AN ORDINANCE AUTHORIZING THE
CITY MANAGER TO ENTER INTO AN
AGREEMENT AND DEED OF EASEMENT,
AND AN ADDENDUM TO AGREEMENT
REGARDING THE LLEWELLYN FARMS
PARK
WHEREAS, it is the desire of Council and staff to have Crow-Ransom,
Ltd. , Partnership, provide for the care and maintenance of
architectural mounding landscape planting within a twenty (20) foot
wide easement of the entire west side of an 8.800 acre tract located
adjacent to the Llewellyn Farms Park; and
WHEREAS, C. F. Bird and R. J. Bull, Ltd. have agreed to provide additional
trees and landscape material.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 7 elected members concurring that:
Section 1. The City Manager is hereby authorized by Council for the
City of Dublin to enter into an agreement and deed of easement granting
a 20' wide easement to Crow-Ransom, Ltd. , Parntership from the City
of Dublin.
Section 2. The City Manager is further authorized to enter into an
addendum to said agreement whereby C. F. Bird and R. J. Bull, Ltd.
agrees to provide $5,000.00 worth of planted trees within the boundaries
of Llewellyn Park and within the boundaries of said 20' easement.
Section 3. This Ordinance shall take effect and be in force from and
after the earliest period allowed by law.

AGREEMENT AND DEED OF EASEMENT
This Agreement and Deed of Easement made this day of
-
, 1987, between the VILLAGE OF DUBLIN, OHIO, an Ohio
municipal corporation, hereinafter referred to as "Grantor", and
CROW-RANSOM, LTD. PARTNERSHIP, hereinafter referred to as
"Grantee".
WHEREAS, the Grantor is the owner in fee simple of a certain
parcel containing 8.800 acres as described on Exhibit A attached
hereto and made a part hereof as though fully rewritten hereinJ
and
\VHEREAS, Grantee is the owner in fee simple of a certain par-
cel containing 13.075 acres as described on Exhibit B attached
hereto and made a part hereof as though fully rewritten hereinJ
and
\oJHEREAS, the parties hereto are desirous of having the
Grantee provide for the care and maintenance of architectural
mounding landscape plantings within a twenty (20) foot wd.de
easement of the entire west side of said 8.BOO acre tract; and
.
WHEREAS, in consideration of the mutual covenants and bene-
fits to be derived by both parties from the care and maintenance
of said mounding and plantings.
NOW, THREFORE, in consideration of the mutual covenants and
benefits set forth herein, and in further consideration of the
benefits derived by the Grantor from the Grantee's care and
maintenance of said mounding and plantings on the above-referenced
twenty (20) foot wide easement, the Grantor hereby grants unto
Grantee, its successors and assigns a perpetual easement over
and within the twenty foot strip of land more particularly
described in Exhibit C attached hereto and made a part hereof as
though fully rewritten herein for the purpose of constructing an
architectural mound and landscape p1antings within said twenty

foot strip in accordance with applicable zoning regulations and
permi ts and for the purpose of the care and maintenance of said
architectural mound and landscape plantings. See Exhibit "0".
Grantee agrees to maintain the said moundings and plantings
and to save Grantor harmles~ from any and all loss, cost, damage
and expense including but not limited to attorney's fees arising
out of any wrongful or negligent act of Grantee or its agents
and assigns in connection with the care and maintenance of said
moundings and plantings.
IN WITNESS WHEREOF, the Grantor has caused its name to be
hereunto subscribed by the Village Manager, being duly
authorized pursuant to Ordinance No. 128-87 duly passed by
the Dublin Village Council on December 21. 1987 , 1987, and
approved by the Grantee.

ADDENDUM TO AGREEMENT
This Addendum to the Agreement between the CITY OF DUBLIN,
Ohio an Ohio Municipal Corporation and CROW-RANSOM, LTD,
PARTNERSHIP, regarding a twenty (20) foot wide architectural mound
and landscape planting easement, is hereby incorporated therein as
if fully rewritten,
WHEREAS, C,F. Bird & R.J, Bull, Ltd, has agreed to provide
additional consideration on behalf of Crow-Ransom, Ltd,
Partnership, pursuant to the underlying agreement and deed of
easement; and
WHEREAS, the original parties are in agreement that
additional consideration for the granting of the subject easement
should be provided to the grantor, City of Dublin, Ohio,
NOW, THEREFORE, in consideration of the mutual covenants
and benefits set forth in the original Agreement and Deed of
Easement and this AddendUm thereto, which is attached thereto and
made a part thereof as though fully rewritten therein, C,F, Bird &
R,J, Bull, Ltd, , hereby agrees to provide the following to the
City of Dublin via private contract:
A, $5,000,00 worth of planted trees, inclusive of labor,
to be located within the boundaries of the Llewlyln Farms Park, to
be installed at the direction of the City of Dublin Parks and
Recreation Department and Planning and Zoning Commission at such
time as said park is landscaped.
B, The parties hereto further agree that all plantings
within the subject twenty (20) foot wide easement to be done
contemporaneously and in conjunction with the development of phase
two of the Crow-Ransom, Ltd, Partnership building on the 13,075
acre tract described on Exhibit liB II of the original Agreement and
Deed of Easement, The location of the plantings within said
easement shall be pursuant to the Plan previously approved by the
City of Dublin Planning and Zoning Commission and Parks and
Recreation Department,
IN WITNESS WHEREOF, the parties hereto being the City of
Dublin, Ohio, Crow-Ransom, Ltd, Partnership, and C,F, Bird << R.J,
Bull, Ltd. hereby execute this Addendum to the original Agreement
on this day of , 1987,
