AN ORDINANCE AUTHORIZING
EXECUTION OF AND PAYMENT
FOR A TEMPORARY EASEMENT
FROM THOMAS A MCDOWELL,
AND DECLARING AN
EMERGENCY
WHEREAS, the City of Dublin is currently under a sewer connection ban
from the Ohio Environmental Protection Agency; and
WHEREAS, the City of Dublin requires an easement on additional land owned
by Thomas A. McDowell in order to locate additional improvements to the
pump station and related facilities as part of an overall sanitary sewer
improvement project designed to meet or exceed the EPA requirement to
facilitate the lifting of the sewer connection ban; and
WHEREAS, Mr. McDowell has agreed to grant the City the necessary temporary
easement which will remain in effect until such time as the west branch
interceptor sewer is constructed and Dublin's connection thereto is
completed.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 7 elected members concurring that:
Section 1. Council hereby authorizes the manager to execute the temporary
easement from Thomas A. McDowell to the City of Dublin attached hereto
and incorporated herein as Exhibit "A".
Section 2. As and for compensation for this easement, Council hereby
authorizes the payment to Thomas A. McDowell of the sum of Twenty
Thousand Dollars ($20,000.00). Further, as additional compensation,
Council hereby agrees to have a survey conducted of Thomas A. McDowell's
entire 6.52 acre tract from which this easement is being granted.
Section 3. This Ordinance is declared to be an emergency measure
necessary for the immediate preservation of the public health, safety
and welfare for the reason that acquisition of this easement is
necessary to complete the improvements required to permanently correct
the City's sewer overflow problem.

EASEMENT AGREEMENT
KNOWN ALL MEN BY THESE PRESENT that THOMAS A. MCDOWELL, hereinafter referred to
as "Grantor", for good and valuable consideration paid.to him by the CITY OF
DUBLIN, an Ohio municipal corporation, hereinafter referred to as "Grantee",
the receipt of which is hereby acknowledged, does hereby grant and convey to
the Grantee a temporary easement for the purpose of access, construction and
operation of a sanitary sewer pump station and related facilities over and
through the real estate more fully described in Exhibits "A" and "B" attached
hereto as if fully rewritten.
(1) The Grantee by accepting and recording this easement
agrees to all of the terms and conditions of this
easement. This easement shall terminate and the
improvements thereon shall be removed within six (6)
months from the date that the Grantee is able to
connect and/or otherwise tie into the west branch
sewer to be constructed primarily by the City of
Columbus with assistance from the Grantee herein.
(2) Grantee shall indemnify and save harmless Grantor, his
heirs and assigns, for all claims, expenses, damages
and liabilities asserted against them or any of them,
including but not limited to claims (i) for mechanic's
and materialman's liens and any costs and reasonable
attorneys' fees incidental thereto, ( ii) on account of
injury to or death of any person or persons whosoever
or (iii) on account of damages to any property, and
every instance caused by, connected with, or in any
way attributable to, the rights herein granted for
Grantee's failure to comply with any of the terms or
conditions hereof;
(3) Grantor hereby reserves the right to use the property
specified in this grant of easement for any lawful
purpose which will not interfere with Grantee's full
enjoyment of the easement.
( 4) Grantee warrants, following completion of construction,
to return the surface, improvements and landscaping
on the easement premises, and the adjacent land used
by the Grantee, if any, to the condition which existed
thereon prior to the entry onto the property by Grantee
subject to Grantee's rights herein, with all such work
to be done at Grantee's sole cost and expense.
(5) This temporary easement shall terminate as set forth
in section (1) herein at which time Grantee shall
have the right to remove any and all improvements
which it has caused to be placed upon the subject
property.

Situate in the State of Ohio. County of Franklin, City of Dublin, being
a part of Virginia Military Survey No. 2542 and also being a strip of land
on. over and across a 6.52 acre tract as conveyed to Thomas A. McDowell by
deed of record in Deed Book 2385, Page 97, Recorder's O(fice, Frank'in
County, Ohio and b&ing more particularly described as follows:
Being a strip of land 25 fet?t in width. the centerlin.e to which being
more particularly described as follows:
Commencing at a point of reference at the southwesterly corner of th~
said 6.52 acre tract and said point being ~lso in the ce~terl;ne of High
Street (Dublin Road);
Thence South 83 degrees 29 minutes 30 seconds East, a distance of
444.52 feet along the southerly line of the said €.52 acre tract and also
along the northerly 1ine of Karrer Place Subdivision of record i~ Plat Sock
53, Page 21, Recorder's Office, Franklin County, Ohio to th~ True Paint of
Beginning of the herein described strip of land;
Thence North 10 degrees 33 minutes 10 seconds ~est, a dis~ance of
548.60 feet crossing the said 6.52 acre tract t, the terminus point of the
herein described strip of land in the southerly r1ght-cf-way line of Short
St reet .
This easement supercedes and vacates t~e easement of r~cord in Deed
