Yeager, Mayor, Village of Dublin, Ohio. Dear Sir:- In reply to your letter of the 20th inst., may we advise as follows: Under the provisions of section 4219 of the General Code, prior to amendment effective July 1,1943, the salary of village councilmen was fixed by law at $2.00 per meeting, not to exceed twenty-four meetings per year. Under that provision it was held that the members of council could be paid said legal rate ot compensation even without an ordinance fixing said rate. I / fI,'" " ~ Section 4219 G.C., was amended effective July 1,1943, to provide - "The maximum amount of compensation which may be fixed for members of counci~ shall be limited as follows: *' *' II It would thus appear that after July 1,1943, any change in the salary of councilmen in a village should be fixed by ordinance of council, especially if such change exceeds the rate of $2.00 per meeting for twenty-four meetings per year. Further, such a change in salary could not be made within the term. However, we can see no objection to fixing the councilmen's salaries at the rate of $2.00 per meeting within the term, of the present members, as they could legally have been paid that rate under the old law. ~"'. /-" "",it"; ...", We are of the opinion, therefore, that council is authorized to fix the salaries of councilmen at the rate of $2.00 per ~~~~,~~~ per year, at th~~3 ~~-
