HomeMy WebLinkAboutResolution 07-13RECORD OF RESOLUTIONS Dayton Legal Blank, Inc., Foot No, 30045 Resolution No. 07 -13 (a{v�P�Yld�d Passed '0 A RESOLUTION APPROVING AN AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF DUBLIN AND THE DUBLIN SOCCER LEAGUE, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT WHEREAS, on July 2, 2012, Dublin City Council approved an extension to the Agreement with Dublin Soccer League ( "DSL ") under which DSL continues to provide general recreational soccer and contracts with third parry non - profit providers to provide supplementary competitive programs; and WHEREAS, Section (13)(3)(a) of the Agreement requires background checks for "staff and volunteers regularly alone with children;" and WHEREAS, the City of Dublin ( "City") desires to extend background checks to any and all individuals who participate and /or are involved in any City program in which children participate. NO THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, of its elected members concurring, that: Section 1. The Dublin City Council hereby approves the Amendment to the Agreement between the City and DSL, attached hereto as Exhibit "A" and authorizes the City Manager to execute the Amendment. Section 2. The Dublin City Council hereby requires that similar background checks be added to any agreement with a third parry provider if the services involve the participation of children. Section 3. This Resolution shall be effective upon passage in accordance with Section 4.04(a) of the Revised Charter. Passed this 1/-fk day o U 2013. V /G,��Ch - �G�X'G�liz��e/✓ Mayor - � esi ing Officer ATTEST: Clerk of Council AMENDMENT TO THE 2012 AGREEMENT This Amendment is to the 2012 Agreement ( "Agreement ") between the City of Dublin ( "Dublin ") and the Dublin Soccer League ( "DSL" ), approved by Dublin City Council on July 2, 2012 and hereby amends said Agreement as follows: That Section 13(3)(a) is hereby amended as follows: a. Assure b Velui4 gu ly A-'R�° 4.v4h e4ild-°H that any individual, including but not limited to staff, board members volunteers and coaches associated with either DSL and/or any other group /organization Providing services under this Agreement is required to pass the qualifications for risk management background checks through the City herebv prohibits the participation of any individual who has been convicted of anv criminal offense involving a minor and/or where the minor was the victim. Finally, assure compliance with all child safety measures required by the United States Soccer Federation, Soccer Association for Youth Times Two program or any replacement program adopted. 2. All other provisions of the Agreement shall remain in full force and effect. Grigsby, City Manager Date: February 8, 2013 Initiated By: Matt Earman, Director of Recreation Services Memo Re: Resolution 07 -13 - Amendment to the Dublin Soccer League and City Agreement Background In order to provide for quality and safe recreation experiences, the City has adopted rules and regulations for organizations that partner with the City for services offered to the Dublin community. The City's Agreement with the Dublin Soccer League (DSL) requires compliance with certain legal requirements for operation of its programs, including background checks for all coaches, volunteers and officials regularly alone with children. The attached Amendment to the DSL Agreement strengthens this requirement to include any individual, including staff, board members, volunteers and coaches, associated with either DSL and /or any other group /organization providing services under this Agreement to pass the qualifications for risk management background checks through the Ohio South Youth Soccer Association (" OSYSA'). In addition to the disqualifiers contained in the OSYSA risk management program, the City, as part of this agreement, prohibits the participation of any individual who has been convicted of any criminal offense involving a minor and /or where the minor was the victim. Finally, DSL must assure compliance with all child safety measures required by the United States Soccer Federation, Soccer Association for Youth Times Two program or any replacement program adopted.
