RECORD OF ORDINANCES Dayton Legal Blank, Inc. ance No. 43 -13 Form No.30043 Passed . 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTATION TO ACQUIRE A 0.280 ACRES, MORE OR LESS, FEE SIMPLE INTEREST OF WHICH 0.184 ACRES, MORE OR LESS, IS PRESENT ROAD OCCUPIED; A 0.009 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT; AND A 0.028 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM JERRY GARLAND SPEARS III AND MARSHA M. SPEARS, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin is preparing to construct a roundabout and accompanying facilities at the intersection of Brand and Coffman Road (the `Project'j; and WHEREAS, the project requires the City to obtain certain property interests within = ranklin County Parcel No. 270 - 000262, owned by Jerry Garland Spears III and Harsha M. Spears, described and depicted in the attached Exhibits "A" and "B," attached hereto and incorporated herein; and WHEREAS, the City and the Grantor participated in good faith discussions and have -ome to mutually agreeable terms for the acquisition of the property interests for the g HM of Fifteen Thousand Six Hundred Forty five Dollars ($15,645.00), plus the addition of eleven (11) trees; and WHEREAS, the City desires to execute necessary conveyance documentation to complete the transaction between the City and the Grantor. NOW, TH�REFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documentation to acquire a 0.280 acres, more or less, fee simple interest of which .184 acres, more or less, is present road occupied; a 0.009 acres, more or less, for a temporary construction easement; and a 0.028 acres, more or less, for a temporary construction easement from Jerry Garland Spears III and Marsha M. Spears, for the sum of Fifteen Thousand Six Hundred Forty Five Dollars ($15,645.00), plus the addition of eleven (11) trees, said property interests located within Franklin County Parcel No. 270 - 0000262, and as more fully described and depicted in the attached Exhibits "A" and "B." Section 2 . This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The acquisition of the property interests described herein is necessary to improve traffic circulation and to address safety concerns for the citizens of Dublin. As such, this ordinance shall go into immediate effect upon passage. Spears Background The City of Dublin ( "City ") is preparing to construct intersection improvements and associated pedestrian facilities at the intersection of Brand Road and Coffman Road (the "Project "). The City must obtain property interests from various landowners located within the area of the Project in order to construct this project. The City presented offers, based upon appraisals, to each of these landowners. One of the landowners that the City must obtain property interests from for the construction of the Project is Jerry Garland Spears III and Marsha M. Spears (the "Grantor "). After engaging in amicable negotiations, the City has come to an agreement with the Grantor to acquire these necessary property interests, pursuant to the terms outlined in this memorandum. Acquisition The City will acquire from the Grantor only those property interests necessary for the construction of the Project as depicted in the legal descriptions and maps attached to this memorandum. The City will acquire these property interests for approximately 5% above appraised value. Staff recommends approval of Ordinance 43 -13 by emergency at the second reading /public hearing on June 10, 2013 as obtaining the property interests is necessary for the furtherance of this Project.
