AN ORDINANCE PETITIONING THE BOARD I
I
OF COUNTY COMMISSIONERS OF DELAWARE i
COUNTY, OHIO FOR A CHANGE OF TOWN-
SHIP LINES TO THE AREA INCLUDED
WITHIN THE CORPORATE LIMITS OF THE
CITY OF DUBLIN FROM CONCORD TOWNSHIP,
AND DECLARING AN EMERGENCY
WHEREAS, in July, 1987, the City of Dublin enlisted the cooperation of
Concord, Perry and Washington Townships to identify methods of
standardizing fire protection and emergency medical services within
Dublin's municipal boundaries when Dublin became a city; and
WHEREAS, the Dublin City Council accepts and incorporates the recommenda-
tions of the Public Safety Committee of the Dublin City Council on this
issue; and
WHEREAS, the Public Safety Committee of Dublin City Council has recommended
that the portions of Concord, Jerome, Perry and Washington townships within
the boundaries of the City of Dublin be brought into a single township
for the purposes of creating uniform fire protection and emergency medical
services within Dublin over a three year period, and that at the end of thi
phase in period, Dublin will create a Dublin township and a Dublin Fire
Department; and
WHEREAS, Section 503.07 of the Ohio Revised Code authorizes the Dublin City
Council to petition the county commissioners to change the township
boundaries within the municipal corporation; and
WHEREAS, Section 503.15 of the Ohio Revised Code anticipates that a city
may be located in more than one county and authorizes the municipal
corporation to apply for a change of township lines across county
boundaries; and
WHEREAS, Washington Township has the largest area of township jurisdiction
within the City of Dublin; and
WHEREAS, Washington Township has a fully equipped and staffed fire station
at Brand Road and Muirfield Drive and can respond in the shortest period
of time to fire and medical emergencies in the Concord Township portion
of the City of Dublin, thereby increasing service and reducing risks to
life and property; and
WHEREAS, there have been several tragedies and near tragedies in the
Concord Township portion of the City of Dublin due to distance, dis-
patching, delays, and Concord Township's decision not to fully implement
the automatic response agreement with Washington Township; and
WHEREAS, response time to the portion of Dublin in Concord Township has
become a major concern to the residents of that area; and
WHEREAS, the Dublin City Council has reviewed the proposal from the Concord
Township Trustees to raise taxes in order to increase services, and Council
has determined that this proposal, Hit is passed by the township voters,
will not enable Concord Township to provide service or response time equal
to or better than the service and response time offered by Washington
Township; and
WHEREAS, more than 1220 signatures have been collected from adult residents
of the Concord Township portion of Dublin urging the Dublin City Council
to extend the boundary of Washington Township to include all of the City
of Dublin in Delaware County;

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
~, of Ohio, 6 of the elected members concurring:

Section 1- That the City of Dublin, Ohio, an Ohio Municipal Corporation,
hereby petitions the Board of County Commissioners of Delaware County,
Ohio, for a change of township lines of Concord Township to remove
the area included within the corporate limits of the City of Dublin from
Concord Township and place it in Washington Township pursuant to the terms
and provisions of the Ohio Revised Code Section 503.07 and related sections.
Section 2. That the Clerk of Council is hereby authorized and directed to
certify a copy of this Ordinance, together with a certified copy of the
minutes of the meeting at which this Ordinance was adopted, showing its
adoption by a vote of the majority of the members of the Dublin City
Council, being the "legislative authority of such Municipal Corporation"
as set forth in Ohio Revised Code Section 503.07, to the Board of County
Commissioners of Delaware County, Ohio.
Section 3. That the City Law Director be and he is hereby authorized and
directed to present a certified copy of this Ordinance and a certified
copy of the minutes of this meeting to the Board of County Commissioners
of Delaware County, as a petition praying for such changes to the
boundary lines of Concord Township as set forth herein.
Section 4. That this Ordinance shall be declared to be an emergency, as
this Council has determined that the health, welfare and safety of the
.*';" citizens of Dublin are at risk, and therefore this Ordinance sha 11 be
passed as an emergency.

AN ORDINANCE TO ACCEPT AN
ANNEXATION OF 7.129: ACRES
IN WASHINGTON TOWNSHIP TO
THE CITY OF DUBLIN
OHIO
WHEREAS, said annexation has been approved by the Franklin County
Commissioners, and Council is of the opinion that said territory
should be annexed.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 7 of the elected members concurring:

Section 1. That the petition for the annexation of 7.129~ acres (see
attached legal description) to the City of Dublin,Ohio, is hereby
accepted.
Section 2. That this Ordinance shall take effect and be in force from
and after the earliest period allowed by law.

are presented the petition for annexation of certain adjacent territory
to the City of Dublin, Ohio, filed by 33/Dublin Industrial Park, et al. ,

WHEREAS, the time and date have been set by the Franklin County
Conurissioners for the annexation petition by 33/Dublin Industrial Park,
et al.; and
WHEREAS, the Ohio Revised Code in Section 709.031 stipulates that
the County Commissioners can ask the County Engineer for a report on the
accuracy of the map or plat; now, therefore, on motion of Commissioner

