height Requirements:

20' shall be required for al imary structures.
Parking and Loading:
1. Sizes, ratio and type of parking and loading and other
facilities shall be regulated by Dublin Code Chapter
1193.
2. Bank drive-thru requirements as per the Columbus Zoning
Code.
Circulation:
1. Perimeter Loop Road shall have a 60' right-of-way, and
a 36' pavement width.
Waste and Refuse:
1. All waste and refuse shall be containerized and fully
screened from view by a solid wall or fence.
Storage and Equipment:
1. No materials, supplies, equipment or products shall be
stored or permitted to remain on any portion of the
parcel outside the permitted structure. Mechanical
equipment or other utility hardware on roof, ground, or
buildings shall be screened from public view with

materials harmonious with the building. storage of
automobiles displayed for sale is regulated by specific
requirements for automobile dealerships. See
Developments Standards.
Landscaping:
1. All landscaping shall be according to the Dublin

Signage:
Signage shall be in accord with Dublin Code and the
Development Standards contained in general section of text.
Lighting:
General standards for lighting are contained in the general
text. Lighting for automobile dealerships must comply with the
general standards. Further, lighting for automobile dealership
display if or a higher intensity than surrounding parking lot
lighting must make a smooth transition to lower intensity
lighting on surrounding uses. Applicants for this type of land
use must show specific fixtures to be used and specifications,
and further must provide lighting engineering plan showing actual
intensities of light falling on illuminated area and cutoff
areas. Higher intensity display lighting may be used only in
association with sales activity, limited to the hours of the
showroom operation. A secondary lower intensity lighting level
consistent with the adjacent parking lot(s) will be used at other
times.
If fixtures selected for surrounding uses in Perimeter
Center are not suitable for lighting for automobile dealerships,
then similar and visually compatible designs must be used.
Fixture finish and color will be the same as Perimeter Center
standard.

MOTION: To approve this rezoning application with the following seven conditions:

Fierce asked that this case be tabled even thou the applicant was not present. An
1 ormal discussion was planned for the benefit of t applicant to address several issues, but

-*- 6. Rezoning Application Z93-008 - Perimeter Center - Crown Mercedes Dealership
Mary Newcomb presented this case and slides. The case was informally reviewed by the
Commission on June 10th. The applicant has requested to amend the approved PCD, Planned
Commerce District plan for Subarea D of Perimeter Center. This will require the rezoning of
2.85 acres located on the north side of Perimeter Road. The site is located east of the existing
Crown Eurocars Dealership. This request is for an expansion of Subarea I to permit a new
Mercedes automobile dealership of approximately 14,000 square feet. It has a 92-space parking
lot along Perimeter Loop Road and parking for an additional 1 02 cars of new car storage behind
the building. Screening it will be important.

Materials, colors, site lighting, other specifics, driveway and entrance locations will need to be
submitted for review of the Development Plan later. Stormwater management and utilities for
the site will need to meet City standards. The public road system is built. The site is a major
gateway to the community, and elevations will be important. Staff recommends approval of this
rezoning application with the following six conditions to be addressed with the Development
Plan:
1) That the landscaping, including perimeter screening, meet Code and be coordinated with
adjacent sites and subject to Staff approval;
2) That Mercedes' drive be constructed along the north property line, subject to approval
by the City Engineer;
3) That storm water management be designed according to the requirements of the City
Engineer;
4) That the building materials, elevations and colors be consistent with the existing
dealership;
5) That site lighting utilize the same, or matching, features as the existing dealership and
conform to the Dublin lighting guidelines; and
6) That the text composite plan and Subarea map for Perimeter Center be amended to reflect
these changes.
Mr. Fishman asked if this would mean that Perimeter Center would not meet the standards in
the original text. Ms. Clarke responded that a Subarea text amendment was needed to include
the requirements of the original Mercedes Dealership (now occupied by others) plus the new
site. The original text covered 5 acres, and the amendment needs to cover the full 7.85 acres.
Glen Dugger, attorney, 37 West Broad Street, Columbus, said that Mercedes wants to change
only Subarea I to enable them to build the dealership with the same quality levels and standards
as are contained and approved in the dealership to the west.
Bob Apel, architect representing the applicant, said that the goal tonight was to address the
zoning aspects of increasing the Subarea I. It is their intent to make it appear to be one
complex. The same brick, banding and aluminum window system will be used with compatible
landscaping. The site plan will be an expansion to the east of the existing facility. The
dealership will occupy the southern two-thirds, and the northern one-third will be vehicle
storage. They intend a low planting island and then screening the entire area with a five-foot
mound with planting on it to substitute for the usual trees in between the cars. The Mercedes
dealership is scaled down, approximately half of the original building. An entrance off
Perimeter Loop will be shared. There are three areas of sloped glass across the front. The
appearance is slightly different, but character remains the same. The mechanicals are screened.
The building is finished on all four sides. Regarding the conditions, he said it would be difficult
to build the road required in the conditions.
Mr. Dugger said almost all of the Staff conditions will be met during the Development Plan.
The construction issue on Mercedes Drive is one simply of timing. They land owner and

