AN ORDINANCE TO APPROPRIATE A 0.093 ACRE TEMPORARY
CONSTRUCTION EASEMENT AND A 0.176 ACRE FEE SIMPLE IlVTEREST
IN PROPERTY OWNED BY JAY B. EGGSPUEHLER, LOCATED ON THE
WEST SIDE OF COFFMAN ROAD, IN THE CITY OF DUBLIN, COUNTY
OF FRANKLIN, STATE OF OHIO, TO AMEND THE ANNUAL
APPROPRIATIONS BUDGET AND DECLARING AN EMERGENCY.
WHEREAS, the City of Dublin is preparing to improve and widen Coffman Road; and,
WHEREAS, said improvement will require the City of Dublin to obtain a temporary
construction easement and a fee simple interest in and to the premises described in the
attached Exhibits "A" and "B", located in the City of Dublin, Franklin County, Ohio.
NOW, THFORE, BE IT ORDAINED by the Council, of the City of Dublin, State
of Ohio, of the elected members concurring that:
i n A temporary construction easement and a fee simple interest in and to the
premises located in the City of Dublin, Franklin County, State of Ohio, and more fully
described in the legal descriptions attached hereto as Exhibits "A" and "B" are hereby
appropriated for the public purpose of improving and widening Coffman Road, pursuant
to Ohio Revised Code Chapter 163 and the Constitution of the State of Ohio.
Section 2. Council hereby fixes the value of the interests appropriated at Two Thousand
Forty Dollars and 00/100 Cents ($2,040.00), which sum shall be deposited with the
Franklin County Common Pleas Court for the use and benefit of the owners of the property
appropriated. Upon such deposit, the City of Dublin shall take possession of and enter upon
the property pursuant to law.
Section 3. Council finds that the appropriation is necessary for the stated purpose, that
the City has been unable to agree with the owner of the property as to appropriate
compensation, and that the City intends to obtain immediate possession of the property.
i 4 The City Law Director is directed to file a petition for appropriation in the
Franklin County Common Pleas Court, to have a jury impaneled to assess the compensation
to be paid for the real estate herein described above.
Section 5. That there be appropriated from the unappropriated balance in the Capital
Improvements Tax Fund the amount of $2,040.00 to account 40-03-14-2550 for right of
way acquisition.
Section 6. This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare. The reason for such
necessity is that the prompt improvement and widening of Coffman Road is necessary to
improve traffic circulation and relieve traffic congestion for the citizens of Dublin.
Therefore, this ordinance shall go into immediate effect.

Situated in the State of Oliio, County of Franklin, Township of Washington and being
0.176 acres out of 7.0.57 acres conveyed Jay B. Eggspuel~ler, as recorded in Ollicial Record
21629-A01, Franklin County Recorders Office. Said 0.176 acres being more particularly
described as follows:
Beginning at the northwest corner of said 7.057 acre tract, said point also being on the
centerline of Coffman Road (Station 246+31.00);
Thence S79°-12'-35"E, along the north line of said 7.057 acre tract, for a distance of
22.50 feet to a point on the easterly right-of--way line of Coffman Road (22.50 feet right of
Station 246+31.00) ;
Thence S 10°-47'-25"W, along said right-of--way line, for a distance of 340.00 feet to a
point on the south line of said 7.057 acre tract(22.50 feet right of Station 242+91.00) ;
Thence N79°-12'-35"W, along said south line, for a distance of 22.50 feet to a point on
the centerline of Coffman Road (Station 242+91.00) ;
T'lience NIO°-47'-25"E, along said centerline, for a distance of 340.00 feet to the Point of
Beginning, containing 0.176 acres of land, more or less of which the present roadway occupies
0.176 acres. Subject to all easement, right-of--way and restrictions of record.
The above described acreage is contained in Auditors Parcel 270-000297.

for Coffman Road, Perimeter Drive, Post Road and Brand Road prepared by Jolin E. Foster and
