AN ORDINANCE TO ACCEPT AN ANNEXATION OF
2.685+/- ACRES IN WASHINGTON TOWNSHIP,
FRANKLIN COUNTY TO THE CITY OF DUBLIN
(SCHNEIDER PROPERTY)
WHEREAS, said annexation has been approved by the Franklin
County Commissioners, and Council is of the opinion that said
territory should be annexed.
NOW, THEREFORE BE IT ORtAINED by the Council of the City of
Dublin, state of Ohio, of the elected members concurring:
section 1. That the petition for the annexation of 2.685+/-
acres (see attached legal description) to the City of DUblin,
Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in
force from and after the earliest period allowed by law.

Washington, in Virginia Military Survey No. 2542, and being a
portion of an 8 acre tract of land (6.318 acres by previous

record in Deed Book 2332, Page 298, Recorder's Office, Franklin

SUBJECT: Annexation Request: Ord. #05-95 ( 2.685 acre M. R. Schneider tract)
INITIATED BY: Terry D. Foegler, Asst. City Mgr.lDir. of Dev.
The subject property encompasses approximately 2.685 acres and is located on the west side
of Dublin Road approximately half way between Indian Run Drive and the 1-270 overpass.
The property is bounded by the City of Dublin on both the north and western boundaries and
is part of a much larger island of unincorporated Washington Township, located in this area
of Dublin Road. The request has been reviewed by the Franklin County Commissioners,
who have voted to approve the release of this parcel for annexation by the City of Dublin.
The City's Interim Annexation Policy provides that the City work to actively encourage the
incorporation of these "islands" of unincorporated area within the City. This policy is
endorsed in order to clarify and simplify the provision of municipal services by both the City
and the Township. The staff has reviewed this request and finds that the subject parcel is
fully serviceable by the City, is consistent with the City's Interim Annexation Policy, and
recommends that Council accept this annexation petition.

WHEREAS. the Ohio Revised Code in Section 709.031 stipulates that the County Commissioners
can ask the County Engineer for a report on the accuracy of the map or plat; now, therefore, upon the
motion of Commissioner Shoemaker , seconded by Commissioner Foulk ,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY,
OHIO:
Section 1. That a hearing upon said petition shall be held in the County Commissioners'
Hearing Room, 26th Floor of the Franklin County Courthouse at 10:00 A.M. on
November 2, 1994; and
Section 2. That the Zoning Director to the Board of County Commissioners be and
hereby is directed to notify the agent of the petitioners of the time and place of said
hearing; and
Section 3. That the map or plat of Marjory R. Schneider is hereby referred to the County

Enclosed is a copy of the resolution adopted on September 13, 1994, by the Board of County
Commissioners, setting the time and place of public hearing for the annexation petition which you, as
agent, filed with this office on September 1, 1994.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised Code, you, as agent, are
responsible for the following:
(I) Notification of the date of filing of your petition with the Board of County Commissioners
to be delivered to the Clerk of the municipality to which annexation is proposed and the
Clerk of each township which is included in the annexation. (A map, description and a
copy of the petition should be presented to each clerk).
(2) Publication of the substance of the petition once a week for four consecutive weeks in a
newspaper of general circulation in the County. (The enclosed resolution will satisfy the
statutory requirements and should be used for the published notice).
(3) Service upon the municipal and township clerks of a copy of the notice within seven (7)
days after the Franklin County Commissioners set the date for the public hearing on the
annexation petition, is on or before September 20, 1994. (The enclosed resolution will
satisfy the statutory requirements and should be used to serve the clerks).

(4) Preparation of an affidavit stating the name of the agent, the number of owners of real
estate at the time of the filing of the petition and the number of owners signing the
petition.
(5) Ensuring that the legislative body of the municipality to which the annexation is proposed,
by ordinance or resolution. adopts a statement indicating what services. if any. the
municipal corporation will provide to the territory proposed for annexation, upon
annexation. (The resolution or ordinance should include response times for fire, EMT and
police units as well as information concerning water and sewer hook-ups and other
pertinent data).
(6) The Agent or Representative of the petitioners needs to be present at the hearing to
present the petition to the Board of County Commissioners.
Proof of compliance with the above is required to be submitted to this office no later than October 19.

1. He is the attomey and agent for petitioners in the annexation of 2.685 acres, more or
less, from Washington Township to the City of Dublin, Ohio, Marjorie R. Schneider,
petitioner; Annexation 36-94, Franklin County, Ohio. His address is below.
2. There was one property owner within the territory sought to be annexed at the time of
the filing of the petition for annexation.
3. The one owner signed the annexation petition.
4. Notice of the filing of the annexation petition along with the legal description and the
map was served upon the clerks of Washington Township and of the City of Dublin on the
2nd day of September, 1994. Copies of the notice which includes a receipt from each clerk
have been previously filed herein and are contained in the file.
5. A copy of Resolution #36-94 of the Franklin County Commissioners was served on the
Clerk of Washington Township on September 15, 1994 and on the Clerk of the City of
Dublin, Ohio on September 15, 1994. Receipts from both clerks have been filed herein
and are contained in the file.
6. Publication as required by the statute is being made by the Daily Reporter and separate

