AN ORDINANCE TO REPEAL THE MINIMUM ACREAGE
REQUIREMENT OF SECTION 1181.07(f) AND TO
ENACT A SECTION REGARDING OWNERSHIP AND THE
AFFECT OF ANY APPROVED DEVELOPMENT PLAN.
WHEREAS, there are many existing small parcels under ten (10) acres within
the Village of Dublin; and
WHEREAS, many of these small parcels are located on major arterial streets
or adjacent to large single family lots; and
WHEREAS, it is necessary to insure these parcels development in an orderly
coordinated and comprehensive manner to preserve the public health, safety
and/or welfare;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin,
State of Ohio, 7 of the elected members concurring:
Section 1. That existing Section 1181.07(f) Area of PUD of the Codified
Ordinances is repealed and a new Section be and hereby is enacted to be
titled:
Ownership
(f) A Planned Unit Development shall be in joint or
common ownership or control at the time the appli-
cation is made for a Planned Unit Development
District. Any transfer of land within the Develop-
ment resulting in ownership within the development
by two or more parties after an application has
been filed shall not alter the applicability of the
regulations contained herein. A Development Plan
approved hereunder shall be binding upon the
applicant(s) , their successors and assigns and
sha 11 limit and control the issuance of validity
of all Certificates of Zoning Clearance.
Section 2. This Ordinance shall take effect and be in force from and after
the earliest period permitted by law.
