An ordinance providing for a change in zoning for 19.398 acres of land
located on the southeast corner of Rings Road and I-270, From: PCD,
Planned Commerce District, To: PCD, Planned Commerce District
(Chakeres/Wheatley/Puckett Text Revision)
NOW, ~EREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, ~ of the elected members concurring:
Section 1. That the following described real estate (see attached map marked Exhibit "A")
situated in the City of Dublin, State of Ohio, is hereby rezoned to PCD, Planned Commerce
District and shall be subject to regulations and procedures contained in Ordinance No. 21-70
(Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments
thereto.
Section 2. That application, Exhibit "B", including the list of contiguous and affected
property owners, and the recommendations of the Planning and Zoning Commission, Exhibit
"C", are all incorporated into and made an official part of this Ordinance and made an official
part of this Ordinance and said real estate shall be developed and used in accordance
therewith.
Section 3. That this Ordinance shall take effect and be in force from and after the earliest
period allowed by law.

not less than 8~ x 11 inches and not more than 16 x 20 inches). The map shall be
identified and submitted in addition to the General Description of Land. The map

feet beyond the limits of the proposed change..
To be shown on the map - all property lines, street right-of-way, easements and

2. State briefly how the proposed zoning and development relates to the existing

Properties are currently zoned PCD for offic
institutional, and hotel use under separate PCD development
texts. The proposal here is to combine these into one district
with a "blended" overall density. The blended density will yield
the same square footage of development as the existing zoning.
This will not increase density but will permit it to be rearrangec.

or binding commitment that the City of Dublin will be able to provide essential
services such as water and sewer facilities when needed by said applicant.
The City of Dublin will make every effort to have these services available
as needed. However, the rapid growth of the City of Dublin and Northwest
Franklin County has stretched the City's capacity to provide these services

Legal Description of Chakeres Land Co property
14.114 acres
Situated in Virginia Military Survey No. 2419 in the Township of Washington, County of
Franklin, State of Ohio and being a portion of the 20 1/4 acre tract of land conveyed to
William L. and Anna M. Smith by deed of record in Deed Book 1454, page 97, Recorder's
Office, Franklin County, Ohio and bounded and described as follows:
Beginning at a P.K, nail in the centerline of Rings Road at the northeast corner of said
Smith tract and at the northwest corner of a tract of land conveyed to Neva Bowen (now
Neva Howard) by deeds of record in Deed Book 1870, Page 440 (1/2 interest) and Deed
Book 2579, Page 89 (1/2 interest), Recorder's Office, Franklin County, Ohio.
Thence S 2° 56' 09" E along the east line of said Smith tact and along the west line of said
Bowen tact a distance of 730.12 feet to an iron pin at the southeast corner of said Smith
tract, at the southwest corner of said Bowen tract and in the north line of a 40.311 acre tract
of land conveyed to Lee R and Barbara Headlee by deed of record in Deed Book 2842,
Page 83, Recorder's Office, Franklin County, Ohio (passing an iron pin in the new south
right-of--way line of Rings Road at 50.29 feet);
Thence S 89° 46' 17" W along a portion of the south line of said Smith tract, along a
portion of the north line of said Headlee 40.311acre tract and along the north line of a
4.515 acre tract of land conveyed to Lee R. and Barbara Headlee by deed of record in Deed
Book 2869, Page 394, Recorder's Office, Franklin County, Ohio, a distance of 816.63
feet to an iron pin in the east limited access right-of--way line of Interstate Route 270 at the
northwest corner of said Headlee 4.515 acre tract, said uon pin being 150.00 feet right of
centerline station 615 + 97.48 of Interstate Route 270, as shown upon Sheet 27 of 30 of
Ohio Department of Highways, right-of-way plans for FPA-270-3, 47N;
Thence N 11° 36' 49" W along the east limited accessright-of--way line of Interstate Route
270 a distance of 687.19 feet to a point in the old centerline of Rings Road and in the north
line of said Smith tract, said point being 150.00 feet right of centerline station 622 + 84.67
of Interstate Route 270 (passing an iron pin at the intersection of the east limited access
right-of--way line of Interstate Route 270 with the new south right-of--way line of Rings
Road at 586.52 feet, said iron pin being 150.00 feet right of centerline station 621 + 84.00
of Interstate Route 270);
Thence N 80° 59' S 1" E along the old centerline of Rings Road and along a portion of the
north line of said Smith tract a distance of 924.15 feet to the place of beginning;
Containing 14.114 acres of land more or less and being subject to all legal highways,
easements and restrictions of record, including Parcel No. 230A, a 1.49 acre easement for
highway purposes, conveyed to the State of Ohio by deed of record in Deed Book 2675,

