AN ORDINANCE AUTHORIZING THE
ACTING VILLAGE MANAGER TO
ENTER INTO A WATERLINE PAY-
BACK AGREEMENT WITH PHOENIX
LAND COMPANY FOR THE WOODLANDS
SUBDIVISION
WHEREAS, the Village of Dublin has received and accepted a proposal
from Mr. John Yeager of The Phoenix Land Company to install a water-
line at his expense to service the Woodlands Subdivision, and
WHEREAS, contiguous properties may also be serviced by this waterline,
and
WHEREAS, Council agrees that a payback agreement is acceptable in order
to provide water services to these properties and reimburse Phoenix
Land Company for the costs incurred.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin,
State of Ohio 7 of the elected members concurring:
Section 1. That the Acting Village Manager be and hereby is authorized
to enter into the agreement attached hereto as Exhibit "A".
Section 2. That this Ordinance take effect and be in force from and
after the earliest period allowed by law.

AGREEMENT
Entered into this 2.fl, day of $ L~ ' 1987 by and between the
Village of Dublin, Ohio and the developer of th Woodlands Subdivision, namell
The Phoenix Land Company, pursuant to Ordinance No. 73-87 passed on ~(ll 61 1
, 1987 for the purpose of setting forth the terms and conditions for
constructing a waterline south from Summitview Road to Tonti Drive to service
the Woodlands Subdivision and the reimbursement for costs thereto.
WHEREAS, Dublin has received and accepted a proposal from the Phoenix Land
Company for installation of a waterline south from Summitview Road to Tonti Drive;
and
WHEREAS, it has been determined that said installation will also service
adjoining properties.
NOW, THEREFORE, Dublin and The Phoenix Land Company in consideration of the
foregoing and mutual promises contained herein agree as follows:
1. The Phoenix Land Company agrees to construct a waterline to service
the Woodlands Subdivision and other adjoining properties pursuant to
the plans on file with the Village Engineer.
2. The Phoenix Land Company agrees to certify the actual cost of
construction of the waterline as soon as possible after completion
of said waterline.
3. Upon verification of the costs as certified in No. 2 above and
acceptance of the waterline by the Village Engineer, the Vi 11age of
Dublin agrees to reimburse The Phoenix Land Company for said costs
as funds are received from front foot assessments on Tonti Drive
pursuant to Ordinance No. 57-84 from any property owner directly
serviced by said waterline who will or may request water taps or
extensions from said waterline for a period of 10 years commencing
from the date of acceptance.
4. Said fees sha 11 be remitted to The Phoenix Land Company on a quarterly
basis along with an itemized list of taps made.
