Inc, Form No. 30045 Resolution No. 28 -13 n Lj A RESOLUTION WAIVING COMPETITIVE BIDDING REQUIREMENTS PURSUANT TO SECTION 8.04 (`CONTRACTING PROCEDURES "), PARAGRAPH C ("WAIVER OF COMPETITIVE BIDDING "), OF THE REVISED CHARTER FOR THE PURCHASE OF BEER FOR THE 2013 DUBLIN IRISH FESTIVAL WHEREAS, Section 8.04(c) of the Revised Dublin Charter authorizes Council, by a vote in favor of no less than five (5) members, to waive competitive bidding requirements if Council determines that it is in the best interest of the City to do so; and WHEREAS, Superior Beverage Group has served as the distributor of the Festival sponsor products for the Dublin Irish Festival over the past two decades, contributing a substantial amount of financial and promotional support to the Festival; and WHEREAS, Killian's Irish Red and Guinness are sponsors of the Dublin Irish Festival and Superior Beverage Group of Columbus is the sole distributor for the their products in Central Ohio; and WHEREAS, it has been recommended by staff that it is in the City's best interest to waive competitive bidding requirements and to designate the Superior Beverage Group as the provider of beer products at the 2013 Dublin Irish Festival due to the financial and marketing benefits these sponsorships provide to the Festival and the City. NOW, MEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, -L/-- of the elected members concurring, that: Section 1. Superior Beverage Group of Columbus is hereby designated as the provider for beer products for the 2013 Dublin Irish Festival. Section 2. Competitive bidding requirements are hereby waived for these purchases, as it has been determined to be in the City's best interest to do so. Section 3. This Resolution shall take effect upon passage in accordance with Section 4.04(a) of the Revised Charter. Grigsby, City Manager Date: May 16, 2013 Initiated By: Alison LeRoy, Manager, Events Administration Re: Resolution No. 28 -13 - Waiving Competitive Bidding Requirements for the Purchase of Beer for the 2013 Dublin Irish Festival Summary Attached for your consideration is Resolution 28 -13, waiving competitive bidding requirements for the procurement of beer for the Dublin Irish Festival. Section 8.04 (c) of the Revised Charter authorizes Council, by a vote in favor of no less than five (5) members, to waive the competitive bidding requirement if it determines that such waiver is in the best interest of the City. This year, as in past years, the beer sponsor of the Festival is Killian's Irish Red. In addition, we have added Guinness as a sponsor in 2013. Their parent companies — MillerCoors for Killian's and Diageo for Guinness -- will each pay a sponsorship fee to the City of Dublin. We will offer the following beer products for sale during the Festival: Killian's Irish Red, Coors Light, Coors, Guinness and Blue Moon. Superior Beverage Group of Columbus is the sole distributor for all of the MillerCoors and Diageo products in Central Ohio. Expenditures for the purchase of beer for the 2013 Festival are estimated at $160,000. Appropriate funding for this purchase has been authorized by Council in the 2013 operating budget. Recommendation Staff recommends approval of Resolution 28 -13, waiving competitive bidding for the purchase of beer for the 2013 Dublin Irish Festival.
