NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, 6 of the elected members concurring: Section 1. That the following described real estate (see attached legal description marked Exhibit "A"), situated in the Village of Dublin, State of Ohio, is hereby rezoned to P.U.D., PLANNED UNIT DEVELOPMENT DISTRICT and shall be subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter Eleven of the Codified Ordinances) the Village of Dublin Zoning Code and amendments thereto. Section 2. That application, Exhibit "B", including the list of contigu- ous property owners, and the recommendation of the Planning and Zoning Commission, Exhibit "C", are all incorporated in to and made an official part of this Ordinance and said real estate shall be developed and used in accordance therewith. February 4, 1986 Page Nine Mr. Berlin said that he liked the way that staff responded to the report and the working relationship they seem to have with the developer. Mr. Berlin made a motion to approve the rezoning. Mr. Amorose seconded the motion. The vote was unanimous in favor. Mr. Geese agreed that the road needs to be abandoned. 6. Concept Plan - The Hoag Site Mr. Bowman said that the subject site is a 122.4 acre tract bounded by Dublin Road on the west, the Scioto River on the east, and Deer Run Estates on the north, and approximately where River Forest Drive intersects Dublin Road on the south. There is a 40 acre tract between the south side of the subject tract and the north side of Donegal Cliffs Subdivision. He said that this was a Concept Plan being submitted as per the Planned Unit Development Subdivision regulations. Approval of the Concept Plan, he said, would simply be authorization to prepare the Preliminary Plan and actually file the rezoning application - the rezoning ( application has not been filed. He said that the property is presently zoned R-1; by Code the Commission has between thirty and ninety days in which to submit its report of recommendations to Council. He noted that such recommendations may be for approval, denial or approval with suggested modifications. He noted that the Concept does not bind Counc il to any particular action; there is still a rezoning process which needs to be pursued; the continguous property owners need to be notified; thus, conditions, opinions, etc. can change. The site being discussed at this meeting, Mr. Bowman said, is probably a little more advanced than an actual Concept Plan. Asked by Mr. Jezerinac what would be the commitment of the Commission with regard to the application, Mr. Bowman said that it is in anticipation of a re- zoning application that is to be filed; essentially what the developers and staff wanted to know was is if what is being proposed is an appropriate land use, is it consistent with the plans of the municipality, are there conditions on the property that people may be aware of that need a special look? Is it "ball park" or not? Mr. Darragh presented slides of the site. It was pointed out that Mr. Varga owns the 40 acre site to the south. Mr. Ben Hale, Jr. was present to represent the applicant and made the following comments: 1. Discussions have been held with the Parks and Recreation Department and the Dublin School Board about the requirements on the site. 2. Essent ia lly it is a wooded site adjacent to a 23 acre site on the north that was brought in to the Commission - a site to be developed by Mr. Fergus. . Sheet 2 of 2 CONTENTS of the CONCEPT PLAN This information provided in response to Section 1181. 07 (g)(1> of the Dublin Zoning Code: A. Topoaraphy: The exist.ing Topography <Sno....n on Plan Sheet 2) has been taken from an aerial survey. as indicated. The Site is basically flat except for the immediate area follo....ing Cosgray Ditch along the North side at Pinney Rd. In general. there is a gradual slope to the ditch, and to Frantz Road to the East. B. Existina Roads. Buildinas. and Permanent Facilities: There are 2 existing houses on the property. and several outbuildings all of ....hich are ....ood frame construction. The Site has approxi- mately 323 feet of frontage on Frantz Rd. and 547 feet along Pinney Rd. Other than the drive....ays to the farm houses. there are no roads on the site. The Site is presently overgro....n pasture. C. Jurisdictional Boundaries: The entire Site is located ....ithin the Village of Dublin. D. Easements. The East Property Line runs along the centerline of a 100' ROW for Frantz Rd. In addition there is a 50' Building Setback from the Frantz Rd. ROW. Surrounding property is developed. or presently being developed ....ith uscs sinnlar to the development proposed here, except that a single residence exists at the SW corner of Pinney Rd. See Plans for names of adjacent property o....ners. E. Physical Features and Natural Conditions: The Site is former farm pasture, overgrown with 5 to 10 year old saplings and brush. There are no significant tree masses, although there are a few mature trees along the northern part of the si tee F. Surface Drainaoe and Areas Subiect to Floodina: The Site drains naturally toward Frantz Rd. to the East, and to Cosgray Ditch along the North. The Floodplain of Cosgray Ditch is considered with respect to the northly limits of the buildings, and the ingress and egress points of the ditch's flow onto and off the site have been maintained with respect to plan location, elevations, and cross-sectional profiles. The Direct Floodway of the ditch has been re-engineered to a 48' W. floodway across this site. The plan has been reviewed with the Village Engineer for concept. The Development Plan indicates the proposed re- engineered floodway and the limits of the 100 Year Flood line as it relates to preliminary site grading. Surface Detention concepts and overall Site Drainage schemes are presently being developed, but will be be dependant upon realization of the floodway design. , G. Existino Utility Sy~tems: There are no Utility Easements or Services presently on the site except those serving each of the single houses. The Site is bounded on the north by a Sanitary Sewer, and Power & Telephone Lines. On the East, there presently exist: Power, Telephone (underground), Storm Sewer, Gas, and Water lines. H. Reoional Transportation System: Frantz Rd. is a major north-south boulevard connecting the west side of Dublin to the Bethel / Sawmill Rds. area from St. Rte. 161 via Hayden Rd. Frantz Road is a collector artery, receiving other Office Park Developments along its length, such as Metro Place South and Blazer Parkway. CONTENTS of the PRELIMINARY SITE DEVELOPMENT PLAN: The following information has been provided in response to Section 1181. 07 (g) ( 2) of the Dublin Zoning Code: A. North Point Scale: Indicated on Plans. B. Proposed Location & Size of Residential Uses: There is no proposed residential usage on the Site. C. Proposed Size & Location of Non-Residential Portions of Tract: As indicated on the Site Development Plan. Uses shall be defined in Chapter 1159 ( SO, Suburban Office & Industrial District) as permitted to be developed in accordance with this Plan. 0, Proposed Provision of Util~ties: Extension of existing Utilities ( Power, Telephone, Gas, Water and Sanitary & Storm Sewers) at the boundaries of the site ....ill satisfy all such needs. All Utilities ....ill be underground. . E. Proposed rraffic C:i:rculation Patterns: The Site Will comprise several smaller parking areas associated with each of the bui ldings, all of which feed into a central landscaped boulevard which in turn connects with Frantz Rd. See Site Development Plan. All setbacks from ROW's. and other Property Lines have been respected. F. Proposed Schedule of Site Development: The Development of the Site will commence immediately upon final approval of the Plan, and upon securing necessary construction permits.
