AN ORDINANCE AMENDING SECTION 2. ("WAGE &
SALARY STRUCTURE/ADMINISTRATION") AND
SECTION 12. ("EXEMPT AND NON-EXEMPT JOB
CLASSIFICATIONS") OF ORDINANCE NO. 17-90
("COMPENSATION PLAN").
WHEREAS, Council has determined, upon the recommendation of the City
Manager, that it is desirable to amend certain sections of Ordinance No.
17-90 ("Compensation Plan"); and,
WHEREAS, Council believes that the amendments recommended by the City
Manager are appropriate;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, 6 of the elected members concurring:
Section l. That Section 2. ("WAGE & SALARY STRUCTURE I ADMINISTRATION") ,
subsection A., of Ordinance No. 17-90 be, and hereby is, amended by adding
the following paragraph at the conclusion of the listing of job
classifications contained therein:
In accordance with the provisions contained in Section 163.04 (g) (3) of
the Dublin Administrative Code, the City Manager may, at his discretion,
establish the classification title of Assistant City Manager to be used in
conjunction with any existing Department/Division Head classification
title and designate the incumbent employed within such classification to
serve in this joint capacity at the pleasure of the City Manager. Under
such conditions, the incumbent designated to serve in such capacity shall
assume the title of Assistant City Manager in conjunction with his/her
existing permanent job title. If under the aforementioned conditions, the
City Manager desires to reassign the pay grade and range of the effected
classification, such reassignment shall be subject to the approval of
Council by Ordinance amending Section 2 A. and B. of the "Compensation
Plan .
Section 2. That Section 2. ("WAGE & SALARY STRUCTURE/ADMINISTRATION"),
subsection A. , of Ordinance No. 17-90 be, and hereby is, amended by
changing the Zoning Administrator classification title and corresponding
pay grade of 17 under the "Planning & Development" categorical grouping,
to the following:
Assistant Director of Planning/Zoning Administrator 18

subsection A. , of Ordinance No. 17-90 be, and hereby is, amended by

At the April 15, 1991 Council Meeting, Council tabled Ordinance No.
21-91 pending the submission of proposed language by staff regarding
Section 1 of said Ordinance which involved the classification title of
Assistant City Manager/Development Director. Based upon the
discussion that evening, attached please find proposed language
amending Section 1 of said Ordinance.

SUMMARY & ACTION RECOMMENDED
Attached for your consideration please find Ordinance No. 21-91 amending Section
2. ("WAGE & SALARY STRUCTURE/ADMINISTRATION") and Section 12. ("EXEMPT AND
NON-EXEMPT JOB CLASSIFICATIONS") of Ordinance No. ll-90 ("COMPENSATION PLAN").
The intent of this legislation is to reflect changes in certain classification
titles presently listed in Section 2., subsection A., of Ordinance No. 17-90, to
amend certain pay grades in said Ordinance, and to add new classification titles
to the aforementioned list of classification titles in Section 2, subsection A.,
of said Ordinance. In addition, the attached legislation also seeks to amend
the list of job classifications depicted under Section 12, subsections A. and
B. , of said Ordinance by reflecting the same changes in classification titles
and the addition of the same new classification titles mentioned previously.
For reasons outlined in the "ISSUES" segment of this report, Staff believes
these amendments are warranted. Therefore, Staff recommends approval of
Ordinance No. 21-9l.
BACKGROUND INFORMATION
It should be noted that the aforementioned title changes, pay grade adjustments,
and addition of new positions or new titles outlined under the previous section
of this report, were the result of a comparative study performed by Staff prior
to and during the 1991 Operating Budget process. Consequently, the proposed
changes or new position titles were reflected in the draft of the Budget toget-
her with funds covering the impact of said changes on wages/salaries and bene-
fits. Traditionally, since 1987, it has been the practice of the City to list
title changes, new titles, and new positions under the "Personnel Data" section
of each Department's or Division's segment of the Budget. It should be noted
that this practice is philosophically consistent with the intent of Chapter 163,
Section 163.04, (1) of the Dublin Administrative Code. Under said Section, the
City Manager may make comparative studies of factors affecting the level of pay
ranges as often as he deems necessary. Said Section also states that these
studies should be made periodically and, when possible, immediately prior to the
preparation of the budget in order that the study findings can be instituted
into the "Compensation Plan" in time for inclusion in the Budget. Some of the
changes or additions noted under the "ISSUES" segment of this report were
adopted in the final version of the 1991 Operating Budget (i.e. Parks Adminis-
trator, Parks Maintenance Crew Leader, and Urban Forester), however, staff was
directed by the Finance Committee of Council to specifically remove the others
from the final version of the Budget (i.e. Assistant Planning Director/Zoning
Administrator and Assistant City Manager/Development Director).

