Form No. 30043 Ordinance No.. 74-90 Passedn m .m" mm.19n ------------- AN ORDINANCE AMENDING THE ANNUAL APPROPRIATIONS, WAIVING FORMAL BIDDING AND ADVERTISING REQUIRE- MENTS, FOR IMPROVEMENTS RELATED TO THE EXPANSION OF THE SANITARY SEWER LIFT STATION, AND DECLARING AN EMERGENCY WHEREAS, the present sanitary sewerage system within the City of Dublin is currently being expanded in order to meet increased demands during times of peak flows; WHEREAS, Dublin City Council originally appropriated $1,500,000 to the Lift Station Improvements Bond Fund to pay the costs of these improvements; and WHEREAS, the Ohio Environmental Protection Agency continues to have in effect a Sewer Connection Ban affecting most of the City of Dublin and has required the City to make these improvements; and WHEREAS, a special bond fund (the "Lift Station Improvement Bond Fund") was created to pay the cost of acquiring easements, designing and con- structing the lift station improvements and the 24" force main. NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~of the elected members concurring: Section 1. That there is hereby advanced from the General Fund to the "Lift Station Improvement Bond Fund" an additional appropriation of $300,000.00 to pay the related costs associated with these permanent improvements, including easement acquisition, additional force main instal- lation, telemetry, odor control equipment, and to install certain over- flow-related modifications to the lift station. This additional advance is to be reimbursed to the City's General Fund from the proceeds of the bonds, or notes in anticipation of those bonds, to be issued to finance the costs of such permanent improvements. Section 2. There is hereby appropriated from the "Lift Station Improvement Bond Fund" an additional $300,000.00 to acquire easements, additional force main installation, telemetry, odor control equipment, and to install certain overflow-related modifications to the lift station. Section 3. That this Ordinance be, and hereby is, declared to be an emergency measure due to the need to continue this expansion without inter- ruption. This expansion will directly affect the City's ability to main- tain the health and welfare of this Community be reducing the possibility of sewerage overloads during periods of peak demands and flows, and additionally has been ordered by the Ohio Environmental Protection Agency. Therefore, formal bidding and advertising requirements are hereby waived pursuant to Section 735.05.01 of the Ohio Revised Code, and this Ordinance shall take effect and be in force immediately upon its passage.