The Planning and Zoning Commission took the following action at this meeting:
4. Development Plan -Rings Road Office Building -5455 Rings Road
Location: 17.237 acres located on the southeast corner of Rings Road and I-270
Existing Zoning: PCD, Planned Commerce District (Chakeres and Wheatley/Puckett
Plans). -
Request: Review and approval of a master plan for a major office building and of a
development plan under the provisions of Section 153.058.
Proposed Use: A two-phase, 295,000 square foot, five-story office building.
Applicant: Duke Construction, c/o Mark Gialluca, 4700 I,akehurst Court, Suite 150,
Dublin, Oleo 43017.
MOTION: To approve this application because it complies with the approved Chakeres and
Wheatley/Puckett PCD composite plan and development texts and provides for coordination
among those parcels, furthers the economic development goals of the City and the Mount Auburn
Study, and adds to the highly successful Tuttle Crossing office park, with 18 conditions:
1) That development text modifications, to permit the density associated with the second
phase, be approved by City Council prior to the construction of Phase Two, if such
rezoning action is required in the opinion of the Law Director;
2) That the three lots, or portions thereof, being utilized be legally combined;
3) That access to the site meet the requirements of the City Engineer;
4) That right-of--way consistent with the Rings Road widening plan and/or easements for
Rings Road be deeded to the City by general warranty deed and provided to the Division
of Engineering prior to issuance of a building permit;
5) That temporary left turn stacking on Rings Road be provided, as required by the City
Engineer;
6) That the design of the private drives and parking areas be approved by the City Engineer;
7) That existing trees be protected prior to and during all phases of construction (including
grading) with temporary snow fencing to be located at least 15 feet from the dripline, and
that fencing be shown on all site, grading, construction and landscape plans, subject to
staff approval;
8) That all signage for this site comply with the development text and the Dublin Sign Code;

staff report, subject to staff approval;

12) That stormwater management meet the requirements of the City Engineer;
13) That water meter pits be located outside of the right-of-way and public easements and be
located below grade or be fully screened, subject to staff approval;
14) That the grading plan be revised to reduce the impact on existing trees;
15) That an additional fire hydrant be added, subject to approval by Washington Township
Fire Department;
16) That the Pagura property be properly rezoned prior to any development on that site,
including access provisions;
17) That the affected Tuttle Crossing development plan (for the Atrium building) be formally
reviewed and approved by the Commission prior to undertaking any site changes; and
18) That a revised landscape plan, site dimension plan, and grading plan, reflecting all
conditions of approval be submitted within two weeks, and that they be approved prior to
issuance of any building permit.

A) Schematic Plan, etc.
The site is an irregular rectangle totaling 19.398 acres. The I-270 frontage is about 600
feet and the depth along Rings Road is about 900 feet. The site is essentially flat with a gentle
slope to the east. The site is of a shape that will permit efficient development with an infinite
number of variations. With the exception of the portion located within the elevated roadway for
the Rings Road right-of-way there are no known physical factors that interfere with full use of the
site.
The primary attributes of the site are its I-270 freeway frontage and a location near to the
Tuttle Crossing interchange. It can be anticipated that the ultimate user of this site will seek to
exploit this exposure, probably with freeway-oriented office or corporate office uses such as are
located to the north, the south, and to the west, across I-270. These uses may include, but are not
limited to, general office uses, corporate headquarters office, hotels/motels and major institutional
uses.
It is anticipated that the site will develop with one large user, but, multiple users or
combinations with adjoining parcels are possible.
B) Provision of Water and Sanitary Sewer, etc.
Water service will be accessed from the 20-inch water line that is located in the Rings Road
right-of--way, on the south side of the street.
Sanitary sewer service will be accessed from the 21-inch trunk line located along the north
side of Rings Road, to the north of the site.
Surface drainage is to be determined. The Cramer Ditch, a major drainage outlet, is
located along the north side of Rings Road to the north of the site.
C) Tra, f, j"ic Circulation, etc.
The site has frontage on, and access to, one public roadway, Rings Road. Due to the
elevation of the Rings Road bridge over I-270, cuts will be restricted on the western portion of
the site. The "ramp" for the Rings Road/I-270 bridge is long and has excellent visibility.
D) Proposed Schedule of Site Development, etc.
The first phase of construction fora 295,000 square foot office building is expected to
begin in the Spring of 1997. It is anticipated that if the site develops with a single user there will
be a single phase of construction. If more than one user is involved it is anticipated that a single
phase for each user will occur.