Dear Mr. Wei1:
Enclosed is a copy of the resolution adopted on March 27, 1990, by the
Board of County Commissioners, setting the time and place of public hearing
for the annexation petition which you, as agen t , filed with this office
on February 23, 1990.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised
Code, you, as agent, are responsible for the following:
(1) Notification of the date of filing of your petition with the Board
of County Connnissioners to be delivered to the Clerk of the
municipality to which annexation is proposed and the clerk of
each township which is included in the annexation. (A map,
description and a copy of the petition should be presented to
each clerk).
(2) Publication of the substance of the petition once a week for four
consecutive weeks in a newspaper of general circulation in the
County. (The enclosed resolution will satisfy the statutory
requirements and should be used for the published notice).
(3) Service upon the municipal and township clerks of a copy of the
notice within seven (7) days after the Franklin County Commissioners
set the date for the public hearing on the annexation petition,
is on or before April 3, 1990. (The enclosed resolution will satisfy
the statutory requirements and should be used to serve the clerks).

(4) Preparation of an affidavit stating the name of the agent, the
number of owners of real estate at the time of the filing of
petition and the number of owners signing the petition.
(5) Ensuring that the legislative body of the municipality to which
the annexation is proposed, by ordinance or resolution, adopts
a statement indicating what services, if any, the municipal
corporation will provide to the territory proposed for annexation,
upon annexation. (The resolution or ordinance should include
response times for fire, EMT and police units as well as information
concerning water and sewer hook-ups and other pertinent data).
(6) The Agent or Representative of the petitioners needs to be present
at the hearing to present the petition to the Board of County
Connnissioners.
Proof of compliance with the above is required to be submitted to this
office no later than April 25, 1990.

wHEREAS, a p~tition for the annexation of 7.129 acres from Washing~n Tcwn-
ship was duly filed by Luis G. Weil, agent for the petitioners; and
WHEREAS, a public hearing will be required before the Franklin County
Commissioners; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to said
earing, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory
proposed for annexation:
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio, 7 of the elected members concurring that:
Section 1. The City of Dublin will provide the following municipal services
for the 7.129 acres in Washington Township-Franklin County upon the annexa-
tion of said area to the City of Dublin, Ohio:
Police. The City provides Police and Communications service on a full twenty-
four hour basis and also has mutual aid agreements with other municipalities.
The annexation area lies approximately one mile south of Dublin's Police
Division Headquarters. Dublin operates with a minimum of three cruisers on
duty. A response time of less than five minutes, for an emergency situation,
should be expected for this area.
Fire. Fire protection is currently provided by well-staff departments in
Washington and Perry Townships in Franklin County, and Concord Township in
Delaware County. They too have mutual aid agreements with other municipali-
tie s. This annexation would not change fire department jurisdict iona 1
boundaries and therefore response times for fire and emergency medical
services will not be affected. The Washington Township Fire station is
less than one mile from the annexation area and normal response times should
be less than three minutes.
Sanitation. Residential refuse collection services are contracted by the
City and are currently provided at no additional charge.
Street Maintenance. The City has a Street Maintenance Department which
provides excellent service in the area of street and road maintenance. This
department also provides curbside leaf pick-up at no additional charge.
Section 2. The City has SEWER and WATER service area contracts with the City
of Columbus and the subject property is within said service areas, and
conditioned on the ability of the City of Columbus to provide WATER, and to
provide sufficient SEWEHAGE disposal capacity, the City will have the ability
to service the area.
Section J. This Resolution shall take effect and be in force from and after
the earliest period allowed by law.

PRAYER OF 33/DUBLIN INDUSTRIAL PARK
FOR ANNEXATION OF 7.l29~ ACRES
IN WASHINGTON TOWNSHIP TO THE
CITY OF DUBLIN, OHIO - GRANT
CASE :/f7 - 90
WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeding
this day to hear and consider the petition of 33/Dublin Industrial Park,
filed February 23, 1990, and having in open hearing heard all of the persons
desiring to be heard for or against the granting of said petition, and
having considered all the facts with reference thereto, and being fu 11 y
advised,
WHEREAS, find that said petition contains all of the matters required
by law; that the territory sought to be annexed is adjacent and contiguous
to the said City of Dublin, Ohio; that the petition contains a full and
complete description of said territory is accurate; that the petition for
said territory is signed by a majority of the owners of real estate within
the territory sought to be annexed; that the required legal notice has
been published; that the territory sought to be annexed is not unreasonably
large; and that the general good of the territory sought to be annexed
will be served if this annexation is granted, all in accordance with the
provisions of the Ohio Revised Code 709.033, therfore, upon the motion
of Commissioner DeMoss , seconded by Commissioner Foulk ;
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY,
OHIO:
Section 1. That the prayer of said petition be granted
and the territory described in said petition shall be
annexed to the City of Dublin, Ohio, in accordance with the law;
that the orders and proceedings of this board relating to said
petition and map attached thereto, and all papers on file relating
to said matter shall be deposited at once with the Clerk
of Dublin, Ohio.
