AN ORDINANCE PROVIDING FOR A CHANGE
OF ZONING ON A 10.85 ACRE TRACT
LOCATED WEST OF AVERY ROAD AND EAST
OF TULLYMORE DRIVE APPROXIMATELY
2,200 FEET NORTH OF POST ROAD
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, 5 of the elected members concurring:
Section 1. That the following described real estate (see attached legal
description marked Exhibit "A"), situated in the City of Dublin, State
of Ohio, is hereby rezoned to to P.U.D., PLANNED UNIT DEVELOPMENT DISTRICT,
and shall be subject to regulations and procedures contained in Ordinance
No. 21-70 (Chapter Eleven of the Codified Ordinances), the City of Dublin
Zoning Code and amendments thereto.
Section 2. That application, Exhibit "B", including the list of contiguous
property owners, and the recommendation of the Planning and Zoning Com-
mission, Exhibit "C", are all incorporated in to and made an official part
of this Ordinance and said real estate shall be developed and used in
accordance therewith.
Section 3. That this Ordinance shall take effect and be in force from
and after the earliest period allowed by law.

not less than 8~ x 11 inches and not more than 16 x 20 inches). The map shall be

to the city of Dublin Zoning
District Map
The applicant proposes to amend the Preliminary Development
Plan for Lowell Trace by (i) adding to said plan the Fillman
Tract, which consists of approximately ten acres of land located
north of the Lowell Trace subdivision, east of Tullymore Drive
and west of Avery Road. and (ii) dedicating to the City of
Dublin as open space a portion of the property already included
within the PUD for Lowell Trace. The rezoning of the Fillman
Tract will add 22 lots to the PUD for Lowell Trace. The portion
of the existing PUD for Lowell Trace to be amended consists of
approximately ten acres located west of Tullymore Drive and
north of the Lowell Trace sUbdivision. The change t.o said ten
acre tract consists of the parkland to be dedicated to the City
of Dublin as open space; no new lots will be added. No other
portions of the Lowell Trace PUD are affected.
I. SECTION 1181.07 q(2) (A) PLAN CONTENTS
A. North point in scale
Please see Preliminary Development Plan
B. The proposed location and size of areas of residential
use includinq dwellinq unit densities, dwellinq unit
types, the total number of dwellinq units within the
density area, the total number of dwellinq units
proposed in the development plan.
Residential uses and types with dwelling unit densities
as shown on the Preliminary Development Plan.
Additional single family development standards have
also been included with this text. The existing Lowell
Trace deed restrictions (copy attached) shall apply.
C. The proposed size, location and use of non-residential
portions of the tract, includinq usable open space
areas, parks, playgrounds, school sites, and other
public areas and open spaces with the suqqested
ownership of such areas.
The non-residential portions (i.e., parkland) are shown
on the Preliminary Development Plan. The park will be
dedicated to the City of Dublin.

Exceprt from minutes of Planning and Zoning Commission meeting of May 4, 1989.
Mr. Berlin made a motion for approval of the rezoning application with the
following conditions:
1. Dedication of right-of-way along Avery Roda (30 feet from centerline) con-
sistent with the Community Plan.
2. Reconciliation of acreage on plan and in text with regard to park.
3. Dedication of easement between two lots at the end of the cul-de-sac to
connect with Avery Road bikepath, and construction of a bikepath
within that easement.
4. Work out storm water retention with City Engineer to be provided either
on site or with the resizing of the existing Lowell Tract basin.
5. Regrading of the drainage ditch along the Avery Road frontage, including
the installation of tile to eliminate the steepness of the ditch and provide
proper drainage.
6. Removal of the fence requirement on both the south and nort:h boundaries of
this site, and the evergreens to remain.
Mr. Geese seconded the motion, and the vote was as follows: Mr. Leffler, yes;
Mr. Berlin, yes; Ms. Rausch, yes; Mr. Campbell, yes; Mr. Geese, yes; Mr. Grace,

Beginning at a point in the centerline of Avery Road
marking the southeasterly corner of said tract and also being a
northeasterly corner of "LOI~ELL TRACE", of record in Plat Book
67, Page 93;
thence South 700 23' 39:1 West, along a northerly line of
"LOWELL TRACE", a distance of 989.93 feet to the southwesterly
corner of said 10.193 acre tract;
thence North 180 47' 26" West, along a westerly line of
said tract and also along the dedicated easterly right-of-way
line of Tullymore Drive, a distance of 401.09 feet to a point
marking the northwesterly corner of said 10.193 acre tract;
