AN ORDINANCE AMENDING ORDINANCE
NO. 06-90, THE ANNUAL APPROPRIA-
TIONS ORDINANCE, AUTHORIZING
IMPROVEMENTS AT AVERY ROAD PARK
WHEREAS, the Ohio Revised Code requires, when necessarY,amendments to
the Appropriations Ordinance in order that appropriations are not over-
expended; and
WHEREAS, it is necessary to appropriate additional funds for the purcha e
of materials for the construction of a concession stand at Avery Road
Park at an approximate cost of $40,000.00; and
WHEREAS, it is also necessary to appropriate additional funds for the
installat ion of lights to light athletic fields for an approximate cost
of $30,000.00:
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, ~of the elected members concurring:
Section 1. That there be appropriated from the unappropriated balance n
the CAPITAL IMPROVEMENT TAX FUND, the sum of $70,000.00 to account
D10-07-7A-250F.
Section 2. That this Ordinance shall take effect and be in force from
and after the earliest period allowed by law.

The 1990 Capital Improvements Program Budget includes two appropriations for Avery Road
Park. 1) . Light two ball diamonds, $90,000.00; 2). Utility services-water, electric and
sanitary for a concession stand to be constructed by Dublin Soccer League, $50,000.00.
Several factors have changed since the original budget estimates were established in
late 1989.
1. The original estimates for ball diamond lighting was based on
wooden poles. Wood was selected over steel poles because
of dramatic cost savings. A new design of steel pole is now
on the market and the cost has been reduced to $5,000.00 more
than wood poles, per diamond. The benefits of steel justify the
expense - durability, ability to stay true, aesthetics, and
maintenance. Further, due to several recent national disasters,
hurricanes and earthquakes, wood utility poles are very
difficult to acquire.
2. The Dublin Soccer League has requested lights for two full
size soccer fields in the future. DSL and DYA tried to
coordinate field uses earlier this year. They attempted
to layout a soccer field on the ball diamond and to be
lit. Unfortunately, it was not possible to create
multiple use due to the physical constraints imposed by
swales, utilities and general design of the park.
3. One of the ball diamonds slated for lights is #2, the
fenced softball diamond in the southern part of
the park. The existing electric in this area that lights
ball diamond #1 and the 3 tennis courts is deteriorating
due to age and poor materials used. The city is continually
repairing this existing electric. We propose to size the new
electric service for the southern park area to handle the
existing electric in the future.
Factors #2 and #3 affect the original ball diamond lighting project in both the size
and location of the transformer. The size, determined by the electric company based on power
needs, has increased the cost due to more service, trenching, and conduit. The new
transformer must be placed in such a manner that it can effectively service lighting ball
diamond #2, a new concession shed, and light two soccer fields in the future. Originally,
the smaller transformer was located next to diamond #2. The new larger transformer location
causes us to install a 550' run to diamond #2 which dramatically increases the cost.
Because of the ongoing problems with the existing electric in the southern areas, we
plan to hook up to the new transformer in 1991. Although the initial cost may seem high,
the benefits are better service to Dublin residents and savings in man hours and repair
bills.
Finally, by further utilizing this new transformer, hooking in existing electric
service in 1991, we will help eliminate, or at least cut the cost considerably of any pay-
back to Columbus Southern Power for the transformer. If we do not use enough electricity
to cover the ir , Columbus Southern Power, cost of installation within a given time frame,
Dublin is responsible for the cost difference.
In summary, this entire situation is an attempt to be efficient through economy of
scale.

I. Meeting Called to Order at 7:30 p.m.
II. Approval of Minutes - Minutes approved with the following notation:
Opinion was voiced that we should not give special invitations, the meeting
is public and enough publicity will be out that everyone should be aware of
the meeting. Other feelings are that there are certain people that you want
at the meeting, and we do not want to take the chance that they might not see
the notices, so we should send them invitations. It was also noted that
invitations should be sent to all area groups, i. e. Women's Club, Soccer
League, DYA, etc.
II. Change Agenda - Since representatives from Soccer League are here,
e should go ahead a put them first on the agenda.
Jim Sturm, DSL stated that their reason for being here this evening is
that the Soccer League would like this committee's input with regard to the
new concessions stand to be located at Avery Park. All the details regarding
funding and legal issues are still being worked out, at this time we would
like to show the committee what soccer has come up with and answer any
questions and get the committee's input.
About two years ago soccer erected a temporary structure, approximately
16' x 20'. Until now it has been satisfactory, however, it does not have
rest rooms, running water and electric is provided by a generator. At this
point we would like to move forward with a more permanent structure.
A local architect, Dick Rauh, has drawn up a concept plan for what
soccer would like to see in the way of a building. Soccer feels that this
building would meet their needs and be a substantial addition to the park,
especially in the way of restrooms.