ISSUES
Issue 1. - Change in Director of Development Classification Title
Section l. of the attached legislation reflects a change in the Director of
Development classification title to Assistant City Manager/Director of Develop-
ment. Pursuant to Chapter 163, Section 163.04 (g) (3) of the Dublin Administra-
tive Code, the City Manager may review the duties of any position and, if
warranted, may establish classifications as necessary, in his own discretion.
In my judgement as City Manager, I believe this change in classification is
warranted and, therefore, under the authority of Section 163.04 (g) (3) , it is
my desire to establish the Assistant City Manager/Director of Development
classification and to have said classification title reflected in Ordinance No.
17-90 ("COMPENSATION PLAN"). (Please refer to my attached memorandum dated
January 24, 1991 within which I discussed the reasons for which said change in
classification title is warranted.) Please note that, as reflected in my
memorandum of January 24, 1991, this change in classification title does not
involve a change in pay grade or organizational structure.
Issue 2. - Change in Zoning Administrator Classification Title
Section 2. of the attached legislation reflects a change in the Zoning Adminis-
trator classification title and corresponding pay grade of 17 to Assistant
Planning Director/Zoning Administrator at pay grade 18. This change in classi-
fication title has been contemplated for several months and is based upon the
assignment of additional duties and responsibilities which have increased the
overall level of responsibility and difficulty inherent in the position. For
example, over the past several months, this classification has been assigned
formal direct supervisory responsibility over those positions allocated to
zoning responsibilities. In addition, this classification has also been
assigned to the role of assisting in the general management of the Division of
Planning. Based upon this increased level of responsibility and difficulty, and
a comparative analysis of the relative level of responsibility and difficulty
inherent in the other classifications in the wage and salary structure, staff
believes an increase in pay grade from 17 to 18 is warranted. (Pay grade 17
carries a pay range of $32,500 - $45,050; pay grade 18 carries a pay range of
$34,000 - $46,640.)
Issue 3. - Change in Park Maintenance Supervisor Classification Title
Section 3 of the attached legislation reflects a change in Park Maintenance
Supervisor classification title and pay grade of 15 to Parks Administrator at
pay grade 16. As may have been noted by the Director of Parks & Recreation
during the 1991 Operating Budget hearing process with the Finance Committee of
Council, this change in classification title is based upon an evolution in job
responsibility combined with the assignment of additional duties & responsibil-
ities, all of which have increased the overall level of job responsibility and
difficulty. Over time, this classification has assumed increased supervisory
authority and an enlarged scope of responsibility as the urban forestry and
parks horticulture program areas and two full-time employees were added to the
organization. In addition, this classification will be assigned an even larger
scope of responsibility in the management of an ever-increasing amount of park
improvement/construction projects and the maintenance of certain public rights
of way. It should be noted that the 1991 Operating Budget, as adopted, notes
this change in classification title and contains funds to cover any increase in
salary. However, an amendment to the "Compensation Plan" is required to reflect
this change in classification title and to formally approve an increase in pay
grade. Based upon this increased level of responsibility and difficulty, and a
comparative analysis of the relative level of responsibility and difficulty
inherent in the other classifications within the wage and salary structure,
staff believes an increase in pay grade from 15 to 16 is warranted. (Pay grade
15 carries a pay range of $26,500 - $36,040; pay grade 16 carries a pay range of
$27,000 - $38,372.)

