General Development Character of the Site. This site, as more fully described in Exhibit A, is located in Shamrock Industrial Park, 6365 Shier-Rings Road, Dublin, Ohio. The property is currently owned by Applicant, Tara Group, Ltd. (Exhibit B), and is zoned as a Restricted Industrial District pursuant to Dublin Codified Ordinance ("DCO") §153.031. The maps and diagrams attached as Exhibit C show the location of the existing structure which currently houses Performance Films, Inc. and a business known as Bike, Warehouse, Inc., both owned by Applicant. A Site Plan is attached hereto as Exhibit D. Drawings of the existing structure are attached as Exhibit E. Due to the common ownership and existing use of the property by Applicant and its employees, Applicant proposes to continue to use this site for warehousing distribution and associated office use as permitted by DCO §153.031 and in addition, seeks to use a limited portion of the property for a small amount of retail sales and other office use. (See attached Exhibit F). B. Provision of Water, Sanitary Sewer, etc. The existing structure is presently served by a public water and sanitary sewer system. Applicant does not anticipate any increase in the use of these services as a result of this proposal. C. Proposed Traffic Circulation Patterns. Exhibit D shows the existing relationship of the site to Shier-Rings Road and Scherers Place. Existing access and parking will be sufficient with additional parking facilities available to the east and south as indicated on Exhibit D, although no need for additional parking is anticipated. Schedule of Site Development Site development is essentially complete with the exception of final landscaping to be performed in the Spring of 1997 (see Exhibit D) and finishing of the interior office space and showroom as depicted in Exhibit F. E. Relationship to Existing and Future Land Use. This site is located in a Restricted Industrial District (DCO 153.031) which allows warehousing and associated office use and Applicant submits that the proposed additional office use and small amount of limited retail sales area use is compatible with the current usage. F. Control of the Land. Applicant is the sole owner of this property. (See Exhibit B). G. Deed Restrictions. Wth the exception of certain recorded easements (see Exhibit C), the property is unencumbered by deed restrictions. H. Development Standards Text General It is the intention of the Applicant to continue to utilize this site as a warehouse, distribution center, and offices for Performance Films, Inc. and Bike Warehouse, Inc., within the permitted uses of a Restricted and Limited Industrial District. (DCO §153.031 and §153.032) and no modifications of the exterior of the existing structure are anticipated. In addition, Applicant proposes to lease a limited amount of office space to other businesses (see Exhibit F) and to establish a limited area within the site (not to exceed 15% of the total square footage of the structure) for the retail sale of bicycles and related parts and accessories (see Exhibit F). Applicant at this point anticipates only two tenants, an insurance agency and a trucking company dispatch office. All uses permitted under DCO §153.031, Restricted Industrial District §153.032, Limited Industrial District and §153.033 General Industrial District. B. Light Industrial. Processing, compounding, assembly, packaging and treatment of and distribution of goods, materials and products not involving operations which are offensive because of odor, dust, smoke, gas fumes, vibrations, noise or other causes. Such uses shall be totally contained within a building having no outdoor, or open lot storage or activity and the exterior character of the buildings shall be compatible with and of the general appearance of office structures. C. Personal Service. Light mechanical repair, assembly; and servicing of bicycles. D. General office, professional, business, and corporate office. E. Retail commercial sales limited to bicycles and related products, said retail space not to exceed 15% of total square footage of the structure located on site. (2) Permitted Density Except as otherwise described in this text, maximum density shall be 10,000 SF per acre for buildings. Yard and Setback Reauirements In addition to the provisions of §§153.070 through 153.076, the following standards for arrangement and development of land and buildings are required. (a) LOT WIDTH. This site abuts a public street and has adequate lot width to provide the yard space required by these development standards. (b) SIDE YARDS. For main and accessory structures, including open service and loading areas, the required side yards shall not be less than one-third the sum of the height and depth of the structure, but in no case shall be less than 15 feet from the interior lot line and 25 feet from L\CLLWLAN.DOC 12/30/96 1255 PM any residential zoning district or planned development district as listed in §153.016. (c) REAR YARDS. For main and accessory structures, the required rear yards shall not be less than one-third the sum of the height and width of the structure, but in no case shall be less than 15 feet from any interior lot line and 25 feet from any residential