AN ORDINANCE TO ACCEPT AN I
ANNEXATION OF 733~ ACRES I
IN WASHINGTON TOWNSHIP TO
THE CITY OF DUBLIN, OHIO
WHEREAS, said annexation has been approved by the Franklin County
Commissioners, and Council is of the opinion that said territory
should be annexed.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, --2-of the elected members concurring:
Section 1. That the petition for the annexation of 733! acres (see
attached legal description) to the City of Dublin, Ohio is hereby
accepted.
Section 2. This Ordinance is hereby declared to be an emergency measure
necessary for the immediate preservation of the peace, health, safety,
morals and welfare of the citizens of Dublin, Ohio; and for the reason
that revenues provided to the City from the territory sought to be
annexed will be used to provide essential municipal services, including
police protection services and fire/emergency medical dispatching
" services to the citizens of the City of Dublin and to those in the
territory sought to be annexed, then this Ordinance shall take effect
immediately upon its passage.

Enclosed is a copy of the resolution adopted on May 1, 1990, by the Board
of County Commissioners, setting the time and place of public hearing for
the annexation petition which you, as agent, filed with this office on
April 12, 1990.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised
Code, you, as agent, are responsible for the following:
(1) Notification of the date of filing of your petition with the Board
of County Commissioners to be delivered to the Clerk of the
~ municipality to which annexation is proposed and the clerk of
~ each township which is included in the annexation. (A map,
0 ~ description and a copy of the petition should be presented to

~ '7"": (2) Publication of the substance of the petition once a week for four
uJ:;e. consecutive weeks in a newspaper of general circulation in the
~ ~ County. (The enclosed resolution will satisfy the statutory
~ requirements and should be used for the published notice).
(3) Service upon the municipal and township clerks of a copy of the
notice within seven (7) days after the Franklin County Commissioners
set the date for the public hearing on the annexation petition,
is on or before May 8, 1990. (The enclosed resolution will satisfy
the statutory requirements and should be used to serve the clerks).

(4) Preparation of an affidavit stating the name of the agent, the
number of owners of real estate at the time of the filing of
petition and the number of owners signing the petition.
(5) Ensuring that the legislative body of the municipality to which
the annexation is proposed, by ordinance or resolution, adopts
a statement indicating what services, if any, the municipal
corporation will provide to the territory proposed for annexation,
upon annexation. (The resolution or ordinance should include
response times for fire, EMT and police units as well as information
concerning water and sewer hook-ups and other pertinent data.)
(6) The Agent or Representative of the petitioners needs to be present
at the hearing to present the petition to the Board of County
Commissioners.
Proof of compliance with the above is required to be submitted to this
office no later than June 26, 1990.

ChristDpher T. Cline, being duly cautioned and sworn, deposes and states
as follows:
1. That he is the attorney and agent for the property owners
seeking the above annexation. His address is 37 West Bridge Street,
Dublin, Ohio 43017.
2. That at the time of the annexation petition, there were 169
property owners in the area proposed for annexation. 103 of those owners
signed the petition for annexation. In determining the number of owners,
any person or entity owning property was assumed tD be an "owner" within
the meaning of ORC section 709.02(c).
3. Resolution Number 470-90 was served upon the Cler k of the City
of Dublin on May 7th, 1990. A copy of the receipt from said clerk was
filed in this cause on May 10, 1990. Notice of the filing of the petition
was served upon the Clerk of the City of Dublin, along with a copy of the
petition, the map and the legal description on the 16th day of April, 1990.
An affidavit of this affiant and a receipt from said cler k was filed in
this cause on April 18th, 1990.
4. Resolution Num ber 470-90 was served upon the Clerk of
WashingtDn Township on May 3rd, 1990. A copy of the receipt from said
cler k was filed in this cause on May 10, 1990. Notice of the filing of the
petition was serve d upon the Clerk WashingtDn Township, along with a
copy of the petition, the map and the legal description on the 16th day of