Issue 4. - Addition of the Park Maintenance Crew Leader Classification Title
Section 4. of the attached legislation adds a Park Maintenance Crew Leader
classification title and corresponding pay grade to the listing of classifica-
tion titles and pay grades in Section 2., subsection A., of Ordinance No. 17-90.
As may have been noted by the Director of Parks & Recreation during the 1991
Operating Budget hearing process with the Finance Committee of Council, with the
growth and increasing scope of responsibility in the Parks program area, the
addition of this position is necessitated by the need to have a working super-
visor for the parks maintenance crew to provide the needed direction & guidance
to said crew in the performance of their day-to-day duties. This position will
also be responsible for prioritizing the daily activities of the crew. In
addition to providing supervisory direction and guidance to the crew, this
position will still be responsible for performing the same types of maintenance
tasks as the remainder of the crew. It should be noted that the addition of
this position has been authorized in the 1991 Operating Budget which contains
funds for wages and benefits. However, an amendment to the "Compensation Plan"
is required to reflect this classification title in the list contained in
Section 2. of the "Plan" and to formally assign this classification to the
appropriate pay grade. Based upon the level of responsibility and difficulty
exhibited in this classification's duties & responsibilities, and a comparative
analysis of the relative level of responsibility and difficulty associated with
other classifications within the wage and salary structure, Staff believes that
this classification should be assigned to pay grade 10. (Pay grade 10 carries a
pay range of $23,000 - $31,800.)
Issue 5. - Addition of an Urban Forester Classification Title
Section 5. of the attached legislation adds an Urban Forester classification
title and corresponding pay grade to the listing of classification titles and
pay grades in Section 2., subsection 2A., of Ordinance No. 17-90. As may have
been noted by the Director of Parks & Recreation during the 1991 Operating
Budget hearing process with the Finance Committee of Council, the growth in the
City Street Tree program area necessitated the expansion of this position from
Part-Time Permanent status to Full-Time Permanent status. It should be noted
that the expansion of this position to Full-Time Permanent status was authorized
in the 1991 Operating Budget which contains funds for full-time wages and
benefits. However, an amendment to the "Compensation Plan" is required to
reflect this classification title in the list contained in Section 2., of the
Plan and to formally assign this classification to the appropriate pay grade.
Based upon the level of responsibility and difficulty exhibited in this classi-
fication's duties & responsibilities, and a comparative analysis of the relative
level of responsibility and difficulty associated with other classifications
with the wage and salary structure, Staff believes that this classification
should be assigned to pay grade 10. (Pay grade 10 carries a pay range of
$23,000 - $31,800.)
Conclusion
Sections 6 - 8 of the attached legislation seek to list the aforementioned
classification titles in the appropriate list under the "Exempt" and "Non-
Exempt" categories outlined in Section 12. of Ordinance No. 17-90. Further
detailed explanation on these amendments should not be necessary at this point.
Based upon the reasons outlined in the "ISSUES" segment of this report, Staff
believes these amendments are warranted and, therefore. recommends that
Ordinance No. 17-90 be adopted.

SUBJECT: Position of Assistant City Manager/Director of Development
As Council will note in your 1991 budget, I have requested that the title for the Director of
Development be modified to Assistant City Manager/Director of Development. In my
performance evaluation following the last Council meeting, several members asked for additional
information regarding this proposed modification.
Structurally, this change does not provide significant changes to our organizational chart. In
fact, in many ways, the change is more reflective of the duties which Mr. Foegler is now
carrying out. As Council is aware, in addition to his responsibilities for directly overseeing the
day-to-day operation of the Divisions of Planning, Building and Engineering; there are an
increasing number of tasks which this position has assumed, and will continue to assume, in the
coming months.
The following represents a summary of the types of responsibilities which Mr. Foegler has and
will be handling, which is an indication of this higher-level management position:
(1) Obviously, coordination of the EP A connection ban, the associated lift station
improvements and I & I reduction program required coordination of engineering,
legal and maintenance activities in-house, as well as the ability to fully coordinate
inter-governmental communications with the Ohio EP A and senior staff at the City
of Columbus.
(2) The coordination of the City's capital improvement program requires the ability
to look beyond the desires and objectives of a particular division, and to examine
the needs of the City in a truly comprehensive fashion. This is a significant
management responsibility which requires the capacity to coordinate across
departmental lines and obtain the full cooperation of all City Divisions and
departments.

(3) Additionally, this position is assuming increasing responsibility for the
coordination of city-wide development and construction activities. This is now
taking place with the construction of the police facility and will be increasing in
the future development of policies and procedures affecting property acquisition
and project implementation. For example, Mr. Foegler is developing more
formalized systems to track the status of all the City's development activities.
Mr. Foegler has also developed a standard Professional Service Contract which
the City now uses for all of its professional service agreements so that consultants
are now dealing with Dublin under terms and conditions, specified by the City.
All of these functions are indications of a senior level management position often associated with
the title of Assistant City Manager. Such a position is not unusual for a city with Dublin's level
of activity and operations. Mr. Foegler has gained the respect of his fellow employees who, I
believe, recognize his leadership abilities in these areas.
It should be noted that although this position will have responsibility for a number of functions
which cross Departmental lines, it does not have responsibility for the day-to-day operations or
oversight of Divisions outside the Department of Development.
As Council may recall, I had contemplated making this position an Assistant City Manager
position when we were having difficulty filling this position with a qualified person. I believe
Mr. Foegler has clearly demonstrated the ability to get "up-to-speed" with complex issues and
to deal with controversial issues in a highly professional and effective manner. Changing this
position to Assistant City Manager/Director of Development status recognizes the inter-
departmental nature of many of Mr. Foegler's activities while, however, recognizing that his
primary responsibilities are the day-to-day operation of the Department of Development.
Basically, no new position is being created, and no change in salary range is proposed as part
of this amendment. I strongly recommend that Council approve this proposed modification to
the title of this position.
