AN ORDINANCE VACATING A 16 FEET
WIDE ALLEY KNOWN AS FOURTH ALLEY
AND ACCEPTING THE DEDICATION OF
A .084 ACRE TRACT OF LAND
WHEREAS, Grafrier Investment Company, an Ohio general partnership, is
developing property located in Old Dublin; and,
WHEREAS, pursuant thereto, said developer has received approval for a
variance from the Dublin Board of Zoning Appeals and has had its project
approved by the Dublin Architectural Review Board; and,
WHEREAS, as part of these approvals, the developer has agreed that in
exchange for vacation of a 16 feet wide alley known as Fourth Alley,
it will dedicate to the City a .084 acre tract of land; and,
WHEREAS, Council further finds that there is good cause for such vacation
of Fourth Alley and that such vacation will not be detrimental to the
general interests of the City of Dublin; and,
WHEREAS, Council further finds that dedication of the .084 acre tract of
land by the developer to the City in exchange for the vacation is also
in the best interest of the City of Dublin.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, ~of the elected members concurring:
Section 1. That the 16 feet wide alley known as Fourth Alley as more fully
described in Exhibit A attached hereto, and the same is hereby vacated on
the condition that the abutting property owner shall convey to the City
of Dublin, easements for the maintenance and operation of various public
utilities, publicly owned or otherwise, and that Grafrier Investment
Company, an Ohio general partnership shall convey a .084 acre tract of
land more fully described in Exhibit B attached hereto and incorporated
herein.
Section 2. That the City Engineer is hereby instructed to prepare a
vacation plat of the vacated street and cause said plat to be recorded
at the office of the Franklin County Recorder.
Section 3. That the Clerk of Council is directed to notify the auditor
of Franklin County of the vacation, by forwarding a copy of this Ordinance
thereto.
Section 4. That this Ordinance shall take effect and be in force from and
after the earliest period allowed by law.

Please attach the enclosed legal description and survey to
the Petition for Municipality to Vacate Alley (Fourth Alley). As
is stated in the Petition, once the improvements are completed, a
right of easement \'1 i 11 be granted to the city of Dublin for
public usage.
The first reading of this Petition is on the Council agenda
for August 21, 1990. If this incorrect, please give me a call,

PETITION FOR MUNICIPALITY TO VACATE ALLEY
To the Council of the City of Dublin, State of Ohio:
The undersigned, owner of Lot Number 134, Village of Dublin
and Lot 1'lumbe r 2, Wrights Subdivision in the city of Dublin,
contiguous to Fourth Alley, respectfully petition your honorable
body that Fourth Alley may be vacated between its intersection of
South High Street and its intersection with the Alley which runs
north and south parallel between Franklin Street to the west and
South Pigh Street to the east, for the creation of a cobblestone
alley, \'lhose location will be slightly north of the present
Fourth Alley, which after completion a right of easement will be
granted to the city of Dublin for public usage.

Being a part of Lot No. 134 in the City of Dublin of record in Plat
Book 3, page 199, as conveyed to GRAFRIAR INVESTMENT COMPANY by deed of
record in Official Record 14020, page C-7, C-lO, and also p~rt of FourUl
Alley (16' R/W) of record in said City of Dublin plat, all references to
the Recorder's Office, Franklin County, Ohio, and being m?re particularly
described as follows:
Beginning at an iron pipe (3/4" 1.D. ) found in the southeast conIC!:'
of said Lot No. 134, in said City of Dublin, said pipe being in the
westerly line of High Street (66 R/W);
thence, South 8018 '44" East along the westerly line of said Ilir,h