709.031 OF THE OHIO REVISED CODE
WHEREAS, a petition [or the annexation of 733! acres from Washington Town
ship was duly filed by Christopher T. Cline, agent for the petitioners;
and
I WHEREAS, a public hearing will be required before the Franklin County
, Commissioners; and
WHEREAS, Section 709.031 of the Ohio REvised Code requires that, prior to
said hearing, the Municipal. Authority shall adopt a statement indicating
I what services, if any, the Municipal Corporation will provide to the
territory rpoposed for annexation:
II NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin,
State of Ohio. ~of the elected members concurring that:
Section 1. The City o[ Dublin will provide the following municipal
services for the 733! acres in Washington Township-Franklin County upon
the annexation of said area to the City of Dublin. Ohio:
Police. The City provides Police and Communications service on a full
twenty-four hour basis and also has mutual aid agreements with other
municipalities. The annexation area lies approximately one mile south
of Dublin's Police Division Headquarters. Dublin operates with a minimum
~ m - of three cruisers on duty. A response time of approximately five minutes
.E S for an emergency situation, should be expected for this area.
i ] I Fire. Fire protection is currently provided by well-staffed departments
~~ I' in Washington and Perry Townships in Franklin County. and Concord Town-
; :~ ship in Delaware County. They too have mutual aid agreements with other
~ c I municipalities. This annexation would not change fire department juris-

~ ~ i dictional boundaries and therefore response times for fire and emergency
~ ~ !: medical services will not be affected. The Washington Township Fire
.~ ~ Station is approximately one mile from the annexation area and normal
~ ~ response times should be approximately three minutes.
~ ~ Sanitation. Residential refuse collection services are contracted by the
o ~ City and are currently provided at no additional charge.

= ~ Street Maintenance. The City has a Street Maintenance Department which
~ ; provides excellent service in the area of street and road maintenance.
.~~ This department also provides curbside leaf pick-up at no additional

S ~ City of Columbus and the subject property is within said service areas,
,~~ and conditioned on the ability of the City of Columbus to provide WATER,

AFFIDAVIT OF SERVICES; MAINTENANCE

Danny Johnson, being duly cautioned and sworn, deposes
and states that he is the duly qualified and acting
Maintenance Superintendent for the City of Dublin, Ohio and
that the following averments set out details of the ability
of the City of Dublin to provide Maintenance Service to the
proposed area of annexation as above described:
1. The Maintenance Division of the City of Dublin is
composed of the following personnel:
1 Maintenance Superintendent
2 Foremen
1 Administrative Clerk/Secretary
11 Maintenance Workers
1 Custodian (for City buildings)
2. The following personnel positions were approved in the
1990 budget and will be added to the division in 1990:
2 Mechanics
1 Auto Service Custodian
1 Maintenance Worker
1 Clerk Typist
3. The Maintenance Division currently has 7 pick up
trucks and 7 dump trucks, all are equipped for snow and
ice removal with plows and salt spreaders. Two
additional dump trucks which will be equipped for snow
and ice removal are on order and should be delivered in
late 1990/early 1991. Additionally, 3 trucks from the
Building and Engineering Division are equipped for snow
and ice removal. A street sweeper, sewer inspection
van, sewer vac. machine, and a front end loader have
been added to the fleet this year. The division also
has 1 chipper machine and 2 leaf machines.
4. The purchase of the following equipment for the
division has been approved in the 1990 budget and will
be purchased yet this year:
1 bucket truck
2 tractors
3 pick ups (2 are on order)

5. The division will be adding several new services in
1990. They are as follows:
1. Mechanical Service -- full time mechanics
will be hired and will service all City equipment
and vehicles .
2. Street Sweeping Service -- this service was
initiated in March 1990.
3. Paint Striping Service -- the City began
performing its own pavement marking service
in June 1990.
4. A brush chipper machine service began in
late 1989 and is continuing in 1990. This
service aids citizens with the removal of
tree and shrub trimmings.
5. Sign Service -- the division will begin
making all its own street and traffic control
signs.
6. The City has a fogging machine and 4
employees licensed by the state to spray
insecticide for the purpose of mosquito
control. The City's mosquito control program
will resume July 1, 1990.
6. The City added a second leaf machine in 1988 and
therefore would be able to handle the additional leaf
removal.
7. A new service complex which will house the division
should be completed within the next month. This
complex will allow the division to expand the services
it offers and would be centrally located should the
annexation occur. Completion of the construction was
delayed but we expect to be occupying the building very
soon.
8. As a part of the expansion of the division which is
currently occurring, the division will be computerized.
This will enhance the performance of the services
provided.
9. As set out in the foregoing averments, it is my opinion
and belief that the Maintenance Division of the City of
Dublin is able to provide a very high level of service
to the annexed area, and that insofar as maintenance
service is concerned, the general good of the area will
be benefitted by annexation to the City of Dublin.

