AN ORDINANCE PROVIDING FOR AN ELECTION ON AMENDMENT TO SECTIONS 3.02, 3.03 and 7.01 OF THE DUBLIN CITY CHARTER~ AND DECLARING AN EMERGENCY WHEREAS, the Washington Township/City of Dublin Merger Commission is in the final stages of approving and adopting the Conditions of Merger for submission to the respective Boards' of Election for placement on the November ballot; and, WHEREAS ~ Council supports the terms and provisions contained within the Conditions of Merger; and, WHEREAS~ if approved by the voters in the November 7, 1989 election the Conditions of Merger will require amendment to Section 3.02, Section 3.03 and Section 7.01 of the Charter by adoption of new Section 3.02(a-1), Section 3.03(a-1) and Section 7.01(a-1) of the Charter; and, WHEREAS~ the Charter amendment set forth herein shall become effective only if the Conditions of Merger are approved by a majority of the voters voting thereon in both the unincorporated territory of Washington Township and the City of Dublin, at the November 7, 1989 election; and the amendment to the Dublin City Charter is approved by a majority of the voters voting thereon in the City of Dublin at the November 7, 1989 election. NOW, THEREFORE~ BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ---L- of the elected members concurring that: Section 1. The question of the amendment of Section 3.02, 3.03 and 7.01 of the Dublin City Charter be submitted to a vote of the qualified electors. If the merger is approved by the voters in both Washington Township and the City of Dublin, and the Charter Amendment is approved by the voters of the City of Dublin, the Dublin Charter will be amended effective January 1, 1991 by adopting new Sections 3.02(a-1), 3.03(a-1) and 7.01(a-1) to read as follows: 3.02(a-l) Pursuant to the Conditions of Merger passed November 7, 1989, the Council shall be composed of eight (8) members effective January 1, 1991 for a three (3) year period. The eighth member of Council shall be selected by a majority vote of the seven- member Council to serve a three-year term through December 31, 1993. Upon the expiration of the term of the eighth member, the composition of Council shall be returned to seven members. 3.03(a-l) Pursuant to the Conditions of Merger passed November 7, 1989 the July, 1991 re-division of the Municipality into wards shall be postponed so as to occur no later than the first day of July, 1993. 7.01(a-l) Pursuant to the Conditions of Merger all present non-electiv~ Washington Township personnel, serving in full-time and part-time permanent positions, shall become employees of the City of Dublin upon the effective date of the Merger, subject to all applicable provisions of this Charter and Ordinances, Resolutions, rules or regulations enacted or promulgated under this Charter, except that any such former Washington Township employees shall not be subject to a pre-employment competitive selection process or initial probationary period, and shall be entitled to either the same benefits in existence for other City employees, or benefits equivalent to their former Township benefits, which- ever is greater. The ballots for the election shall be entitled: "DUBLIN CITY MERGER-MANDATED CHARTER AMENDMENT", and the proposed amendment of Section 3.02, 3.03 and 7.01 of the Dublin Charter, be adopted, contingent on the approval of the Conditions of Merger by the voters of Washington Township and the City of Dublin. Section 3. The Clerk of Council is directed to mail a copy of the proposed Charter Amendment to each elector whose name appears on the registration books of the last regular election held in the City, at least thirty (30) days before the date of the election, and to certify a copy of this Ordinance to the Boards of Election of Franklin, Union and Delaware Counties. Section 4. The Clerk of Council is directed to publish the whole text of the proposed Charter Amendment, as set forth above, once a week for not less than two consecutive weeks in a newspaper published and of general circulation in the City, with the first publication being at least fifteen (15) days prior to the election, in accordance with Section 9 of Article XVIII, Ohio Constitution, and RC 731.211. Section 5. To pay the cost of printing and mailing copies of the proposed Charter Amendment and of publishing notice there is hereby appropriated by the General Fund the sum of $15,000.00, or so much thereof as may be needed. Section 6. This Ordinance is declared to be an emergency for the immediate preservation for the public health, safety and welfare based upon the Board of Election filing requirements mandated by the Ohio Constitution and the Ohio Revised Code, in order to place this Charter Amendment on the November 7, 1989 ballot.
