Form No. 2806-A Ordinance NO'mm}g.~,~8~?~J~ended) p assed____mn~nmmnm~~__~mm...mmm~~19 om~ ~o AN ORDINANCE AMENDING SECTION 1183.04 OF THE DUBLIN PLANNING AND ZONING CODE REQUIRING THE CONTAINMENT AND REGULAR DISPOSAL OF DEBRIS FROM CONSTRUCTION SITES, AND DECLARING AN EMERGENCY WHEREAS, there is a recognized need to reduce the amount of wind and water borne litter within the community; and, WHEREAS ~ the containment and regular disposal of debris at construction sites will reduce the cost to taxpayers, homeowners, and property managers for litter collection; and, WHEREAS ~ the containment and regular disposal of debris will protect the health, safety and/or welfare of those within the Municipality, as well as, improve the appearance of the environment; NOW~ THEREFORE~ BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 6 of the elected members concurring: ----r-- Section 1. That Section 1183.94(c)(1) be, and the same hereby is, amended so that as amended the same shall read as follows: (c) Condition of Premises; Waste Accumulation. No person, firm, or other property owners or residents sha 11 : (1) Cause or permit waste, garbage, trash or any debris such as lumber and building materials, unused tires or other material to accumulate or remain on their property except as follows: A. Trash and garbage properly located for normal and regular pickup, provided that no such items shall be permitted to remain exposed to open view beyond normal pickup times. B. All trash and debris associated with or resulting from the construction of either residential or commercial structures permitted hereby shall be contained on the construction site in a stable and secure enclosure no smaller than ten (10) cubic yards. The permit holder shall maintain the enclosure and site so as to control litter and debris at all times, and remove and dispose of the debris in an approved landfill. The enclosure shall be removed from the site within 10 days of issuance of the occupancy permit or within 10 days of cessation of active construction work. Section 2. That Section 1183.04(d) be, and the same hereby is, amended so that as amended the same sha 11 read as follows: ( d) Corrective Action by Municipal Officials. (1) All violat ions of this Section which remain uncorrected after not less than ten days notice to the owner or resident, may be corrected by the Municipality, or by any person, firm or organization selected by the Municipality, and the costs thereof shall be paid by the owner of such property within thirty days. (2) Any such charges which remain unapid for the thirty days may be collected in any manner provided by law and shall be certified by the Administration to the Auditor of each county wherein such property may be located to be charged as a lien against the property. Page Two (3) Violations occurring on construction sites may result in the issuance of a stop-work order until the site is brought into compliance. Section 34. That all permit holders of building permits issued after the effective date of this Ordinance must comply with provisions found herein at the onset of construction. All other construction sites must be brought into compliance with the provisions of this Ordinance within 30 days of the date the Ordinance was passed by Council. Section 4. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and welfare, the reason for such emergency being the necessity to provide for adequate trash containment so as to minimize adverse impacts upon the Dublin environment; and provided it receives the affirmative vote of two-thirds of the members of Council, it shall take effect immediately after passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.
