Form No. 30043 Ordinance No,.3.~.-:-:9.~ (Amended) Passed.uu. .ummumu. mmmmumu19uu AN ORDINANCE AUTHORIZING THE PURCHASE OF A SEWER VACUUM MACHINE WITHOUT FORMAL ADVERTISING AND COMPETITIVE BIDDING, AND DECLARING AN EMERGENCY WHEREAS, it is the desire and objective of the City of Dublin to identify and resolve the existing sanitary sewer infiltration/inflow problem as expedi- tiously as possible; and WHEREAS, Council has already authorized the purchase of sewer video inspection equipment to achieve said objective; and WHEREAS, for the sewer video inspection program to be effective in achieving the desired objective, certain sewer lines will need to be cleaned; and WHEREAS, Section 8.02(B) of the Dublin Charter enables Council, by ordinance, or resolution adopted by a vote of at least two-thirds of its members, to authorize, without advertising and competitive bidding, contracts or expendi- tures for any purpose where the statutory or common law of Ohio does not require competitive bidding; and WHEREAS, Section 735.051 of the Ohio REvised Code enables the legislative authority of a city to authorize, by a two-thirds vote of its members elected thereto, the City Manager, or other duly authorized contracting authority, to enter into a purchasing contract without formal bidding and advertising, when a real and present emergency arises in connection with the operation of any department, division, commission, bureau or board of the municipality; and WHEREAS, Council believes that a real and present emergency exists within the City of Dublin; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 7 of the elected members concurring: Section 1. That, pursuant to Section 8.02 of the Dublin Charter and Section 735.051 of the Ohio Revised Code, the purchase of a sewer vacuum machine, without formal advertising and competitive bidding, in the amount not to exceed $140,000.00, is authorized. Section 2. That this Ordinance be, and hereby is, declared to be an emergency measure necessary for the preservation of the public health, safety, and welfare and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Hansley, City Manager SUBJECT: Emergency Purchase of a Sewer Vacuum Machine DATE: March IS, 1990 BY: David L. Harding, Director of Personnel & Purchasing Attached for your consideration please find Ordinance No. 31-90 authorizing the purchase of a sewer vacuum machine without formal advertising and competitive bidding and declaring an emergency. As the attached legislation states, it is the objective of the City to resolve the infiltration/inflow problem in the sanitary sewer system. Council has already authorized the emergency purchase of sewer video inspection equipment to achieve said objective. In order for the sewer video inspection program to be effective in achieving the desired objective, a certain percentage of the sewer lines will need to be cleaned. Therefore, Staff believes that the sewer vacuum machine needs to be purchased immediately so that the effectiveness of the sewer video inspection program can be maximized. Staff believes that the cost of a sewer vacuum should not exceed $120,000. In conclusion, Staff recommends that pursuant to Section 8.02 of the Dublin Charter and Section 735.051 of the Ohio Revised Code, formal advertising and competitive bidding be waived and the sewer vacuum machine be purchased on an emergency basis. Mr. Johnson, Maintenance Superintendent will be in attendance at the Council Meeting on March 19, 1990 to brief Council regarding this matter. TCH/DLM/mc Attachment