Building, as designed, has a concession area, men & women's restrooms,
entral utility, which provides access to rest rooms, a storage area, and a
hop area. Soccer would like to start a soccer shoe exchange, many children
outgrow their soccer shoes before they wear out, in this shop area, people
can bring in soccer shoes that are now the wrong size and trade them in for
a pair that fits. Soccer could also sell shirts, etc. , at the tournaments.
The building will look, from the road, very similar to the DYA
concession, same roof, same exterior, the major difference is that this
building is square, not 5 sided.
Right now, soccer would like to provide the labor, they want the City
to provide the materials.
Janet stated that in the Capital Improvements Budget, has a $50,000.00
line item to give support to this project. With the $50,000.00 we are going
to be able to bring electric from Avery Road. The water lines run along the
east side of Avery Rd. and we have to pay the tap fees. The sanitary sewer
issue was the most complicated. We have to put a leach bed in with
provisions. All of this needs to be approved by the EPA, we have started
this process.
Earlier this week, Janet, Pat O'Kane, Mitch Banchefsky, and Chris Cline
met to discuss how all of this was going to get done so we are not in direct
violation of Ohio Construction law, it could be construed that we are trying
0 circumvent the bidding process. Janet feels that they worked through
very thing and that everything is on the table. The new issue, however, is
hat Janet told Council that we were doing water, electric and sanitary
sewer, now soccer would like us to provide the materials. This will have to
go back to Council, they will have to approve the expenditure for building
materials. We believe this can all be done within the $50,000.00. There
will have to be a formal presentation to Council when we have more
information.
We do have the opportunity to save on the electrical installation. The
Parks Department is lighting Diamonds #2 & #5. We will get a larger
transformer from the electric company.
Questioned was raised as to the need for the restrooms. It was
explained that the expense for the restrooms was in the fixtures. the sewage
system will still have to be put in for the concession stand and it will have
to meet health department standards.
Soccer stated that they are planning on bringing in some larger
tournaments and they believe that it is not attractive to have the portable
restrooms visible. This could be a deciding factor in whether or not a
tournament would be held at Avery or somewhere else.

Joel Campbell suggested that DSL apply for bed tax funds. Tournaments
ring people and money into the City. Soccer asked if they could use bed tax
unds to purchase the equipment to go inside the concession stand?
We are not sure bed tax funds can be used for something that is going
to be here all year and used primarily for the benefit of the local people.
Bed tax could be used for tents, hospitality, or anything directly used for
the tournaments. We believe request have to be geared for bring people in
from out of town.
Janet suggested that DSL talk to the DYA. DYA made enough money the
first year to pay for all of the equipment they acquired.
Soccer stated they are considering using the slab that the present
concession stands is on and possibly making another shelter house. They were
also considering cleaning out the woods area.
Janet asked that they not clean the woods out, this is a nature area
with mulch trails, etc. , the Parks Department will take care of the woods.
Denise King stated that this area of woods is very useful and educational if
you know what you are looking for.
Kent Underwood was asked his opinion as an architect. He feels we need
a good sense of the site plan and we need a good paved area for the lines in
front of the concession stand windows, otherwise the grass area will be
'lined.
Jim Sturm stated that several things have been modified to address that
specific item. The building is 44 feet square, the roof is 56 feet and 6
feet on the outside. Soccer is recommending that they go an additional 2
feet all the way around, this means we will have an 8 foot apron.
Question was raised as to whether women's restroom could be expanded if they
took out some of what appears to be a over generous utility room?
Soccer stated that they will be servicing a soda fountain and the
canisters would be in that area and they are very large. You have to be able
to move around in there in order to service the canisters. Soccer usually
has the soft drink company service them.
Janet stated that the concession run by DYA does not use the canisters,
they use more of a milk carton type item which sits on a rack. Janet stated
that soccer needs to go out to the DYA concession and take a critical look
at how that one works, what needs to be close to other things.
Pat O'Kane asked if committee has any preference to coloring of the
block. Committee wants to see sameness.

Architect suggested that at corners approximately 4 feet in and a couple
E rows up, bottom and top, a slightly different color 1. e. light brown -
irk brown to add some color.
Janet stated that this is a preliminary plan, the entire project will
have to go through the City's formal plan review process. Janet would like
to see compatibility.
Janet stated that there were some concerns as to how this was going to
get bid out as far as what we, the city, are working on. The City will be
functioning as the general contractor and all the pieces will be under the
bid requirements and we will be paying prevailing wage. The attorneys carne
to agreement that we are not in conflict as the general contractor and
purchasing the various supplies that go into this.
DSL stated that the concession stand does belong to the City. Janet
stated that it will run under the same agreement that we have with DYA as far
as rights and privileges. After at least a year of operation, the utility
cost will be calculated out and then we will take a minimal percentage to
cover the cost of the utilities in a rent payment type situation.
IV. Old Business
Updates - Starkey-Coffman - none at this time
Community Center - Request for Proposal - we now have a signed contract
.th Bill Andrews and we have a meeting scheduled for next week.
Matter of when the public meeting will be. At the beginning we were
going to shoot for the last week in March, first part of April and although
we are not going to be on the May ballot, there is concern that we don't let
this get put off too long. Timing is a big factor.
Joel Campbell stated that timing was also a factor in that since it is
not on the May ballot, and that there is a number of issues that we have to
deal with for the May ballot, everyone felt that the Community Center should
be dealt with immediately after.
Facilitator - the City has in the past used Mike Lorz, Lorz
Communications, he has expressed an interest in being the facilitator for the
public meeting.
Donegal Cliffs - Council awarded the contract last Monday. The lowest
and best bid was Strawser Paving, coming in at $299,712.00. Contract was
signed this week and we will be having our pre-construction meeting.
Strawser plans on being on site next week.