states that he is the duly qualified and acting police chief for the City of
Du blin, Ohio and that the following averments set out details of the
ability of the City of Dublin tn provide police protection tn the proposed
area of annexation as above described:
1. The police department of the City of Dublin is composed of the
following personnel:

2. The Dublin Police Department presently has 14 vehicles on hand, 10 of
which are marked cruisers and 4 are unmarked cars. In addition,
the Division also maintains a fully equipped all terr ain vehicle
which serves as a mobile comm and center. This vehicle is used in
the managment of special events, critical incidents and other police
related incidents.
3. The Du blin Police Department operates its own fully operational 24
hour radio dispat.ching center. The center is equipped with state of
-the art equipment and handles all dispat.ching for the Dublin Police
Department and the Washington Township Fire Department.
4. The Dublin Police Department is in the process of beco!1lming tntally
computerized with respect tn records and dispatching. The transition
has been funded and will be complete by year end. The system will
be state-of-the-art.
5. The Dublin Police Depar'bnent has completed an on-site assess!1lent from
a te am of assessors representing the Commission on Accreditation of Law
Enforcement Agencies in January of this year. In Marc h, the Division
form ally received national accreditation. The Du blin Police Department
was the first central Ohio law enforcement agency tn recieve such
recognition.
6. The Division of Police has specialized positions tD bev...er provide law

enforcement services for the community. These include Technical
Accident Investigators, Crimes Scene Evidence Technicians and Breath
Testing Operators (to operate the Division's breath testing machine).
7. Each patrol shift is norm ally staffed by 1 sergeant and three patrol

8. The area proposed to be annexed is bounded to the north and east by
the corpor ate limits of the City of Dublin. As a result, the are a is
already recel vlng the benefit of the presence of Dublin police
cruisers which regularly pass through the area during norm al patrol
operations . As such, the area is able to be efficiently patrolled
Vlithou-c o:;ignificant alteration in patrol operations.
9. Due to the geographical location of the area proposed for annexation,
which is to a a large degree internal within the present city,
dispatch times for emergency calls will be as short, or shorter, than
for the balance of the corpor ate limits of Dublin. Maxim um time for
" priority one" calls is presently about four minutes. Planned
municipal road im provements , to include the Muirfield Drive extention
and the Coffm an Road extention across State Route 161/US 33 will
provide even more efficient service to the area.
10. The Dublin Police station is presently located approximately 4800 feet
to the north from the northernmost portion of the area proposed for
annexation. A new police station is presently planned and will be
located on Coffm an Road which will be extended across State Route
161/US33 to directly connect to t.c'-1e area proposed for annexation.
The distance will be about the same.
11. As set out in the foregoing averments, it is my opinion and belief that
the Dublin Police Department is able to provide a very high level of
police protection and service to the annexe d area, and that insofar

be benefitted by annexation to the City of Dublin.

Gene Bostic , being duly cautioned and sworn, deposes and states
that he is the duly qualified and acting fire chief for WashingtDn
Township, Fr anklin County , Ohio and that the following averments set out
details of the fire and emergency protection which would be provided to
the proposed area of annexation as above described if the annexation to
the City of Dublin is allowed:
l. The entire area proposed for annexation is contained within the
present service area of the WashingtDn Township Fire Department.
Annexation to the City of Dublin will allow the are a to rem ain within the
service area of the WashingtDn Township Fire Department without change.
2. At the present, dispatrhing within the area proposed for
annexation is handled through a contract with the Cit"y of Dublin, Division
of Police. The same arrangement would remain after annexation to Dublin.
3. At present 9-1-1 calls are routed through the F::" anklin County
Sheriff to the City of Du blin, Division of Police, for dispatrhing.
Annexation would cause those calls to go directly to the Dublin dispatrher.
4. The nearest WashingtDn Township fire station to the area
proposed for annexation is at 6255 Shier Rings Road, bascially located
within the area proposed for annexation. From that fire station to the
farthest point in the annexation area is less than two miles. The average
response time for the WashingtDn Tow nship Fire Department to the
annexation area is three to four minutes.
5. The WashingtDn Township Fire Department maintains mutual aid
and automatic response agreements with neighboring fire departments
should additional assistance be needed.
6. The WashingtDn Township Fire Department is fully manned by
on-duty personnel 24 hours per day 7 days per week. Personnel are as