zoning district, or planned development district as listed in §153.016. (3) Hei hq t Requirements. Maximum height for structures shall be 35' as measured for Dublin Zoning Code. (4) Parking and Loading Sizes, ratio and type of parking and loading and other facilities shall be regulated by DCO §§153.200-153.212 (off street parking and loading). (5) Waste and Refuse All waste and refuse shall be containerized and fully screened from view by a solid wall or fence. (6) Storage and Equipment No materials, supplies, equipment or products shall be stored or permitted to remain on any portion of a parcel outside of a permitted structure. Mechanical equipment or other utility hardware on roof, ground or buildings shall be screened from public view with materials harmonious with the building. (7) Landscaping. All landscaping shall conform to the Dublin Landscape Code and shall contain a mixture of ornamental evergreen and shade trees. The pattern of landscaping shall be uniform in design and type of materials, mounding and fencing. Landscaping may vary in density, spacing and other treatment to reflect variations of topography. (8) Signage and Graphics. (a) All signage, graphics and setbacks shall conform to DCO §§153.150-153.164. Rezoning Application Z97-OO1Z -Composite Plan -Shamrock Industrial Park - Performance l~hns - 6365 Shier-Rings Road John Talentino presented this request to rezone from RI, Restricted Industrial District to PCD, Planned Commerce District. The two acre site is on the south side of Shier-Rings Road. It contains a new 12,000 square foot building and currently houses Performance Films. The proposed PCD uses include RI uses plus office use and retail use for a bike shop, each of which could occupy up to 15 percent of the building. Staff recommends deleting "canning" from the list of permissible uses. There is a bikepath in front of the building. The pazking lot will need nine additional spaces to support the change in use as requested. A recently received landscaping plan has not been reviewed by staff. The Southwest Area Plan notes that the Avery Road Corridor is to have a broad mix of uses. Staff believes this application is consistent with that plan. Mr. Lecklider asked about screening the utility boxes. Mr. Talentino said they would be screened and will be covered in a revision to the site and landscaping plans. Staff recommends approval of this application with the following conditions: 1) That pazking and its screening conform to Code; 2) That landscaping conform to Code, and that a revised landscape plan be submitted and be approved by staff; 3) That use 204 "Canning and preserving fruits, vegetables and sea foods" be excluded from the permitted uses in the zoning text, and that a revised text be submitted; and 4) That a revised site plan, landscape plan, and zoning text be submitted within two weeks and be acceptable to staff. Mr. Ferraza asked about signage. Mr. Talentino said the sign needs to meet Code, and its base requires landscaping. George Lewis, the applicant, said Buckeye Landscaping will be doing the site design, and he feels his plan will exceed Code. The building could have been an inexpensive, unattractive metal building, but he has built an attractive and more expensive building. He agreed to all the conditions. Mr. Lewis said no truck dispatching would be permitted, and it has been deleted from the request. An insurance office is proposed and a small printing office may be included. Ms. Clarke said truck dispatching would be a conditional use in the RI District; subject to further Commission review. She read examples of wholesaling and manufacturing uses in the RI District. She said the larger manufacturing or "mill" type of uses are not permitted in the RI District. It was noted that the text still mentions truck dispatching as a permitted use. Mr. Lewis said this was erroneous and will be removed from the development text. Dublin Planning and Zoning Commission Staff Report -February 6, 1997 Page 7 CASE 2: Rezoning Application Z97-OO1Z -Composite Plan -Shamrock Industrial Park - Performance Films - 6365 Shier-Rings Road APPLICANT: Tara Group, Ltd., c/o George Lewis, 6365 Shier-Rings Road, Dublin, Ohio 43016. REQUEST: Review and approval of a rezoning application from RI, Restricted Industrial District to PCD, Planned Commerce District to allow for limited retail sales and office use within an existing 12,000 square foot building in addition to RI uses. The site is 2.1 acres located on the southwest corner of Shier-Rings Road and Scherer Place, approximately 350 feet east of Avery Road. STAFF CONTACT: John Talentino, Planner. BACKGROUND: The Planned Commerce District was designed to permit the vast majority of development decisions to be made for properties with commercial potential, at the time of zoning. The developer is to clearly set out the list of permissible uses, standards for development, infrastructure contributions, and general development expectations within the zoning document, consisting of the composite plan and development text. With approval of the PCD zoning, the developer knows exactly what will be required by the municipality in the future. The subject site is Lot 9 of the Shamrock Industrial Park and is zoned