Village of Dublin, Ohio.
Dear Sir:-
In reply to your letter of the 20th inst., may we
advise as follows:
Under the provisions of section 4219 of the General
Code, prior to amendment effective July 1,1943, the
salary of village councilmen was fixed by law at $2.00
per meeting, not to exceed twenty-four meetings per
year. Under that provision it was held that the
members of council could be paid said legal rate ot
compensation even without an ordinance fixing said
rate.

Section 4219 G.C., was amended effective July 1,1943,
to provide -
"The maximum amount of compensation which may be fixed
for members of counci~ shall be limited as follows:

It would thus appear that after July 1,1943, any change
in the salary of councilmen in a village should be fixed
by ordinance of council, especially if such change exceeds
the rate of $2.00 per meeting for twenty-four meetings per
year. Further, such a change in salary could not be made
within the term.
However, we can see no objection to fixing the councilmen's
salaries at the rate of $2.00 per meeting within the term,
of the present members, as they could legally have been
paid that rate under the old law.

We are of the opinion, therefore, that council is authorized
to fix the salaries of councilmen at the rate of $2.00 per