JANET L. JORDAN, being fully cautioned and sworn, deposes and states that
she is the duly qualified director of the Parks and Recreation Department for
the City of Dublin, Ohio and that the following averments set out details of the
abili ty of the City of Dublin to provide recreation and park services to the
proposed area of annexation as above described.
1. The parks and recreation department of the City of Dublin is composed of
the following personnel.

2. The Dublin Parks and Recreation Department presently has 9 vehicles on
hand, 2 dump trucks, 1 4-wheel drive pick up, 1 4-door pick up, 1 S-10 pick up,
2 regular pick up trucks, 1 cushman, and 1 fire truck for watering. In 1990
2 additional trucks will be added. Parks Maintenance also has 7 riding mowers,
a back-hoe and a tractor.
3. The Dublin Parks and Recreation Department maintains 11 developed parks.
These parks are both passive and active in character, comprising approximately
220 acres. Included in these parks are 13 multi-purpose fields, 11 tennis courts
(6 lighted), 7 shelter houses, 7 tot lots, 11 ball diamonds, and 5 basketball
courts (1 lighted), 2 sand volleyball lots and 2 horseshoe pits. Fishing and
sledding can be enjoyed at Scioto Park. The Dublin Municipal Pool opened in
1988.
4. The City of Dublin has approximately 120 acres of undeveloped parkland
including a 60 acre nature study park and a proposed Japanese garden to be
developed along the Scioto River in an abandoned quarry.
5. The City of Dublin pursues an ambitious Capital Improvements program in
park development. 25% of the income tax collected is ear marked for Capital
Improvements Projects.
6. The City of Dublin acquires parkland through developer dedication of land
as negotiated in the zoning process on residential developments. The City of
Dublin also purchases property deemed desirable by it's residents.

7. The Dublin Parks and Recreation Department offers recreational programming
beginning from age 18 months through pre-school, school age, teens, adults and
senior citizens. The service area for recreation encompasses the Dublin School
District. Sampling of programs include Sports leagues i.e. 80 softball leagues
(fall & winter), 2 basketball leagues (summer and winter); volleyball leagues
(fall, winter & spring); sand volleyball league (summer only); Recreational
programming includes Pre school activities, Kidzercise, Tumbling, Conversational
Japanese, Dublin Troupers, Guitar Lessons, Red Cross Babysitting, Billiards
lessons, Basketry, Red Cross Community CPR, Red Cross First Aid, Quilting, Golf
and Tennis Lessons, 3 Summer playgrounds, 5 sessions of Day Camp, and a Learn-
to-Swim program coordinated with Developmental and Competitive Swim Teams.
8. The City of Dublin is planning to construct a multi-generational Center
to facilitate recreation activities in Coffman Park.
9. As set out in the foregoing averments, it is my opinion and belief that
the Dublin Parks and Recreation Department is able to provide a high level of
recreation and parks services to the annexed area, and that insofar as recreation
and parks. services is concerned, the general good of the area will be benefitted
by annexation to the City of Dublin.

WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeding
this day to hear and consider the petition of Larry Kincaid, et al. , filed
April 12, 1990, and having in open hearing heard all of the persons desiring
to be heard for or against the granting of said petition, and having
considered all the facts with reference thereto, and being fully advised,
WHEREAS, find that said petition contains all of the matters required
by law; that the territory sought to be annexed is adjacent and contiguous
to the said City of Dublin, Ohio; that the petition contains a full and
complete description of said territory is accurate; that the petition for
said territory is signed by a majority of the owners of real estate within
the territory sought to be annexed; that the required legal notice has
