AN ORDINANCE TO APPROPRIATE A 0.034 ACRE TEMPORARY
CONSTRUCTION EASEMENT AND A 0.004 ACRE FEE SIlVIPLE I1vTERFST
IN PROPERTY OWNED BY LOUIS E. TIBERI AND BETTY ANN TIBERI,
LOCATED ON THE WEST SIDE OF COFFMAN ROAD, IN THE CITY OF
DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO, TO AMEND THE
ANNUAL APPROPRIATIONS BUDGET AND DECLARING AN
EMERGENCY.
WHEREAS, the City of Dublin is preparing to improve and widen Coffman Road; and,
WHEREAS, said improvement will require the City of Dublin to obtain a temporary
construction easement and a fee simple interest in and to the premises described in the
attached Exhibits "A" and "B", located in the City of Dublin, Franklin County, Ohio.
NOW, THF,REFORE, BE IT ORDAINED by the Council, of the City of Dublin, State
of Ohio, ~_ of the elected members concurring that:
Section 1. A temporary construction easement and a fee simple interest in and to the
premises located in the City of Dublin, Franklin County, State of Ohio, and more fully
described in the legal descriptions attached hereto as Exhibits "A" and "B" are hereby
appropriated for the public purpose of improving and widening Coffman Road, pursuant
to Ohio Revised Code Chapter 163 and the Constitution of the State of Ohio.
Section 2. Council hereby fixes the value of the interests appropriated at One Thousand
Nine Hundred and Eighty Dollars and 00/100 Cents ($1,980.00) which sum shall be
deposited with the Franklin County Common Pleas Court for the use and benefit of the
owners of the property appropriated. Upon such deposit, the City of Dublin shall take
possession of and enter upon the property pursuant to law.
Section 3. Council fmds that the appropriation is necessary for the stated purpose, that
the City has been unable to agree with the owner of the property as to appropriate
compensation, and that the City intends to obtain immediate possession of the property.
Section 4. The City Law Director is directed to file a petition for appropriation in the
Franklin County Common Pleas Court, to have a jury impaneled to assess the compensation
to be paid for the real estate herein described above.
Section 5. That there be appropriated from the unappropriated balance in the Capital
Improvements Tax Fund the amount of $1,980.00 to account 40-03-14-2550 for right of
way acquisition.
Section 6. This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare. The reason for such
necessity is that the prompt improvement and widening of Coffman Road is necessary to
improve traffic circulation and relieve traffic congestion for the citizens of Dublin.
Therefore, this ordinance shall go into immediate effect.

out of Lot 1 of S1}annon Park Section I (Plat Book 54, Page 72 and 73) as conveyed to Louis E.
c~: Betty A. Tiberi in Official Record 08283-103 of the rranklin County Recorder's Office. Said
0.004 acres being more particularly described as follows:
Beginning for reference at the centerline intersection of Coffman Road with Rosscommon
Roacl (Station 228+66.74), thence, Ni0°-47'-25"E a distance 50.00 feet to a point, thence, N79°-
12'-35"1'V adistance of 40.00 feet to the TRUE POINT OI~ BEGINNING in the westerly rigl-t-of-
way line of Coffman Road, the easterly line of said Lot 1 (40.00 feet left of Station 229---1 6.74);
Thence, with said westerly right-of--way line of Coffman Road, the said easterly line of Lot
1, and with a curve to the right having a radius of 25.00 feet, and arc Length of 39.43 feet and
whose chord bears S55°-55'-20"W a chord distance of 35.47 feet to a point in the southerly line
of said Lot I, the northerly line of said Rosscommon Road (65.00 felt ot'station 228+91.74);
Thence, NSS°-55'-20"E a distance of 35.47 feet to the TRUC POINT Or BEGINNING
anti containing 0.004 acres of land, rnore or less, of which the present roadway occupies 0.00
acres. Subject to all easements, restrictions and rights-ol=way or record.
The above described acreage is contained in Auditors Parcel 273-001 198.

as conveyed to Louis C. & Betty A. Tiberi, as recorded in Ollicial Record 08283-I03