RI, Restricted Industrial District. Performance Films, a window tinting business, occupies one half of the newly constructed 12,000-square-foot building. The applicant is requesting the site be rezoned to PCD, Planned Commerce District to allow limited retail and general office uses in the remainder of the building. The Planning and Zoning Commission is to make its recommendation on the proposed rezoning and then forward this application to City Council. It will be scheduled for a public hearing and vote by City Council. Atwo-thirds vote of Council will be required to override a negative recommendation from the Commission, and otherwise the outcome will be determined by a simple majority vote. If approved, the rezoning will take effect in 30 days. The building is in place so no development plan review is anticipated. However, if changes to the building or site plan are proposed in the future, prior approval by the Planning Commission under the development plan process will be required. CONSIDERATIONS • The site is a 2.1 acre lot located in the Shamrock Industrial Park. The site is developed with a newly constructed 12,000 square foot building. Half of this building, currently houses Performance Films, Inc. and Bike Warehouse, Inc. It is the intent of the applicant to expand the warehouse by 2,400 square feet, while maintaining the distribution center, and offices for both Performance Films, and the Bike Warehouse as permitted under the RI, Restricted Industrial District zone. In addition, 1,800 square feet (up to 15 percent of the total square footage of the structure) is proposed is proposed for use as office space. Another 1,800 square feet (up to 15 percent of the total square footage of the structure) Dublin Planning and Zoning Commission Staff Report -February 6, 1997 Page 8 for the retail sale of bicycles and accessories. Development of the site is essentially complete with the exception of landscaping and finishing of the interior office space and showroom. • The site and all surrounding properties are zoned RI, Restricted Industrial District. To the north of the site across Shier Rings Road is Medex. To the east across Scherer Place is Washington Township Fire Department. To the west is Dolan Business Park. Southwest on Avery Road is Ohio Seed. To the south is Scherer's (Medio, LSP Technologies, Micro Auto Paint, Brigade Fire Protection). • The text submitted for the project maintains the full range of uses permitted under the RI, Restricted Industrial District. Use 204 "Canning and preserving fruits, vegetables and sea foods" is a permitted use in the RI District. Staff recommends excluding this use from the permitted uses in the PCD text. Under the requested Planned Commerce District zoning designation, only limited office and retail uses aze proposed. • The site is almost 300 feet squaze. Scherer Place is a cul-de-sac which runs along the eastern boundary of the site and serves established businesses to the south. The site has one driveway from Shier-Rings Road and a second from Scherer Place which provides access to the loading areas behind the building. A paved bikepath is developed along the south side of Shier-Rings Road which fronts the site. The existing right-of--way exceeds that of the Thoroughfaze Plan. • The site has 24 pazking spaces which meet the code requirements for the existing uses. Based upon the proposed uses, 9 additional pazking spaces (33 total) are required. This is based on the proposed 8,400 squaze feet of wazehouse use at one space per 1,000 squaze feet (8.4 spaces); 1,800 squaze feet of proposed retail use, at 1 space per 150 squaze feet (12 spaces); 1,800 square feet of proposed office use at one space per 250 squaze feet (7.2 spaces); and one space per employee on the lazgest shift (5 spaces). Two loading spaces are provided which exceeds code. No business vehicles are proposed to be kept on the site. The pazking lot is on the north and east sides of the building facing both streets. • The project site is identified in Subarea 7 "Avery Road Special Corridor" in the Southwest Area Plan. The plan states that development and redevelopment of sites within this corridor "will very likely accommodate a broad range of uses including residential, office, industrial, and commercial uses. It is not intended that the Avery Road Corridor become a continuous commercial strip." The requested rezoning is to allow limited office and limited retail use of the site in conjunction with the uses permitted within the Restricted Industrial zone consistent with the Southwest Area Plan. Further, Section 5.3.1 of the Mt. Auburn study states that Dublin should place its highest priority on the retention and expansion of existing employers. • According to the text, all landscaping must conform to the Dublin Landscape Code. The applicant submitted an approved landscape plan at the building permit stage of the building. The applicant has indicated that a revision to the original landscape plan is proposed to more accurately show the existing conditions such as the curb cut onto Shier- Rings Road and new landscaping plan. • A utility box is located on the site. Section 153.134® of the code states that all service structures in all zones shall be screened.