developer of Perimeter Center commits that Mercedes Drive will be completed as part of
Perimeter Center later. He asked that this condition be deferred. He is not avoiding that
obligation.
Mr. Sutphen asked if he would accept, as a condition of approval, that the developer will be
responsible for that road. Mr. Dugger would like to transfer the obligation of building the road,
from this project to Perimeter Center. This owner is not a developer.
Mr. Dugger said Muirfield Partners owns Perimeter Center. Muirfield Partners was a
partnership between Mr. McKitrick and Planned Communities, but then went back to Mr.
McKitrick. He owns both this property and Perimeter Center to the north. Mr. Dugger
understands the need for the road, just not the necessity of it being built with this project.
Mr. Fishman asked if it could be approved subject to a bond from the owner.
Mr. Dugger gave his commitment to the Commission that the road would be built when
Perimeter Center is built. The development plan will be presented next month with the solution
for the timing of the construction of the continuation of Mercedes Drive.
Mr. Sutphen said the existing dealership has inadequate parking for customers.
Mr. Dugger said the problem is that the Jeep/Chrysler/Eagle dealership were put in that building
with Mercedes because the new one is not ready. When the new building is done, Mercedes
will move into it, and the parking problem should be resolved. Mr. Dugger said they
understand that they are out of compliance in the existing dealership.
Mr. Manus reminded Mr. Dugger that when Subarea I was created, one major concern was the
screening of mechanicals so as to create an appealing view from 1-270 entrance and exit ramps.
Ms. Stillwell asked what the actual height of the buildings was. Mr. Dugger responded that the
text states 65 feet. He would be willing to amend the text to 35 feet because the existing
building is 27 feet and the new one is 26 feet.
Ms. Clarke stated one of the reasons for interest in the construction of Mercedes Drive has to
do with shielding the parking lot at the rear. A five foot mound does not help if the road is
constructed higher than anticipated. Staffs concern is with screening the cars from the outside.
She asked if preliminary grades for that road can be established.
Mr. Dugger believes that is relatively easy to do because Mercedes Drive is built to the east line
of the existing dealership, and the grade at Perimeter Loop Drive is determined. He will work
on a plan for insuring the construction of Mercedes Drive for the next meeting.

7. Rezoning Application Z93-011 - Refinement of Metro Center Preliminary Plan -
Graeter's Ice Cream
Lisa Fierce presented this case and slides. The subject site is situated between Max and Erma's
and the Fifth Third Bank within Metro Center. The site is 1.33 acres and is a residual portion
of the original Max and Erma's site. A private access drive is constructed from Metro Place
North to Metro Place South behind the site. The site has no direct access onto a public street.
It will connect to Max and Erma's parking lot and to the access drive.
In connection with the Final Development Plan for Max and Erma's, uses for this site were
determined as non-fast food restaurant or offices. The request here is for a specialty ice cream
store which actually fits within the definition of a fast food restaurant. This request is for a
refinement to the text for Metro Center to permit an ice cream store of 1,800 square feet. The
building will be consistent with the area, featuring similar building materials, standing seam
metal roof and natural/compatible exterior finishes. Seating for 40 people in the restaurant will
be provided. There is a patio area along the east elevation toward the Reserve area that will
include some benches to accommodate outdoor seating. The restaurant will generally be in
operation from 11:00 a.m. to 11:00 p.m. in the summer, with more restricted hours in the
winter. There will be approximately 15 to 20 employees based on the season/need.
Staff is concerned about the level of pedestrian/bicycle activity that would be encouraged. Some
type of connection to the Frantz Road sidewalk is needed. Frantz Road has a sidewalk along
the entire length from SR 161 through Llewellyn Farms on the east side only. There should be
some kind of connection, possibly through the Reserve, to Graeter's.

