AN ORDINANCE TO ACCEPT THE LOWESTIBEST
BID FOR THE CONSTRUCTION OF PHASE 1
OF mE COMMUNITY RECREATION CENTER,
APPROPRIATING FUNDS AND DECLARING AN EMERGENCY (AMENDED)
WHEREAS, after advertising, receiving and opening bids for the construction of Phase 1
of the Community Recreation Center on February 24, 1995; and
WHEREAS, it has been determined the 10west/best bid was from Tuttle Construction in the
amount of $9,630,000; and
WHEREAS, it is necessary to amend the annual appropriations ordinance to provide
sufficient funding for the project.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Dublin, State of
Ohio, '7 elected members concurring:
Section 1. That the bid from Tuttle Construction in the amount of $9,630,000 for the
construction of Phase 1 of the Community Recreation Center be, and hereby is, accepted.
Section 2, That the City Manager and the Director of Finance be, and hereby are, authorized
to enter into a contract with Tuttle Construction for construction of Phase 1 of the
Community Recreation Center pursuant to the bid specifications.
Section 3. That there be appropriated from the unappropriated balance in the Community
Recreation Center Construction Fund the amount of $10,111,500 to account 43-03-14-2530
for the construction of the facility,
Section 4. That this ordinance be, and the same hereby is, declared to be an emergency
measure for the preservation of public peace, health or welfare of the residents of this
City, and therefore this ordinance shall take effect and be in force immediately upon its
passage.

Re: Bid of Cleveland Construction, Inc.
on City of Dublin community Recreation Center
Dear Mr. Lenz:
Our firm is counsel to Cleveland Construction, Inc. and we
have been requested to contact your office relative to the bidding
for the above referenced contract. As you were advised by
representatives of Cleveland Construction on February 24, 1995,
Cleveland Construction, Inc. made a substantial arithmetic error in
the calculation and submission of their bid for this project.
Pursuant to Ohio Revised Code Section 9.31, the City of Dublin
is hereby formally given notice of Cleveland Construction, Inc. 's
claim of its right to withdraw its bid for this project.
As your bid tabulation will reveal, the bid of Cleveland
construction, Inc. was substantially lower than the second bidder.
In fact, the differential was $783,000. The arithmetic error which
was made was the failure of Cleveland construction, Inc. to include
the amount of its labor in its bid. This amount totaled $329,489.
This substantial arithmetic error was unintentional and is clearly
an omission of a substantial quantity of labor as contemplated by
Revised Code section 9.31. We would be happy to provide you with
a copy of Cleveland Construction, Inc. 's take-off, as well as any
other documentation you might require, to substantiate this
arithmetic error. RECEIVED
