HomeMy WebLinkAbout115-87 Ordinance RECORD OF ORDINANCES National Graphics Corp., COls., O. ~ Form No. 2806.A Ordinance No.ul15=81mm Passed 19 AN ORDINANCE REPEALING CHAPTER 561 AND ADOPT- ING CHAPTER 561 OF THE CITY OF DUBLIN CODIFIED ORDINANCES REGARDING ABATEMENT OF NOXIOUS WEEDS AND DECLARING AN EMERGENCY WHEREAS, weed control is required in the City of Dublin, and therefore, no person, whether the owner, lessee, agent, tenant or other person of entity having charge or care of land in the City shall permit noxious weeds to grow thereon to a height in excess of twelve inches, or to mature seeds thereon, or fail to cut and destroy such weeds when notified by the Code Enforcement Officer to do so; and WHEREAS, "noxious weeds" are defined to include thistle, burdock, jimson weed, ragweed, mi lkweed, mullein, poison ivy and other vegetation of rank growth, and the failure to cut the same is declared a nuisance and a hazard to the health and safety of the residents of the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 7 of the elected members concurring: Section 1. That Chapter 561 entitled Weeds and Trees be repealed and that a new Chapter 561 entitled Weeds shall be enacted. Section 2. That the Code Enforcement Officer shall cause written notice to be served once each growing season, May 1 through September 30 of each calendar year upon the owners, lessees, tenants or other persons or entities having charge or care of land in the City, notifying them that noxious weeds be cut within five days of such notice and that such weeds be cut thereafter during the growing season with sufficient frequency to prevent such weeds from exceeding twelve inches or maturing seeds thereon. Section 3. During the period May 1 through September 30 of each calendar year, the Code Enforcement Officer may determine that the growth of noxious weeds on land for which a notice has been issued which constitutes a hazard and/or a nuisance, and that the person having charge or care of the land has failed to comply with the notice. Thereupon, the Code Enforcement Officer may cause the weeds to be cut by use of City forces and equipment or by the hiring of private contractors. Section 4. That upon completion of the cutting and removal of the weeds, thp Code Enforcement Officer shall determine the cost of cutting and removal, and sha 11 cause a statement thereof to be mailed to the owner of the land. Section 5. That the owner shall pay such costs as are charged in accordance with this Ordinance to the Finance Director within thirty days after the statement of charges has been mailed to the owner at the address of record in the office of the County Treasurer. If the charge is not paid within thirty (30) days after mailing, the Director of Finance sha 11 certify the charges for services to the County Auditor upon direction by Council and approval of certification, together with a proper description of the premises. Such amounts sha 11 be entered upon the tax duplicate, sha 11 be a lien upon such lands from the date of the entry, and sha 11 be collected as other taxes and returned to the City with the General Fund. Section 6. That whoever violates this section is guilty of a minor mis- demeanor and subject to the penalties provided in this Ordinance. Section 7. That this Ordinance be, and the same hereby is, declared to be an emergency measure necessary for the preservation of the public peace, health and safety and therefore this Ordinance sha 11 take effect and be in force immediately upon its passage. pa;;;li; of September , 1987.