I BY SECTION 709.031 OF THE OHIO REVISED CODED
Ii DECLARING AN EMERGENCY.
II WHEREAS, a petition for the annexation of 2.685+/- acres from
I Washington Township was duly filed by Christopher T. Cline, 37
W. Bridge street, DUblin, Ohio, agent for petitioner Marjory
R. Schneider; and
WHEREAS, a public hearing has been scheduled by the Franklin
County Commissioners at 10:00 a.m. on Wednesday, November 2,
1994; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires
that, prior to said hearing, the Municipal Authority shall
adopt a statement indicating what services, if any, the
Municipal Corporation will provide to the territory proposed
for annexation; and
WHEREAS, Dublin City Council adopted an interim annexation
policy on June 20, 1994 to provide policy directive regarding
proposed annexations to the City of Dublin.
NOW, THEREFORE, BE IT RESOLVED by Council of the city of
Dublin, State of Ohio, ~ of the elected members
concurring:
Section 1. The city of Dublin will provide the following
municipal services for 2.685+/- acres in Washington Township,
Franklin County if-the subject property is annexed to the City
of DUblin, Ohio:
,,'~) Police. The city provides Police and communications
i~ service on a full twenty-four hour basis and also has
, ' mutual aid agreements with other municipalities. The
"~ annexation area lies approximately two miles northeast of
Dublin's Police Division Headquarters. Dublin operates
with a minimum of three cruisers on duty. A response
time of approximately three minutes for an emergency
situation should be expected for this area.
Fire. Fire protection is currently provided by well-
.- staffed departments in Washington and Perry Townships.
They, too, have mutual aid agreements with other
municipalities. This annexation would not change fire
department jurisdictional boundaries, and therefore
~ response times for fire and emergency medical services
will not be affected. The Washington Township Fire
station is approximately two miles northwest of the
annexation area and normal response times should be
approximately three minutes.
Sanitation. Residential refuse-collection services are
contracted by the City and are currently provided at no
additional charge.
street Maintenance. The City has a street Maintenance
Department which provides excellent services in the area
of street and road maintenance. This department also
provides curbside leaf piCk-Up at no additional charge.

section 2. The City has SEWER and WATER service area
contracts with the City of Columbus and the subject property
is within said service areas. Conditioned on the ability of
the City of Columbus to provide WATER and to provide
sufficient SEWERAGE disposal capacity, the City will have the
abili ty to service the area. Water and sewer lines are
accessible to the subject property.
Section 3. The proposed annexation appears to be consistent
with the City's recently adopted annexation policy.
Section 4. This resolution is declared to be an emergency
measure necessary for the immediate preservation of the public
peace, health, safety or welfare of the City, and for the
further reason that action must be taken prior to the public
hearing scheduled by the Franklin County Commissioners on
November 2, 1994, and therefore this resolution shall be
effective upon passage.

THE CITY OF DUBLIN, OHIO

WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded on the 2nd day of
November. 1994 to hear the petition of MaIjory R. Schneider, filed September 1, 1994, and having in
open hearing heard all of persons desiring to be heard for or against the granting of the petition. and
having considered all the facts with reference thereto. being fully advised. and
WHEREAS, the Commissioners make the following findings. based upon the exhibits and
testimony presented at the hearing of this matter:
1. The Petition contains all of the matters required by Ohio Revised Code
Section 709.02 including, without limitation: A. A full description and
accurate map or plat of the territory to be annexed; B. A statement of the
total number of owners of real estate in the territory to be annexed; C.
The name of the person to act as agent for the petitioner.
2. The territory sought to be annexed is adjacent and contiguous to the City
of Dublin. Ohio.
3. Notice of the petition and the hearing has been published as required by
law. and all notices of filing the petiton and the hearings thereon have
been given and delivered as required by law.
4. The persons whose names are subscribed on the petition are owners of
real estate in the territory sought to be annexed, and as of the time the
petition was filed, the number of valid signatures on the petition
constituted a majority of the owners of real estate in the territory
proposed to be annexed.
5. The map or plat and the description of the territory contained in the
petition are accurate.
6. The City of Dublin has complied with Division (B) of Ohio Revised
Code Section 709.031.
7. The territory sought to be annexed is not unreasonably large.
8. The general good of the territory sought to be annexed will be served if I
the annexation petition is granted and the annexation is allowed.
Therefore, upon the motion of Commissioner Shoemaker . seconded by Commissioner
Foulk
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY,
OHIO:
Section 1. That the prayer of the Petition be GRANTED, and the territory sought to be
annexed by the petition filed herein be annexed to the City of Dublin, Ohio, in accordance
with the law; that the orders and proceedings of this board relating to the Petition, and
map and description attached thereto, and all papers on file relating to this matter be
delivered forthwith to the Clerk of Council, City of Dublin, Ohio.