To the greatest degree possible, this text seeks to make this site subject to the same goals,
restrictions, and quality assurances as the Tuttle Crossing development to the south and across I-
270 to the west.
The development standards of Tuttle Crossing Subazea A aze lazgely carried over into this
text. The goal is to encourage development of this site as a visually integral part of the Tuttle
Crossing development and be complimentary to the Ashland corporate park to the north.
F) Evidence of Control, etc.
All affected properties aze now in the control of one developer.
G) Deed Restrictions.
Deed restrictions, if any, will be filed at the time of conveyance of the property to end
user(s).
ITJ Development Standards Text.
If these standazds conflict in any way with the City of Dublin Codified Ordinances then
the Planned Commercial District shall prevail. Standazds in the City of Dublin Zoning Code
applicable to matters not covered in this document shall apply to each of the subazeas in the
Planned Commercial District. The proposed development will compliment the adjacent uses
within the Tuttle Crossing Development. The Subarea Development Standazds for the Tuttle
Crossing Development will apply, as appropriate, to this development. They aze as follows:

1) It is the intent of the developer to create a unified, high quality office pazk
development.
2) Mid rise, signature type offices with parking structures will be promoted along
freeway frontage.
3) Building elevations, plans and materials will be submitted for approval as part of
the Development Plan in order to ensure that the quality standards required by this
text have been met.
4) The same palette of landscaping materials will be utilized in a similar design
manner as in the Tuttle Crossing development to ensure a coordinated landscaping
treatment. Proposed developments will be focused around major water features.
Wells will be used in some cases to control levels.
5) All site planning will be done in a manner consistent with prudent planning
principles and practices.

The following uses are permitted:
1) Those uses listed Dublin Code 153.026 (SO, Suburban Office and Institutional) and
153.034 (OLR, Office, Laboratory and Research).
2) Corporate offices.
3) Hotel and motel.
4) Institutional uses.
5) Ancillary commercial or restaurant uses within a structure primarily devoted to
office or hotel uses.
The overall site will be developed with a maximum building area computed on the basis of
acreage, exclusive of right-of--way, yielding about 300,000 square feet of gross floor area. In an
effort to promote large scale signature type office buildings with integrated parking structures, the
maximum overall density will be 17,000 square feet per acre. The higher density will offset costs
needed to create parking structures, therefore, promoting open space other than parking lots.
1) Setback along I-270 shall be 50 feet for all parking areas and 75 feet for
buildings.
2) Side yards shall be 25 feet for pavement and buildings.
3) Rear yards shall be 25 feet for pavement and buildings.
4) All other publicly dedicated streets shall have a 25-foot pavement setback and a 50-
foot building setback.
5) Total ground covered by all buildings, excluding parking garages, shall not exceed
25 percent of the total area. Maximum lot coverage shall not exceed 70 percent
of the total lot area.
The maximum height for structures shall be measured per the Dublin Zoning Code and have a
maximum height limitation of 100 feet. The maximum height may be extended if the structure
is set back from both I-270 and Rings Road rights-of-way and an additional two feet beyond the

