A RESOLUTION ACCEPTING THE LOWEST AND BEST BID
FOR THE BRAND ROAD SHARED -USE PATH PROJECT
WHEREAS, formal advertising and competitive bidding procedures have been
conducted, pursuant to Section 8.04 of the Revised Charter and Chapter 37 of
the Dublin Code for the Brand Road Shared -Use Path project; and
WHEREAS, Council has determined that the bid submitted by Ohio Paving &
Construction Co., Inc. constitutes the lowest and best bid; and
WHEREAS, Council has determined that there may be a legitimate need to
declare the relocation of the utilities in connection with the above - referenced
project as a "single source" procurement, for reason that the company owning
the utilities in question has the exclusive rights to relocate such utilities.
NZ, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin,
�_ of its elected members concurring, that:
Section 1. The bid submitted by Ohio Paving & Construction Co., Inc. in the
total amount of $727,761.20 is hereby accepted.
Section 2 . The City Manager is hereby authorized to enter into contracts
with Ohio Paving & Construction Co., Inc. for performance and completion of
the Brand Road Shared -Use Path project, pursuant to the Advertisement,
Proposal and Contract Documents for said project on file in the office of the
City Engineer.
Section 3. This Resolution shall take effect and be in force upon passage
in accordance with Section 4.04(a) of the Revised Charter.

Re: Resolution No. 49 -13 - Brand Road Shared -Use Path — Bid Acceptance
Summary
On August 29, 2013, one (1) bid was received, publicly opened and read for the Brand Road
Shared -Use Path project, which involves the construction of approximately 3,600 feet of an 8 -foot
wide asphalt shared -use path from east of Muirfield Drive (in front of Washington Township Fire
Station No. 93) to the Earlington Parkway /Brandonway Drive intersection. The path will be located
along the south side of Brand Road and will include a pre- fabricated steel bridge, concrete
abutments, storm sewers, grading and turf restoration. Additionally, this project will include the
construction of an 8 -foot wide shared -use path on the west side of Muirfield Drive, from the Brand
Road roundabout to Moors Place, which will also include a pre- fabricated steel bridge over the
North Fork Indian Run (west of Muirfield Drive).
The Engineer's estimate for this project is $700,000.00. The funds for the construction of this
project are from the Capital Improvements Tax Fund. Ohio Paving & Construction Co., Inc.
submitted the lowest and best bid of $727,761.20. Staff has reviewed the bid as listed below.
For Council's reference and review, a reduced set of project construction drawings has been placed
in the Council Planning Room.
Staff has compared the Engineer's estimate to the one bid received. The likely factor impacting
the bid, resulting in only one submitted bid, is the performance of the project in the fall
construction season, a time when many contractors and subcontractors have already committed to
other projects. The unit prices bid are somewhat higher than estimated, which staff believes
reflects a "premium" for performing this project within the fall and within a compressed time
frame. Staff believes the bid is a fair and acceptable cost to construct this path.
Over the past several months, staff has met with property owners adjacent to the path to secure
necessary easements where the path is not located within existing right -of -way. A few remaining
easements are being finalized and will be secured prior to path construction.

Staff anticipates the construction to commence by the end of September. The scheduled
completion date for the project is November 15, 2013, except for the pre- fabricated bridges, which
will likely be complete by January 2014. Brand Road will remain open to traffic for the duration of
the construction, although some limited temporary lane restrictions may be necessary for certain
work components.
Recommendation
Staff has thoroughly reviewed the Ohio Paving & Construction Co., Inc. bid. Although this
contractor has not previously worked for the City of Dublin, they did provide references for similar
projects they have constructed. Staff has contacted representatives of these projects and received
favorable references.
Staff recommends Council approval of Resolution 49 -13, accepting as lowest and best the bid of
Ohio Paving & Construction Co., Inc. in the amount of $727,761.20 and authorizing the City
Manager to enter into a contract with Ohio Paving & Construction Co., Inc. for this project.
