AN ORDINANCE TO APPROPRIATE A 0.046 ACRE TEMPORARY
CONSTRUCTION EASEMENT AND A 0.028 ACRE FEE SIMPLE INTEREST
IN PROPERTY OWNED BY ALAN E. AMSTUTZ AND SUE A. AMSTUTZ,
LOCATED ON THE WEST SIDE OF COFFMAN ROAD, IN THE CITY OF
DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO, TO AMEND THE
ANNUAL APPROPRIATIONS BUDGET AND DECLARING AN
EMERGENCY.
WHEREAS, the City of Dublin is preparing to improve and widen Coffman Road; and,
WHEREAS, said improvement will require the City of Dublin to obtain a temporary
construction easement and a fee simple interest in and to the premises described in the
attached Exhibits "A" and "B", located in the City of Dublin, Franklin County, Ohio.
NOW, THEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State
of Ohio, ~_ of the elected members concurring that:
. ection 1. A temporary construction easement and a fee simple interest in and to the
premises located in the City of Dublin, Franklin County, State of Ohio, and more fully
described in the legal descriptions attached hereto as Exhibits "A" and "B" are hereby
appropriated for the public purpose of improving and widening Coffman Road, pursuant
to Ohio Revised Code Chapter 163 and the Constitution of the State of Ohio.
erection 2. Council hereby fixes the value of the interests appropriated at Eight Thousand
One Hundred Dollars and 00/100 Cents ($8,100.00), which sum shall be deposited with the
Franklin County Common Pleas Court for the use and benefit of the owners of the property
appropriated. Upon such deposit, the City of Dublin shall take possession of and enter upon
the property pursuant to law.
. ection 3. Council fmds that the appropriation is necessary for the stated purpose, that
the City has been unable to agree with the owner of the property as to appropriate
compensation, and that the City intends to obtain immediate possession of the property.
erection 4. The City Law Director is directed to file a petition for appropriation in the
Franklin County Common Pleas Court, to have a jury impaneled to assess the compensation
to be paid for the real estate herein described above.
Section 5. That there be appropriated from the unappropriated balance in the Capital
Improvements Tax Fund the amount of $8,100.00 to account 40-03-14-2550 for right of way
acquisition.
Section 6. This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare. The reason for such
necessity is that the prompt improvement and widening of Coffman Road is necessary to
improve traffic circulation and relieve traffic congestion for the citizens of Dublin.
Therefore, this ordinance shall go into immediate effect.

Situated in the State of Ohio, County of Franklin, City of Dublin and being 0.028
acres out of Lot 69, Shannon Park Section 1 as recorded in Plat Book 54, at pages 72, 73,
as conveyed to Alan E. & Sue A. Amstutz, as recorded in Official Record 06222-
J14,Franklin County Recorders Office. Said 0.028 acres being more particularly described
as follows:
Beginning at the northeast corner of said Lot 69, said point also being on the
westerly right-of--way line of Coffman Road (40.00 feet left of Station 224+97.07) ;
Thence S10°-47'-25"W, along the east line of said Lot 69 and the westerly right-
of-way line of Coffman Road, for a distance of 166.52 feet to the southeast corner of said
Lot 69(40.00 feet left of Station 223+30.55);
Thence N48°-44'-18"W, along the south line of said Lot 69, for a distance of
12.20 feet to a point (50.52 feet left of Station 223+36.74) ;
Thence N13 °-06'-15"E for a distance of 161.39 feet to a point on the
north line of said Lot 69 (44.00 feet left of Station 224+98.00) ;
Thence S66°-08'-12"E, along said north line, for a distance of 4.11 feet to the
Point of Beginning, containing 0.028 acres of land, more or less. Subject to all easement,
right-of--way and restrictions of record.
The above described acreage is contained in Auditors Parcel 273-001266.
Stations- and offsets used in this description are referenced to the proposed
centerline plat for Coffman Road, Perimeter Drive, Post Road and Brand Road prepared
by John E. Foster and Associates, Inc.
Bearings used in this description are based on an actual field survey utilizing USGS
Monuments Britton, Davidson and Lincoln LeVec Tower by John E. Foster and
Associates, Inc. in May 1989.
