WHEREAS, Sand F Development Company is requesting a variance from the provisions of Section 1185.06(d)(1)(Lot requirements) to permit the construction of a 5600 square foot retail furniture store on a half-acre tract located on the west side of Sawmill Road approximately 125 feet south of Federated Boulevard; and WHEREAS, Section 1185.06(d)(1)(Lot requirements) prohibits reducing the distance between a side property line and pavement from 15 feet to 10 feet; and WHEREAS, the Dublin Planning and Zoning Commission and Board of Zoning Appeals denied in a similar case a request for a 5,000 square foot furniture showroom during 1985; and WHERESAS, the Court of Appeals of Ohio Tenth Appellate District rendered a decision which overturned this denial on September 25, 1986; and WHEREAS, the Court remanded the case to the Village of Dublin for further proceedings consistent with its decision; and WHEREAS, this development request, in order to be made at least minimally functional and safe, will require a variance to some provision of the Dublin Zoning Code; and WHEREAS, the property is zoned CC, Community Commercial and is appropriately zoned for a retail furniture store; and WHEREAS, the Village of Dublin wishes to comply expeditiously with the mandate of the Appellate Court; and WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and WHEREAS, the granting of said variance will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed development, be materially detrimental to the public welfare, or injurious to private property or public improvements in the vicinity; and WHEREAS, the granting of said variance will alleviate the difficulty encountered by Sand F Development Company in using said property as desired; NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, 7 of the elected members concurring that: Section 1. That a variance from the provisions of Section 1185.06(d)(1) (Lot requirements) of the Dublin Zoning Code is hereby granted to Sand F Development Company for the property otherwise known as Reserve "A" of Meadowland Heights No. 1, located on the west side of Sawmill Road approximately 125 feet south of Federated Boulevard, insofar as said section prohibits the reduction in the distance between a side property line and pavement from 15 feet to 10 feet in conjunction with the construction of a 5,600 square foot retail furniture store. That this ordinance is conditioned upon and shall remain in effect only for so long as said property is used for the establishment of a furniture store which shall not exceed 5,600 square feet in area and shall be developed in compliance with the site plan on file in the Village offices, prepared by Wright-Kritschgan and Associates, Inc. , and bearing the revision date of 12-30-86. Section 3. That the variance granted by this ordinance shall become void one (1) year after this ordinance becomes effective by law unless prior thereto an affirmative act of the applicant has commenced which makes use of said Council Variance. Section 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law. MEMORANDUM TO: Members of Council FROM: Planning Department SUBJECT: Waterbeds and Stuff Lawsuit and Resolution DATE: January 14, 1987 Dublin's Planning and Zoning Commission and Board of Zoning Appeals acted to deny a Certificate of Zoning Compliance as part of a Corridor Development District Review during 1985 for Sand F Development Company. The site plan showed a one-story, 5,000 square foot building to be used for the sale of furni- ture (waterbeds) and other merchandise (stuff). The 1985 site plan was and is, in the opinion of staff, totally unworkable and a true example of bad development for a lot of reasons. Upon denial, Sand F filed suit against the Vi llage of Dublin; we won. S and F appealed the decision; we lost. The Court of Appeals of Ohio Tenth Appellate District overturned the Village's denial and remanded the cause to Dublin "for further proceedings consistent with this decision". The staff has attempted to elicit the best possible site plan without risking a contempt citation. The site plan before you was in fact designed by the joint efforts of Columbus Traffic Engineering Division and our staff . It is the only plan produced to date which can realistically get a furniture delivery truck onto and off of the site without interfering with the traffic movement on Sawmill Road. The site is still overdeveloped in the opinion of staff, and there is still too little parking for the size of the store. However, these reasons were ruled by the Court as inadequate or inappropriate for denial. Given that, and the fact that it is far more workable than the 1985 plan, staff recommends approval of the reduction in the side yard development standard which will permit a one-way drive totally around the building. In short, a truck can now get in and get out without incident, and that is a major improvement.
