AN ORDINANCE TO ACCEPT A CONTRACT
WITH THE CITY OF COLUMBUS TO SHARE
THE COST OF INSTALLATION AND MAIN-
TENANCE OF TWO TRAFFIC SIGNALS ON
SAWMILL ROAD AT FEDERATED BOULEVARD
AND AT SAWMILL PLACE.
WHEREAS, the City of Columbus intends to widen Sawmill Road south of
1-270 to State Route 161; and,
WHEREAS, the west side of the intersections of Sawmill Road at Federated
Boulevard and at Sawmill Place is in the Village of Dublin; and,
WHEREAS, the Village of Dublin has received a proposal from the City of
Columbus to pay 50% of the cost to install and maintain traffic signals
at these two intersections;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin,
State of Ohio, f. of the elected members concurring:
Section 1. That the Acting Village Manager and Finance Director be
and hereby are authorized to enter into the contract with the City of
Columbus attached hereto as Exhibit A.
Section 2. That this Ordinance shall take effect and be in force
immediately upon its passage.

TRAFFI~ CONTROL DEVICES CONTRACT
This Contract, CT--~~ , is entered into
this day of ~J:'P . , 19 , by and be-
tween the Village of Dublin, Ohio, County of Franklin, herein
called "Owner" and the City of Columbus, Ohio, Division of Traf-
fic Engineering and Parking, herein called "C it y ."
WITNESSETH
That whereas Owner is the owner/agent of the property
located on the west side at Sawm i 11 Road at Federated Boulevard
and at Sawmill Place; and,
Whereas, the City agrees to provide traffic control ser-
vices to Owner to facilitate ingress and egress to said property
by designing, installing and maintaining warranted traffic con-
trol devices (including but not limited to traffic signs, signals
and pavement markings) for the purpose of regulating, warning or
guiding traffic in accordance with the Traffic Code of the City
of Columbus, the Ohio Manual of Uniform Traffic Control Devices,
and under the terms of this Contract:
Now, therefore, in consideration of the mutual agree- ()
ments herein contained. the parties hereto mutually agree as ~
follow:

Installation ~

1) The City agrees to place orders for th~ procurement of or to '-..,.,

furnish from existing stock the additional traffic signal .~
materials and agrees to install said signal materials. Owner 71
agrees to pay the City 50% of the expense involved in pro-
curing and installing these additional signal materials used
i in the completion of the signal work.
2) Owner agrees to pay 50% of the total cost to the City to
purchase and/or install appropriate traffic control pavement
marking materials on the public street approaches to said
property.
3) Owner agrees to pay 50% of the total cost to the City to
install appropriate traffic control signs on the public
street approaches to said property.
Maintenance
4) Owner agrees to pay 50% of the expense involved in a yearly
signal lamp replacement and lens cleaning.
5) Owner agrees to pay 50% of the electricity to operate the
traffic signal installation.
6) The City agrees to perform normal maintenance and repair of
the traffic signal and components for its continued opera-
tion until such time as the signal is no longer warranted,
at which time the signal will be removed.
7) Owner agrees to pay 50% of the total cost of purchasing and
installing new signal materials when the existing materials
become obsolete or unserviceable due to normal wear, con-
struction activities, vandalism, accidents or any other
condition as would be determined at the sole discretion of
the City. This may include, but not be limited to control-
ler, cabinet, poles, vehicular or pedestrian signal heads,
cable, signal coordination devices, and all intersection
detectors.

8) Owner agrees to ,pay 50% of the total cost to the City to
maintain traffic control pavement markings on the public
street approaches to said property. Maintenance shall con-
sist of replacing pavement markings ren~ered unserviceable
due to normal wear, construction actvities, vandalism,
accidents or any other condition, as would be determined at
the sole discretion of the City. Pavement markings, if
installed now or at any time, that are to be maintained by
the City are defined as stop lines, crosswalk lines, turn
arrows, words, channelizing lines, and channelizing islands.
9) Owner agrees to pay 50% of the total cost to the City to
maintain traffic control signs on the public street ap-
proaches to said property. Maintenance shall consist of
replacing signs rendered unserviceable due to normal wear,
construction activities, vandalism, accidents or any other
condition, as would be determined at the sole discretion of
the City.
Changes in Operation
10) Owner agrees to pay 50% of the total cost to the City for
making changes in the signal installation as would be deter-
mined at the sole discretion of the City to be in the best
interest of proper signal operation and public safety, and
for revisions that may be required to conform to any new
laws and/or standards of the State of Ohio or the City of
Columbus or the Village of Dublin.
11) Owner agrees to pay 50% of the total cost to the City to
revise the pavement markings on the public street approaches
to said intersection as would be required to conform to any
new laws and/or standards of the State of Ohio or the City
of'Columbus or the Village of Dublin.
12) Owner agrees to pay 50% of the total cost to the City to
revise the traffic control signs on the public street ap-
proaches to said intersection as would be required to con-
form to any new laws and/or standards of the State of Ohio
or the City of Columbus of the Village of Dublin.
General Information
13) The City agrees to submit itemized bills for materials,
labor, and equipment in regard to the previous paragraphs
and Owner agrees to make payment when these bills are due.
14) All traffic control device materials shall become the prop-
erty of the City. In the event the control devices are
removed because they are no longer warranted or this Con-
tract is terminated, credit for 50% of salvage or trade-in
value, if any, will be credited to the Owner towards mater-
ials if traffic control devices would again be approved at
some time following removal. Owner agrees to pay 50% of
removal costs.
15) Termination of this Contract may occur by:
1 ) either party giving to the second party
not less than thirty (30) days nor more
than ninety (90) days written notice, or
2) failure by the Owner to comply with the
terms herein contained in this Contract.

This Contract shall be binding upon and inure to the
benefit of the parties hereto, their respective successors and/or
assigns.
In witness, whereof, the parties have 'hereunto set their
hands to this Contract as the respective duly authorized agents
as of the day and year first stated above.