of two stories shall be required for all primary structures.
1) Sizes, ratio, and type of parking and loading and other facilities shall be
regulated by Dublin Code, Chapter 153.
2) Bank drive-thru uses subject to conditional use provisions of Dublin Code 153.026.
3) All loading docks shall be screened according to Dublin Code, Chapter 153.
1) All accesses shall be as approved by the City Engineer. At least one full service
cut shall be permitted on Rings Road, in an appropriate location.
2) Final location and design of all accesses to be subject to approval of the City
Engineer.
3) A turn lane will be provided on Rings Road if it is needed, as determined by the
City Engineer.
All waste and refuse shall be containerized and fully screened from view by a solid wall or fence.
1) No materials, supplies, equipment, or products shall be stored or permitted
to remain on any portion of the parcel outside of permitted structures.
2) Mechanical equipment or other utility hardware on roof, ground, or buildings shall
be screened from public view with materials harmonious with the building.
1) All landscaping shall be according to Dublin Landscape Code.
2) A continuous landscape treatment shall be provided along the I-270 frontage
containing a six foot earth mound or evergreen hedge/planting. Trees shall be
placed in a manner that provides a 50 percent visual opacity throughout the year.
This shall be achieved by providing a mixture of deciduous and evergreen trees.

The deciduous trees shall be planted a minimum of 30 feet on center with a
minimum installation size of 2.5 inches caliper measured at to height of 12 inches
above ground level. Evergreen trees shall be installed a maximum of 15 feet on
center with a minimum height of six to eight feet. Landscape material shall be
located to provide maximum buffering to vehiculaz azeas while allowing visual
access to building facades.
3) As many existing trees as possible will be preserved. Existing trees to be
preserved shall be protected during construction with snow fencing placed at the
drip line and maintained during construction.
4) Within the 25-foot setback along Rings Road, a three foot average height
continuous earth mound shall be installed and planted with one tree per 40 feet of
frontage or fiaction thereof. Provided however that this requirement will be abated
due to the rise in Rings Road as it crosses I-270. The degree and point of
abatement will be subject to resolution by the applicant and the Staff.
5) If a parking lot abuts a dedicated road, then the one tree per 40 feet of frontage
shall meet both the vehiculaz use azea perimeter requirement as well as the street
tree requirement.
6) Any portion of a lot upon which a building or pazking area is not constructed, or
any portion retained to be developed in a future phase, shall be landscaped with a
lawn at a minimum.
7) A minimum greenbelt of 25 feet shall be maintained between adjoining property
line and any parking area or structure. Required mounding can be placed in this
area.
8) Site unity will be maintained by specifying the same species of major landscape
elements (shade, evergreen, and ornamental trees) as in the adjoining Tuttle
Crossing development. New compatible species of shrubs and ground cover will
be introduced to the plant palette as needed to provide interest, focal points and
screening around new development.

1) All signage and graphics shall conform to the Sign Code.
2) All signage shall be subject to applicable signage setbacks of the Code.
3) No sign shall be painted or posted directly on the surface of any building, wall or
fence.
4) No signs shall be applied to windows for the purpose of outdoor or exterior
advertising.

5) No roof signs shall be permitted. Nor should a sign extend higher than the
building.
6) No flashing, traveling, animated or intermittently illuminated signs may be used.
7) No billboards, or electrical or other advertising signs shall be allowed other than
a sign carrying the name of the business occupying the site.
8) The size of the site, the freeway frontage, the obscuration of view from southbound
I-270 and the fact that neither wall nor ground signage on the freeway side of the
site will be visible at the access point on Rings Road, create special signage
needed. One wall and one ground sign, each per the Sign Code, will be permitted
facing I-270. Additionally, at the Rings Road access point one ground sign, six
feet in height and with a maximum size of 50 square feet will be permitted.
Except as otherwise stated herein:
1) External lighting within all subareas shall be cutoff fixtures.
2) All types of pazking, pedestrian, and other exterior lighting shall be on poles or
wall mounted cutoff fixtures and shall be from the same type and style.
3) All light poles and standards shall be dazk in color and shall either be constructed
of dazk wood or dazk brown, black, or bronze metal.
4) Parking lot lighting shall be no higher than 28 feet.
5) Cutoff type landscape and building uplighting shall be permitted.
6) All lights shall be arranged to reflect light away from any street or adjacent
property.
7) All building illuminations shall be from concealed sources.
8) No colored lights shall be used to light the exterior of buildings.
9) Landscape lighting along Rings Road shall be ground mounted with a low level of
illumination.
No chain link or wire fencing shall be permitted, except in areas where such aze required by
ODOT (Ohio Department of Transportation) or federal regulations.
