AN ORDINANCE TO ACCEPT A PETITION
FOR ANNEXATION TO THE VILLAGE OF
DUBLIN, OHIO OF 16.1 ACRES ON THE
WEST SIDE OF S.R. 745, SOUTH OF THE
1-270 BRIDGE OVER SAID S.R. 745.

WHEREAS, said annexation has been approved by the Franklin County
Commissioners and;
WHEREAS, the Dublin Village Council is of the opinion that said
territory should be annexed:
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of
Dublin, State of Ohio, of the elected members concurring:
Section 1. That the petition of Jerold L. Trabue, et al., for
the annexation to the Village of Dublin, Ohio of 16.1 acres in
the County of Franklin (see attached legal description hereby
made an official part of the Ordinance) together with an accurate
map and a certified transcript of the proceedings of the County
Commissioners, all on file in the office of the Village Manager
be, and the same hereby is accepted.
SECTION 2. That this Ordinance shall take effect and be in force
from and after the earliest period allowed by law.

Beginning at a point in the westerly right-of-way line of
Dublin Road (State Route 745, being 60 feet in width), 8aio
point being an angle point in the existing Village of Dublin

Franklin County, Ohio, do hereby certify that the papers hereto attached
constitute the original papers and a true transcript of all proceedings had
by the Board of County Commissioners of Franklin County, Ohio, in connection
with the petition filed by Jerold L. Trabue, et a1., owning real estate
within the territory sought to be annexed; praying for the annexation of
certain adjacent and contiguous territory in Washington Township to the

The Commissioners of Franklin County, State of Ohio, proceeding this
day to hear and consider the petition of Jerold L. Trabue, et al., filed
January 13, 1984, and having in open hearing heard all of the persons de-
siring to be heard for or against the granting of said petition, and having
considered all the facts with reference thereto, and being fully advised,
FIND, that said petition contains all of the matters required by law;
that the territory sought to be annexed is adjacent and contiguous to the
Village of Dublin, Ohio; that the petition contains a full and complete
description of said territory sought to be annexed; that the map for said
territory is accurate; that the petition for said territory is signed
by a majority of the owners of real estate within the territory sought to
be annexed; that the required legal notice has been published; that the
territory sought to be annexed is not unreasonably large; and that the
general good of the territory sought to be annexed will be served if this
annexation is granted, all in accordance with the provisions of the Ohio
Revised Code 709.033; therefore,
IT IS HEREBY ORDERED: On motion of Commissioner DeMoss, seconded by
Commissioner Foulk, that the prayer of said petition be granted and that
the territory described in said petition be annexed to the Village of Dublin, I
Ohio, in accordance with the law; that the orders and proceedings of this
Board relating to said petition and map attached thereto, and all papers
on file relating to said matter be deposited at once with the Clerk of
Dublin, Ohio.

says that he is the attorney for the Agent for the Petitioners
in that certain Annexation Petition wherein it is prayed that
16.1 acres, more or less, in Washington Township be annexed to
the Village of Dublin, Ohio, which petition is set for hearing
before the Board of County Commissioners of Franklin County, Ohio,
on Wednesday, March 14, 1984, at 10:00 A.M.; that, at the time of
the filing of said petition, there were 8 owners of real estate in
the area so prayed to be annexed, of which 8 owners of the 8 had
signed and affixed their signatures to said petitioner; that
affiant was the circulator of said petitioner and that, to the
best of affiantts knowledge, each of said signers placed his and/or

Gentlemen:
In regard to the proposed annexation ( 16.1 deres f rOfll

Washington Township to the Village of Dublin to be heard on
[\1a r c h 14, 1984 at 10:00 A.M., I offer the following
comments:
Se\.Jer and Water Service
The Village has Sewer and Water Service Contracts with the
City of Columbus and the subject property IS within said
;j<, Service Areas. The subject property would be served as soon
as legal and financial obligations would permit.
Police Protection
The Village currently employs eighteen ( 18) full-time
Personnel in the Police Department and provides service on a
full t\.Jent y-four (24 ) hour basis. Equipment is excellent
with a program of replacement of at least two (2 ) new
Cruisers on an annual basis. Communications are contracted
from Perry Township and Concord Township in Delaware County.
They too have a mutual aid Agreements \.Ji th ot:her
municipalities.
Fire Protection
Fire protection is currently provided by well staffed
Departments in Washington Township, Perry Township and
Concord Township in Delaware County. They too have mutual
aid Agreements with other municipalities.
tvla i ntenance and Improvements
The Village has an expanding Street [\1aintenance Department,
\.Je 11 equipped to provide excellent service In the area of
Street and Road maintenance. In addition, t:he Village has a
progressive Capital Improvement Plan which IS reviewed on an
Annual basis.
~.!i t h these service provisions we pray approval of the
proposed annexation to the Village of Dublin.

Room, 3rd floor, 410 S. High Street,
Columbus, Ohio.
Dear Mr. Smith:
Enclosed if a copy of the resolution adopted on January 23, 1984,
by the Board of County Commissioners setting the time and place
of public hearing for the annexation petition which you, as agent,
filed with this office on January 13, 1984.
Under the provisions of Section 709.03 of the Ohio Revised Code,
you, as agent are responsible for the following:
( 1) Notification of the date of filing of your petition
with the Board of County Commissioners to be delivered
to the Clerk of the municipality to which annexation is
proposed and the clerk of each township which is included
in the annexation. (A map, description and a copy of the
petition shoUld be presented to each clerk) .
( 2) Publication of the substance of the petition once a
week for four consecutive weeks in a newspaper of
general circulation in the County. (The enclosed
resolution will satisfy the statutory requirements and
should be used for the published notice) .
( 3) Service upon the municipal and township clerk of a
copy of the published notice.
( 4) Preparation of an affidavit stating the name of the
agent, the number of owners of real estate at the time
of the filing of petition and the number of owners
signing the petition.
A letter from the municipality to which an annexation is proposed
stating the availibility of services such as water, sewerage, and
police and fire protection, is also required.

duplicate to this office no later!than, March 9, 1984.

certain adjacent territory to the Village of Dublin, Ohio, by
Jerold L. Trabue, et al., and appointing Harrison W. Smi th , Jr. ,
as agent for the said territory being described as follows:

MORE OR LESS, IN THE
TOWNSHIP OF WASHINGTON
TO THE BOARD OF COUNTY COMMISSIONERS
OF FRANKLIN COUNTY, OHIO:
The undersigned, petitioners in the premises, and being a
MAJORITY OF OWNERS OF REAL ESTATE in the territory hereinafter
described, consistin9 of 16.1 acres, more or less, in
the Township of Wash1ngton , which area is contiguous
and adjacent to the v1~~age o~ uuo11n , do hereby pray
that said territory be annexed to the Village of Dublin ,
according t~ the statutes of the State of Ohio.
A full and accurate description and a plat of said territory
so prayed to be annexed are attached hereto and made part hereof.
In support of said Petition, your petitioners suate that there
are within the territory so prayed to be annexed 8 OWNERS
OF REAL ESTATE.
Harrison w. Smith, Jr., is hereby appointed Agent for the
undersigned Petitioners, as required by Section 709.02 of the
Revised Code of Ohio. Said Agent is hereby authorized to make
any amendment and/or deletion which in his absolute and complete
discretion is necessary or proper under the circumstances then
existing, and in particular to make such amendment in order to
correct any discrepancy or mistake noted-by the Franklin County
Engineer in this examination of the Petition and Plat. Said
amendment shall be made by the presentation of an amended plat
and description to the Board of County Commissioners on, before,