CASE 6: Rezoning Application Z93-008 - Perimeter Center - Crown Mercedes Dealership
APPLICANT: Muirfield Drive Consultants c/o Jeffrey L. Brown, Attorney, 37 West Broad
Street, Columbus, Ohio 43215.
REQUEST: To rezone 2.85 acres located on the north side of Perimeter Loop Road,
approximately 500 feet east of Avery Road within Subarea D of Perimeter Center.
The request is to revise the approved Composite Plan for Perimeter Center under
the PCD, Planned Commerce District provisions contained in Section 1181.09 of
the Planning and Zoning Code.
BACKGROm...1J):
The existing Crown-Mercedes dealership is located on five acres in Subarea I within the
Perimeter Center Plan. The dealership was reviewed and approved by the Commission on
December 7, 1989, and was constructed in 1991. This proposal is for a new dealership to be
located directly to the east of the existing Crown Eurocars dealership. The land to the east must
be rezoned to permit auto sales in order for this to happen. This proposal was reviewed
informally by the Planning and Zoning Commission on June 10, 1993. The original proposal
was to rezone +8.422 acres.
The plan sets forth the general layout and development standards. The Planning and Zoning
Commission shall make its recommendation on the rezoning request and then return the
application to City Council. A public hearing will be conducted there. Following that, City
Council will vote on the ordinance. A two-thirds vote of Council is required in order to
override the recommendation of the Commission. If approved, the proposal will be reviewed
under the development plan procedures as well.
CONSIDERA TIONS:
0 The site is zoned PCD, Planned Commerce District as part of the Perimeter Center Plan
within Subarea D, which is generally zoned for freeway oriented offices and hotels.

STAFF RECOMMENDATION:
Staff feels the proposed development is consistent with the purpose, intent, and applicable
standards of the Zoning Ordinance, and that the proposed development is in conformity with the
Community Plan. The Staff recommends approval of this rezoning application with the
following conditions to be addressed with the development plan.
Conditions:
1) That the landscaping, including perimeter screening, meet Code and be coordinated with
adjacent sites, and are subject to Staff approval;
2) That Mercedes Drive be constructed along the north property line subject to approval by
the City Engineer.
3) That storm water management be designed according to the requirements of the City
Engineer;
4) That the building materials, elevations, and colors be consistent with the existing
dealership;
5) That site lighting utilize the same or matching fixtures as the existing dealership, and
conform to the Dublin lighting guidelines; and
6) That text, composite plan and subarea map for Perimeter Center be amended to reflect
these changes.

Perimeter Center/Crown-:Mercedes Dealership.
Ms. Newcomb presented slides and the information contained within the staff report. This is
an informal application where rezoning is contemplated, but no action will be taken now. The
site is 8.422 acres located on the north side of Perimeter Loop Road between A very Road and
Wilcox Road for construction of an auto dealership.
Concerns were raised about the area becoming an auto-mall. This area is zoned as PCD,
Planned Commerce District, as part of Subarea D (freeway oriented offices and hotels) abutting
the original Mercedes dealership. The land to the east must be rezoned to permit auto sales by
expanding Subarea I. This area is being called Subarea L. The new area will house the
relocated Mercedes dealership, a 92-space parking lot (to be located on Perimeter Loop Road)
and a 102-space parking lot located to the rear of the building. Other specifics have not been
presented.
Mr. Bob Apel, representing the Crown Dealership, reviewed comments from the fall meeting
(1992). Concerns were raised regarding limiting the extension of the dealership to just the area
needed to complete the additional building. He said no other auto dealerships be added that
would turn the area into an auto-mall. Mr. Apel stated that he will be present at the August
meeting to re-address this issue.
Mr. John McDonald (owner) mentioned that a third dealership would not be added.
Mr. Fishman raised a concern that the trees should be planted to complete the aesthetic look of
the mall area and the roads completed.
No action was taken.
