AN ORDINANCE TO APPROPRIATE A 0.017 ACRE TEMPORARY
CONSTRUCTION EASEMENT AND A 0.010 ACRE FEE SIMPLE INTEREST
IN PROPERTY OWNED BY GREG B. BENNETT AND MARGARET S.
BF.NNETT, LOCATED ON THE WFST SIDE OF COFFMAN ROAD, IN THE
CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO, TO
AMEND THE ANNUAL APPROPRIATIONS BUDGET AND DECLARING
AN EMERGENCY.
WHEREAS, the City of Dublin is preparing to improve and widen Coffman Road; and,
WHEREAS, said improvement will require the City of Dublin to obtain a temporary
construction easement and a fee simple interest in and to the premises described in the
attached Exhibits "A" and "B", located in the City of Dublin, Franklin County, Ohio.
NOW, TH FORE, BE IT ORDAINED by the Council, of the City of Dublin, State
of Ohio, of the elected members concurring that:
Section 1. A temporary construction easement and a fee simple interest in and to the
premises located in the City of Dublin, Franklin County, State of Ohio, and more fully
described in the legal descriptions attached hereto as Exhibits "A" and "B" are hereby
appropriated for the public purpose of improving and widening Coffman Road, pursuant
to Ohio Revised Code Chapter 163 and the Constitution of the State of Ohio.
Section 2. Council hereby feces the value of the interests appropriated at Two Thousand
Eight Hundred Eighty-Five Dollars and 00/100 Cents ($2,885.00), which sum shall be
deposited with the Franklin County Common Pleas Court for the use and benefit of the
owners of the property appropriated. Upon such deposit, the City of Dublin shall take
possession of and enter upon the property pursuant to law.
Section 3. Council finds that the appropriation is necessary for the stated purpose, that
the City has been unable to agree with the owner of the property as to appropriate
compensation, and that the City intends to obtain immediate possession of the property.
Section 4. The City Law Director is directed to file a petition for appropriation in the
Franklin County Common Pleas Court, to have a jury impaneled to assess the compensation
to be paid for the real estate herein described above.
Section 5. That there be appropriated from the unappropriated balance in the Capital
Improvements Tax Fund the amount of $2,885.00 to account 40-03-14-2550 for right of
way acquisition.
Section 6. This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare. The reason for such
necessity is that the prompt improvement and widening of Coffman Road is necessary to
improve traffic circulation and relieve traffic congestion for the citizens of Dublin.
Therefore, this ordinance shall go into immediate effect.

Situated in the State of Ohio, County of Franklin, City of Dublin and being 0.010
acres out of Lot 102, Shannon Park Section 1 as recorded in Plat Book S4, at pages 72,
73, as conveyed to Greg B. & Margaret S.Bennett, as recorded in Official Record 10302-
C 14, Franklin County Recorders Office. Said 0.010 acres being more particularly
described as follows:
Beginning at the northeast corner of said Lot 102, said point also being on the
westerly right-of--way line of Coffman Road (40.00 feet left of Station 221+89.82) ;
Thence S10°-47'-2S"W, along the east line of said Lot 102 and the westerly right-
of-way line of Coffman Road, for a distance of 28.20 feet to a point of curvature (40.00
feet left of Station 221+61.63);
Thence, continuing along said right-of--way line and the east line of said Lot 103,
with a curve to the left, having a radius of 1081.74 feet,an arc length of 44.64 feet, whose
chord bears S09°-36'-29"W for a chord distance of 44.63 feet to the southeast corner of
said Lot102 (40.00 feet left of Station 221+18.64) ;
Thence N74°-17'-38"W, along the south line of said Lot 102, for a distance of
4.71 feet to a point (44.67 feet left of Station 221+19.51) ;
Thence with a curve to the right, having a radius of 1232.90 feet, an arc length of
44.32 feet, whose chord bears N07°-1 S'-SO"E for a chord distance of 44.31 feet to a
point (46.50 feet left of Station 221+61.63) ;
Thence N08°-30'-S1"E for a distance of 28.76 feet to a point on the north line of
said Lot 102 (47.64 feet left of Station 221+90.37) ;
Thence S75 °-04'-24"E, along said north line, for a distance of 7.66 feet to the
Point of Beginning, containing 0.010 acres of land, more or less. Subject to all easement,
right-of--way and restrictions of record.
The above described acreage is contained in Auditors Parcel 273-001299.

centerline plat for Coffman Road, Perimeter Drive, Post Road and Brand Road prepared

being on the westerly right-of--way line of Coffman Road (40.00 feet left of Station
221+89.82) ;
Thence N75°04'-24"W, along the north line of said Lot 103 , for a distance of
7.66 feet to the True Point of Beginning (47.64 feet left of Station 221+90.37) ;
