AN ORDINANCE AUTHORIZING THE
ACTING VILLAGE MANAGER TO
ENTER INTO AN AGREEMENT WITH
THE CITY OF COLUMBUS TO
IMPROVE O'SHAUGHNESSY BRIDGE
WHEREAS, the Village of Dublin, Ohio, pursuant to Resolution No. 14-86
passed September 2, 1986, agreed to cooperate with the City of Columbus
to widen and improve O'Shaughnessy Bridge, and
WHEREAS, replacement of said bridge will benefit both citizens of
Dublin and Columbus, and
WHEREAS, Federal Funds may be available for a substantial portion of
the construction costs.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin,
Ohio, State of Ohio, 7 of the elected members concurring that:
Section 1. That the agreement attached hereto as Exhibit "A" is hereby
approved and accepted.
Section 2. The Acting Village Manager is hereby authorized to enter
into said agreement with the City of Columbus to cooperate in the
financing and replacement of O'Shaughnessy Bridge.
Section 3. That this Ordinance shall take effect and be in force from
and after the earliest period allowed by law.

WITNESSETH

NOW, THERI-:FORE, Dublin and Columbus, in consideration of the covenance and agreements
contained herein, agree as follows:
1. Dublin shall make application [or eighty percent (8010 ) Federal funding o[ the Bridge
rf'p Llcell1ent and sha II take all necessary steps to qualify [or said Federal funding
including but not I i.mi ted to the annexation of necessary sections of Glick Road and
the Bddge right-oE-way, and the placing of Glick Road on its thoroughfare plan.
2. Columbus agrees to cooperate with Dublin in accomplishing the objective set forth
in paragraph I , herein.
J. In Lhe event eighty percent (80/0 ) Federal funding is obtained, the parties agree
that Dublin shall pay ~iQ percent and Columbus shall pay 75% per"cent of
thl' tot ill project costs in l'xcess of the grant of Federal funds. The City's
obl igilt ion for any part of the project will not be legally enforceable unless tire
City Auditor first certifies to the City Counc il that the money required fa I' said
part of the project is in the treasury to the credit of the fund from which it is
to be drah'n, and not appropriated for any other purpose.

a. f{eplacelllent of the current two lane bridge with a four lane bridge, in which
case Dublin agrees to be responsible for the total project costs in excess
ot the engineer's estimate for a new two lane bridge, and further, for those
duties set fonh in paragraph 4 herein. Columbus sha 11 be responsible [or the
project costs equal to the engineer's estimate for a two lane bridge.
b. f{eplacement of the current Bridge with a new two lane Bridge, in which case
Dublin agrees to be responsible for 0 percent of the total project costs,
and Columbus shall be responsible for 100 percent of said costs.
c. !Jublin llIay withdraw completely from the Bridge replacement project.
6. f Il tile event Dublin elects to withdraw from this project, pursuant to paragraph 5
herein, Dubl in agrees to reimburse Columbus for 20 percent of the total engin('ering
cost expended by both parties; provided, however, that said reimbursement sha 11 1I0t
exceed Eighty Thousand Dollars ($80,000.00).
IN WITNESS WHEREOF, the parties hereto have set their hands effective this date.

AGREEMENT
Entered into this day of , 1987, by and between the Village of Dublin,
an Ohio Municipal Corporation (hereinafter "Dublin"), pursuant to Resolution No. 14-86,
passed September 2, 1986, and Ordinance No. 74-87, passed on July 6, 1987, and the City
of Columbus, an Ohio Municipal Corporation (hereinafter "Columbus"), pursuant to Ordinance
No. passed , 1987, for the purpose of setting forth the terms and
condit ions for cooperation between Dublin and Columbus in the financing and replacement
of the O'Shaughnessy Bridge (hereinafter "Bridge").
WITNESSETH
WHEREAS, Dublin, by its Resolution and Ordinance referenced herein, has indicated its
intent to work in cooperation with Columbus to finance and replace the Bridge with a new
four lane bridge; and
WHEREAS, Dublin and Columbus agree that the existing two lane bridge is in need of replace-
ment to enhance the safety of the dam and minimize the size of levee needed to maximum
probable flood condition; and
WHEREAS, replacement of the Bridge will benefit both the citizens of Dublin and Columbus;
and
WHEREAS, Federal funding may be available to pay for a substantial amount of the con-
struction costs; and
WHEREAS, procurement of such funds will enable Dublin and Columbus to construct a four
lane bridge at a cost less than the cost of repairing the existing two lane bridge;
NOW, THEREFORE, Dublin and Columbus, in consideration of the covenance and agreements
contained herein, agree as follows:
1. Dublin shall make application for eighty percent ( 80/0) Federal funding of the Bridge
replacement and sha 11 take all necessary steps to qualify for said Federal funding
including but not 1 imited to the annexation of necessary sections of Glick Road and
the Bridge right-of-way, and the placing of Glick Road on its thoroughfare plan.
2. Columbus agrees to cooperate with Dublin in accomplishing the objective set forth
in paragraph 1, herein.
3. In the event eighty percent (80/0) Federal funding is obtained, the parties agree
that Dublin shall pay 25% percent and Columbus sha 11 pay 75% percent of
the total project costs in excess of the grant of Federal funds. The City's
obligation for any part of the project will not be legally enforceable unless the
City Auditor first certifies to the Ci~y Council that the money required for said
part of the project is in the treasury to the credit of the fund from which it is
to be drawn, and not appropriated for any other purpose.
4. Upon completion of the Bridge, Dublin agrees to assume responsibility for routine
daily maintenance and repair of the Bridge and roadway, including sidewalks and
approaches, and Columbus agrees to assume responsibility for all structural main-
tenance and repairs of the Bridge.
S. In the event eighty percent (80%) Federal funding is unavailable, Dublin shall
elect from one of the following courses of action:
a. Replacement of the current two lane bridge with a four lane bridge, in which
case Dublin agrees to be responsible for the total project costs in excess
of the engineer's estimate for a new two lane bridge, ,and further, for those
duties set forth in paragraph 4 herein. Columbus sha 11 be responsible for the
project costs equal to the engineer's estimate for a two lane bridge.
b. Replacement of the current Bridge with a new two lane Bridge, in which case
Dublin agrees to be responsible for 0 percent of the total project costs,
and Columbus shall be responsible for 100 percent of said costs.
c. Dublin may withdraw completely from the Bridge replacement project.
6. In the event Dublin elects to withdraw from this project, pursuant to paragraph 5
herein, Dublin agrees to reimburse Columbus for 20 percent of the total engineering
cost expended by both parties; provided, however, that said reimbursement sha 11 not
exceed Eighty Thousand Dollars ($80,000.00).

MEMORANDUM
TO: All Councilmembers

SUBJECT: Ordinance No. 75-87
DATE: July 2, 1987
The above ordinance will be given to you at Monday's evening. Briefly, the
purpose is to cover accounts that will be "overdrawn" by some of the bills
on the listing for July 6th. Since the bill listing is not yet completed r
am unable to have the Ordinance completed at this time. r expect three
accounts in particular to be the following:
1) A01-07-7E-231A for Real Estate Taxes - bills for the last half of the
year were due 6/20 on newly acquired parkland. Exemptions can now
be filed for next year.
2) A01-07-7A-234B for the Manager Search Expenses. r should be able to
have a better estimate of final costs now that the process is completed.
3) A01-07-7E-2520 and B09-04-4B-2520 for Office Equipment for the Building
and Engineering Department as well as Administrative Offices. With the
addition of inspectors, planning and clerical personnel, more furniture
needs to be ordered for these departments.
